Regulations under Section 100 of the Local Railways Act, 1914.

LIVERPOOL, Governor.
ORDER IN COUNCIL.

At the Government House at Wellington, this fifteenth day of November, 1915.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

IN pursuance and exercise of the powers conferred upon him by section one hundred of the Local Railways Act, 1914, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby make the following regulations for the purposes of section three of the said Act.

REGULATIONS.

  1. EVERY petition praying that any area be constituted a railway district shall be addressed to His Excellency the Governor, and shall be signed by not less than one-fourth of the ratepayers within such area.

  2. Such petition, together with the plans and declarations hereinafter mentioned, shall be sent to the Under-Secretary, Public Works Department, Wellington, for transmission to His Excellency the Governor.

  3. The petition shall describe the boundaries of the area to be constituted a railway district by reference to section boundaries, roads, or rivers, or other well-defined boundaries.

  4. Every petition shall have annexed thereto a copy of the newspaper in which such petition was publicly notified.

  5. The plan of the area of the proposed railway district must show the boundaries of boroughs, counties, road districts or town districts, or other local-governing districts, and also the section and block boundaries and numbers and the name of the survey district, parish, or hundred.

  6. Canals, rivers, roads, existing railways and tramways, must be shown on the plan of the proposed railway district.

  7. The scale of the plan shall not be less than one mile to the inch.

  8. The plan of the proposed area to be constituted a railway district shall be supplied in triplicate. Such plans shall each be mounted on drawing-paper.

  9. A statutory declaration, properly signed and stamped, must be annexed to the petition, showing the total number of the ratepayers in the proposed district.

  10. There shall also be furnished a statutory declaration, properly stamped and signed, by a person of competent knowledge or competent means of knowledge, which must be stated, verifying the signatures of the persons signing as the actual signatures of the persons purporting to sign; and such declaration shall also state whether the persons signing are ratepayers within the proposed railway district.

  11. No such petition shall be taken into consideration by His Excellency the Governor until fourteen days after the foregoing requirements have been complied with.

The Southern Side of John Street, Linwood Ward, in the City of Christchurch, exempted from the Provisions of Section 117 of the Public Works Act, 1908.

ORDER IN COUNCIL.

At the Government House at Wellington, this fifteenth day of November, 1915.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by subsection one of section one hundred and seventeen of the Public Works Act, 1908, it is, inter alia, provided that the said section shall not apply in any case where the local authority having control of any road or street by resolution declares that the provisions thereof shall not apply to any specified road or street, or any specified part thereof, and such resolution is approved by the Governor in Council:

And whereas by subsection two of section one hundred and seventeen of the Public Works Act, 1908, and clause (b) of subsection one of section thirteen of the Public Works Amendment Act, 1911, it is provided that such approval may be either absolute or subject to such conditions as the Governor in Council thinks fit to impose, and may refer to one or both sides of the road or street:

And whereas the Christchurch City Council, the local authority having control of the street described in the Schedule hereto (hereinafter referred to “as the said street”), has passed the following resolution—viz., “That the Christchurch City Council, being the local authority having control of John Street, Linwood Ward of the City of Christchurch, hereby resolves that the provisions of section one hundred and seventeen of the Public Works Act, 1908, shall not apply to the south side of the said street lying between Ensor’s Road and Osborne Street”:

And whereas it is deemed expedient that such resolution should be approved in so far as it refers to the southern side of the said street:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers conferred by the above-in-part-recited Acts, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the said resolution to the extent hereinbefore mentioned.

SCHEDULE.

ALL that street in the Linwood Ward, City of Christchurch, Canterbury Land District, known as John Street, commencing at its junction with Ensor’s Road, and proceeding thence in a north-westerly direction to its junction with Osborne Street. As the said street is more particularly delineated on the plan marked P.W.D. 38630, deposited in the office of the Minister of Public Works at Wellington, in the Provincial District of Wellington, and thereon shown edged red.

Thornton Street, St. Albans Ward in the City of Christchurch, exempted from the Provisions of Section 117 of the Public Works Act, 1908.

And whereas it is deemed expedient that such resolution should be approved:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers conferred by the above-in-part-recited Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the said resolution.

SCHEDULE.

ALL that street in the St. Albans Ward, City of Christchurch, Canterbury Land District, known as Thornton Street, commencing at its junction with Flockton and Harrison Streets, and proceeding thence in a north-westerly direction, and terminating at its junction with Shirley Road. As the said street is more particularly delineated on the plan marked P.W.D. 38922, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Provincial District, and thereon coloured red.
