Land proclaimed as a Road, and Road closed, in Blocks VIII, Waimate, and V, Hawera Survey Districts, Hawera County.

A PROCLAMATION.

IN pursuance and exercise of the powers conferred by section eleven of the Land Act, 1908, I, Arthur William de Brito Savile, Earl of Liverpool, the Governor of the Dominion of New Zealand, do hereby, with the consents of the owner and mortgagees of the land described in the First Schedule hereto, and of the Hawera County Council, being the local authority in whose district the said land is situated, proclaim as a road the land in Waimate and Hawera Survey Districts described in the First Schedule hereto; and also do hereby, with the like consents as aforesaid, proclaim as closed the road described in the Second Schedule hereto, which is not required by reason of the road described in the First Schedule hereto.

FIRST SCHEDULE.
LAND PROCLAIMED AS A ROAD.

APPROXIMATE area of the piece of land proclaimed as a road: 3 acres 3 roods 13 perches.
Part of Subdivision 2 of Sections 68, 69, 70, 71, 72, 79, and part 80.
Coloured on plan: Pink.

SECOND SCHEDULE.
ROAD CLOSED.

APPROXIMATE area of the piece of road closed: 3 acres 1 rood 9 perches.
Adjoining or passing through Subdivision 2 of Sections 68, 69, 70, 71, 72, 79, and part 80.
Coloured on plan: Green.

All situated in Blocks VIII, Waimate, and V, Hawera Survey Districts (Patea R.D.).

All in the Taranaki Land District; as the same are more particularly delineated on the plan marked P.W.D. 37006, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Provincial District, and thereon coloured as above mentioned.

Given under the hand of His Excellency the Right Honourable Arthur William de Brito Savile, Earl of Liverpool, Knight Grand Cross of the Most Distinguished Order of Saint Michael and Saint George, Member of the Royal Victorian Order, Governor and Commander-in-Chief in and over His Majesty’s Dominion of New Zealand and its Dependencies; and issued under the Seal of the said Dominion, at the Government House at Wellington, this thirtieth day of January, in the year of our Lord one thousand nine hundred and fifteen.

Additional Regulations under the Fisheries Act, 1908.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this twenty-sixth day of January, 1915.

Present:
THE RIGHT HONOURABLE W. F. MASSEY, P.C., PRESIDING IN COUNCIL.

WHEREAS it is, amongst other things, enacted by the fifth section of the Fisheries Act, 1908 (hereinafter termed “the said Act”), that the Governor in Council may from time to time make regulations for the purposes therein mentioned, which shall have general force and effect throughout the Dominion, or particular force and effect only in such waters or places as are specified in such regulations:

And whereas by Order in Council dated the twenty-third day of May, one thousand nine hundred and six, and published in the New Zealand Gazette of the thirty-first day of the same month, regulations were made, inter alia, prohibiting the setting of nets for the purpose of taking fish by the process known as “stalling,” whereby a net is staked or set across or within any bay, inlet, river, or creek in tidal waters of the Dominion in such a manner that the fish enclosed by such net are or may be left stranded at low tide:

And whereas it is expedient to make the regulations herein-after set forth in regard to taking fish by the said process on the mud-flats in Kaipara Harbour:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred upon him by the said Act, and of all other powers and authorities enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby make the following regulations, and doth order that they shall have force and effect on and after the date of publication thereof in the New Zealand Gazette.

REGULATIONS.

  1. NOTWITHSTANDING anything contained in clause 23 of the hereinbefore-recited regulations, it shall be lawful to take fish by the process known as “stalling” on the mud-flats in Kaipara Harbour, subject to the following conditions:—
    (a.) The size of mesh of set-nets so used shall not be less than 4½ in.
    (b.) No person or persons shall use more than 300 fathoms of set-net from one boat or launch.
    (c.) No person or persons shall join together the nets used or set by different boats or launches.
    (d.) There shall be a clear space of not less than 100 yards between the nets set by different boats, and no person shall set nets without leaving such space.
    (e.) Persons using set-nets shall frequently “under-run” them and take out the fish from the time the nets are set until the tide has run out.

  2. Any person committing a breach of the above regulations is liable to a fine of not less than £1 and not exceeding £20.

Amendment of Order in Council making Additional Regulations under the Patents, Designs, and Trade-marks Act, 1911, relating to Patents.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this first day of February, 1915.

Present:
THE RIGHT HONOURABLE W. F. MASSEY, P.C., PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers conferred on him by the Patents, Designs, and Trade-marks Act, 1911, and of all other powers enabling him in this behalf, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby amend the Order in Council under the said Act (relating to the sealing of Letters Patent after the prescribed time) dated the third day of April, one thousand nine hundred and fourteen, and published in the Gazette of the ninth day of April, one thousand nine hundred and fourteen, in the manner hereinafter appearing, namely:—

(1.) Number nine of the regulations described by the said Order is hereby amended by omitting all words after the words “part of month,” and substituting the words “from the lapse of the original application to the date of the application for sealing of the patent, 10s.”

(2.) Form number two of the Schedule to the said Order is hereby amended by inserting, after the words “application has been made,” the words “by [Insert name, address, and description of applicant].”
