Milling-timber in Nelson Land District for Sale by Public Auction.
District Land and Survey Office,
Nelson, 26th October, 1915.
NOTICE is hereby given that the undermentioned milling-timber will be offered for sale by public auction in Nelson at this office at 2.30 o’clock p.m. on Monday, 29th November, 1915, under the provisions of the Land Act, 1908, and the timber regulations thereunder.
SCHEDULE.
NELSON LAND DISTRICT.
PART Section 17, Sections 21, 22, and part 23, and lands adjoining in Blocks VI and X, Aorere Survey District.
Area of milling-timber: About 550 acres.
Timber: Rimu, kahikatea, silver-pine, and birch; approximately 6,875,000 sup. feet.
Upset price: £1,720.
CONDITIONS OF SALE.

The right to cut and remove the timber will be sold generally in accordance with the provisions of the Land Act, 1908, the timber regulations made thereunder, and the following conditions, and may contain such additional conditions as the Commissioner in his discretion considers necessary in the interests of the Crown or of the public.

The quantities of the various timbers set forth in the above Schedule are approximate only, and are furnished for the information of intending purchasers, who are expected, previous to the sale, to make their own estimates of the quantities. No contract for purchase shall be voidable, nor shall the licensee be entitled to any abatement in price, by reason of the said timber being of less quantity, quality, and kind than as stated herein, nor shall any extra sum be claimed by the Crown if for any reason the quantity of timber is found to be in excess of that stated herein.

The successful bidder shall purchase the whole of the timber in the lot, and shall on the fall of the hammer pay in cash a deposit of 5 per cent. of the amount bid, together with £1 1s. license fee. The balance of the purchase-money to be paid by fifteen equal half-yearly instalments, payable on the 1st January and 1st July in each year, the first of such payments to be made on the 1st July, 1916.

The purchaser shall have the right to cut and remove all timber on the land comprised in the license for a term of eight years from 1st January, 1916, which shall also include the period from date of sale to the said 1st January, 1916. A ground rental of £10 per annum shall be paid by the licensee for the sixth year, seventh year, and eighth year of the term. The license shall be for the cutting and removal of the timber, and shall give no right to the use of the land.

The timber shall be cut in a face, and the Crown reserves the right of following up the mill-workings by felling and grassing such areas as from time to time will have been cleared of milling-timber. Sufficient timber shall be left for fencing and general farming purposes.

The license shall be subject to any right of tramway already granted or that may hereafter be granted over the lands comprised therein, and the Land Board may authorize the laying-down and working of tram-lines through the lot by other persons than the licensee.

The licensee shall not put, throw, or place, or allow to be put, thrown, or placed, into any river, stream, watercourse, or into any place where it may be washed into any river, stream, or watercourse, any sawdust or other sawmill refuse.

If the timber is unsold at auction the right to cut it at the upset price will remain open for application until further notice.

The lots will be sold generally in accordance with the area and boundaries as shown on the sale map at the District Lands and Survey Office, Nelson.

No compensation will be given nor shall any be claimed for any error, discrepancy, or misdescription whatever in respect of these lots or in these conditions.

The attention of intending purchasers is directed particularly to clauses 9, 18, 22, and 27 of the Forest Regulations under the Land Act, 1908, dated 31st March, 1909.

NOTICE is hereby given, in pursuance of section 326 of the Land Act, 1908, that Section 10B, Block VI, Gore Survey District, Marlborough Land District, containing 336 acres 2 roods, will be disposed of under the provisions of the said Act on or after Monday, the 31st day of January, 1916.

Lighthouse Reserve at Manukau Heads for Lease.
District Lands and Survey Office,
Auckland, 27th September, 1915.
NOTICE is hereby given that written tenders will be received at this office up to 4 p.m. on Wednesday, the 17th day of November, 1915, for a lease for fourteen years of the Manukau Heads Lighthouse Reserve (excluding the portion reserved for the use of the lightkeepers), being Section N.E. 144, Awitu Parish, containing 356 acres, more or less. Lease to be subject to the Public Reserves and Domains Act, 1908, and the special conditions herein contained. Minimum annual rental, £60.
The lessee will be required to forthwith erect a suitable fence on the Manukau coast for the purpose of preventing stock from damaging the lupins growing thereon; also to repair or reconstruct as a proper legal fence the fence adjoining the lightkeepers’ reserve and to eradicate any blackberry growing on the land leased. Public right of access over any tracks across the land is reserved.
ABSTRACT OF CONDITIONS OF LEASE.

Lease to be for grazing purposes only, and subject to resumption at twelve months’ notice.

The lessee shall have no right to compensation, either for improvements put on the land or on account of the aforesaid resumption, or for any other cause; but he may, on the expiration or sooner determination of the lease, remove all buildings or fences erected by him, but not otherwise.

The lessee shall not sublet, transfer, or otherwise dispose of his interest in the lease without the written consent of the Commissioner of Crown Lands.

The lessee shall prevent the growth and spread of all noxious weeds on the land, and he shall with all reasonable despatch remove, or cause to be removed, all noxious weeds or plants as may be directed by the Commissioner of Crown Lands.

The lessee shall not be entitled to cut or make use of any timber on the land, and shall take all reasonable steps to preserve such timber from destruction by fire or otherwise.

The lessee shall discharge all rates, taxes, charges, and other assessments that may become due and payable.

Rental payments in arrear for two calendar months shall render the lease liable to termination; or a breach of covenant in the lease, expressed or implied, shall entitle the Crown to re-enter and determine the lease.

Tenders to be endorsed on the outside “Tender for Lease,” and to be accompanied by the first half-year’s rent at the rate tendered, and lease fee, £1 1s.

The highest or any tender not necessarily accepted.
