Portion of the North-eastern Side of Well Street, in the Borough of Maori Hill, exempted from the Provisions of Section 117 of the Public Works Act, 1908, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this twenty-sixth day of January, 1915.

Present:

THE RIGHT HONOURABLE W. F. MASSEY, P.C., PRESIDING IN COUNCIL.

WHEREAS by subsection one of section one hundred and seventeen of the Public Works Act, 1908, it is, inter alia, provided that the said section shall not apply in any case where the local authority having control of a road or street by resolution declares that the provisions thereof shall not apply to any specified road or street, or any specified part thereof, and such resolution is approved by the Governor in Council:

And whereas by subsection two of section one hundred and seventeen of the Public Works Act, 1908, and clause (b) of subsection one of section thirteen of the Public Works Amendment Act, 1911, it is provided that such approval may be either absolute or subject to such conditions as the Governor in Council thinks fit to impose, and may refer to one or both sides of the road or street:

And whereas the Maori Hill Borough Council, the local authority having control of the portion of street described in the Schedule hereto (hereinafter referred to as the said portion of street) did, by resolution, declare that the provisions of the said section one hundred and seventeen should not apply to the said portion of street:

And whereas it is deemed expedient that such resolution should be approved in so far as it refers to the north-eastern side of the said portion of street, subject to the condition hereinafter mentioned:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers conferred by the above-in-part-recited Acts, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the said resolution to the extent hereinbefore mentioned, subject to the condition that no building or part of a building shall be erected at any time on the north-eastern side of the said portion of street within a distance of thirty-three feet of the centre-line of the said portion of street.

SCHEDULE.

ALL that portion of Well Street, situated in the Otago Land District, Borough of Maori Hill, adjoining Allotments 8, 7, 6, 5, and 4 of Section 8, Block II, Upper Kaikorai District, being a distance of 333 links, more or less, as the said portion of street is more particularly delineated on the plan marked P.W.D. 36339, deposited in the office of the Minister of Public Works at Wellington, in the Provincial District of Wellington, and thereon coloured red.

Prohibited Telegrams.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this twenty-sixth day of January, 1915.

Present:

THE RIGHT HONOURABLE W. F. MASSEY, P.C., PRESIDING IN COUNCIL.

WHEREAS by section one hundred and thirty-three of the Post and Telegraph Act, 1908, as amended by section seven of the Post and Telegraph Amendment Act, 1913 (hereinafter referred to as “the said Acts”), the Governor in Council is empowered to make regulations prohibiting the transmission of telegrams of a nature or character to be defined by such regulations, and authorizing officers of the Post and Telegraph Department to determine in the case of any telegram whether such telegram is within the definition of any such prohibited class:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred upon him by the said Acts, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby make the regulations set forth in the Schedule hereto; and doth order that such regulations shall come into force from the date of the publication of this Order in Council in the New Zealand Gazette.

REGULATIONS.

  1. THE transmission of telegrams of the following nature or character is hereby prohibited:—

(a.) Telegrams which are indecently or obscenely worded, or which appear to contain matter of a treasonable, seditious, libellous, or grossly offensive character.

(b.) Telegrams in plain language relating to betting or to investments on the totalizator, or in coded language reasonably supposed to relate to betting or to investments on the totalizator, addressed to any person on a racecourse.

(c.) Money-order telegrams addressed to a racing club, or to a secretary or other officer, agent, or servant of a racing club, relating to investments on the totalizator, whether addressed to a racecourse or elsewhere.

(d.) Telegrams in plain language relating to betting or to investments on the totalizator, or in coded language reasonably supposed to relate to betting or to investments on the totalizator, addressed to any person who has been convicted in a Court of law under the Gaming Act, 1908, or any amendment thereof, of any offence relating to betting or investments on the totalizator; and any money-order telegram addressed to any such person.

(e.) Telegrams relating to Customs duties during any period for which the transmission thereof is prohibited by the Minister of Telegraphs.

(f.) Telegrams instigating or aiding the commission of any criminal offence or fraud.

  1. The Secretary of the Post and Telegraph Department is hereby authorized to determine whether any telegram comes within the definition given in paragraph (a) of the last preceding regulation, and in the case of any other telegram the officer for the time being in charge of the telegraph-office at which that telegram is presented for transmission is hereby authorized to determine whether it comes within any of the other definitions contained in the last preceding regulation.

Provisions of Mortgages Extension Act, 1914, not to apply in certain cases.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this first day of February, 1915.

Present:

THE RIGHT HONOURABLE W. F. MASSEY, P.C., PRESIDING IN COUNCIL.

WHEREAS by section two of the Mortgages Extension Amendment Act, 1914 (No. 2), it is provided that the Governor may, from time to time by Order in Council gazetted, suspend the operation of the Mortgages Extension Act, 1914, for such period as he thinks fit, or may modify any of the provisions of that Act as he thinks fit, and may revoke any such Order in Council:

And whereas it is deemed expedient that the provisions of the Mortgages Extension Act, 1914, should not apply to certain agreements for the sale and purchase of leasehold interests in land:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred upon him by section two of the Mortgages Extension Amendment Act, 1914 (No. 2), doth hereby declare that from and after the date hereof the provisions of the Mortgages Extension Act, 1914, shall not apply to agreements for the sale and purchase of leasehold interests in land only, whether such agreements were entered into before or after the commencement of that Act; provided that this exemption shall not extend so as to exclude from the provisions of that Act agreements for the sale and purchase of land partly freehold and partly leasehold.
