  1. CHARGES FOR ELECTRIC ENERGY.

The charge for electrical energy shall not exceed 9d. per unit for lighting purposes, and 3d. per unit for motor-power, heating, or cooking purposes; provided that “lighting purposes” shall include the operation of motor generators for lighting purposes.

  1. DURATION OF LICENSE.

This license shall, unless sooner determined in accordance with the provisions hereinafter expressed, continue in force for a period of forty-two years from the date hereof. Upon the expiry of the said term, or upon the sooner determination of this license by revocation or otherwise, all rights hereby granted to the licensee shall thereupon cease and determine; but such expiration or determination shall not relieve the licensee of any liability theretofore incurred under this license.

ORDER IN COUNCIL.

At the Government House at Wellington, this ninth day of October, 1916.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by section two of the Public Works Amendment Act, 1911, it is provided that no person shall lay, construct, place, put up, or use any electric line except under the authority of a license issued by the Governor in Council under that Act:

And whereas the Waimairi County Council (hereinafter referred to as “the licensee”) desires to erect electric lines within the area of supply as defined in the Schedule hereto, and hereinafter called “the area of supply,” and it is expedient accordingly to issue a license in respect thereof under the said section:

Now, therefore, in pursuance and exercise of the powers conferred upon him by the said section, and of all other powers in anywise enabling him in that behalf, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth, subject to the conditions set forth in the Schedule hereto, and to the regulations made under section two of the aforesaid Act and published in the New Zealand Gazette dated the twenty-ninth day of April, one thousand nine hundred and fifteen, and hereinafter referred to as “the regulations,” hereby authorize the licensee to erect and maintain electric lines for lighting, power, and heating purposes within the area of supply hereinafter described.

SCHEDULE.

  1. AREA OF SUPPLY.

THE area of supply comprises the County of Waimairi as at present constituted.

  1. SYSTEM OF SUPPLY.

The system of supply shall be as described in paragraphs (e) and (c) of clause 2 of the regulations.

Electrical energy shall be received from the Lake Coleridge supply at a pressure not exceeding 11,000 volts between phases, and transformed down for distribution on the three-phase system at a pressure not exceeding 3,300 volts between phases.

  1. DATUM TEMPERATURE.

For the purpose of calculating the stresses as provided in clause 12 of the regulations, the datum temperature shall be taken as 12 degrees Fahrenheit.

  1. NOTICES re EXTENSIONS, ETC.

Records of results of tests (Regulation 37), and notices re commencement of work (Regulation 44) and re extensions and alterations (Regulation 49), should be sent to the Under-Secretary, Public Works Department, Wellington, and to the Telegraph Engineer of the district, or his deputy, at present stationed at Christchurch.

Licensing William John Francis Constable to use and occupy a Part of the Foreshore at Rawene, Hokianga, as a Site for a Shop.

ORDER IN COUNCIL.

At the Government House at Wellington, this ninth day of October, 1916.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS, there being no Harbour Board empowered to grant the license hereinafter mentioned, William John Francis Constable, of Rawene (hereinafter called “the licensee”), has applied to the Governor in Council for a license under the Harbours Act, 1908 (hereinafter called “the said Act”), to occupy a part of the foreshore at Rawene, Hokianga, as a site for a saddlers and bootmakers’ shop, to be built in accordance with the plan marked M.D. 4678 (in triplicate), and in the position shown as Section No. 2 on plan M.D. 4462, and deposited in the office of the Marine Department at Wellington:

And whereas it has been made to appear to the Governor in Council that the work will not be or tend to the injury of navigation, and it is desirable that a license should be granted and issued to the licensee under the said Act for the purposes aforesaid:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred upon him by the said Act, and of all other powers and authorities enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the purpose or object for which the said license is required by the licensee as aforesaid; and, in further pursuance and exercise of the said power and authority, and with the like advice and consent as aforesaid, doth hereby license and permit the licensee to use and occupy that part of the foreshore on which the said shop is to be erected, as shown on plan marked M.D. 4462, so deposited as aforesaid, for the purpose of maintaining the said structure thereon, such license to be held and enjoyed by the licensee upon and subject to the terms and conditions set forth in the Schedule hereto.

SCHEDULE.

  1. IN these conditions the term “Minister” means the Minister of Marine as defined by the Shipping and Seamen Act, 1908, and includes any officer, person, or authority acting by or under the direction of such Minister.

  2. The concessions and privileges conferred by this Order in Council shall extend and apply only to that part of the foreshore occupied by the said shop as shown as Section No. 2 on the plan marked M.D. 4462.

  3. In consideration of the concessions and privileges granted by this Order in Council the licensee shall, on being supplied with a copy thereof, pay to the Minister the sum of £2 10s., and thereafter an annual sum of £5 in advance, dating from the date of this Order in Council, the first of such annual payments to be made on the licensee being supplied with a copy of this Order in Council.

  4. His Majesty or the Governor, and all officers in the Government service acting in the execution of their duty, shall at all times have free ingress, passage, and egress into, through, and out of the said shop without payment.

  5. The licensee shall maintain the above-mentioned shop in good order and repair.

  6. Any person authorized by the Minister may at all reasonable times enter upon the said shop and view the state of repair thereof; and upon such Minister leaving at or posting to the last known address of the licensee in New Zealand a notice in writing of any defect or want of repair in such shop, requiring him within a reasonable time, to be therein prescribed, to repair the same, he shall with all convenient speed cause such defect to be removed or such repairs to be made.
