less than 30 ft. from any building, street, public place, public
or private right-of-way, or adjacent land, or in such manner,
whether in the open air or under cover, as to be, if set on fire,
dangerous to life and property.

The owner or occupier of any premises whereon any case,
crate, or package, sawdust, shavings, hay, straw, or other
inflammable substance is placed, stored, or suffered to remain
as in the last preceding by-law mentioned, upon receiving
notice in writing so to do from the Inspecting Officer, shall,
within the time specified in that behalf in such notice, and
if no time is specified in such notice then forthwith, remove
such case, crate, or other package, sawdust, shavings, hay,
straw, or other inflammable substance to some place of safety
to be approved of by the Inspecting Officer.

If the owner or occupier of any premises in the last pre-
ceding by-law mentioned shall fail to comply with any
notice given to him thereunder, it shall be lawful for
the Board or Inspecting Officer to remove or cause to be
removed the article, thing, or goods in such notice mentioned,
and to store the same in a place of safety, and (without
prejudice to any penalty incurred by such owner or occupier
in respect of the breach of any by-law) the cost of such
removal and of such storage, if any, shall be recoverable by
the Board from such owner or occupier.

Gratuities for Volunteer or other Services.

  1. For the performance of any volunteer or special services
    rendered by any person, whether a member of any brigade
    or not, in respect of any fire, there may be paid out of the
    funds of the Board such sum as the Board or any committee
    authorized by the Board may direct, not exceeding the rate
    of 2s. per hour for the time occupied in such services.

PART II.

In respect to the Maintenance of Discipline and the Ensuring
of Good-conduct on the Part of the Officers and Members of
the Brigade.

  1. (1.) No person shall interfere with or obstruct any officer
    or member of the brigade in the execution of his duties.

(2.) No person shall aid, abet, or encourage any member of
the brigade in any act of disobedience of orders, or insub-
ordination, or in the use of abusive or obscene language when
such member is on duty.

(3.) No person shall supply any intoxicating liquors to
any member or officer of the brigade while such officer or
member shall be on duty, unless he shall first have received
from the officer in charge of the brigade at the time permis-
sion to do so.

(4.) No person other than the members of the Fire Board
and its Secretary, or the members of the brigade, shall enter
any station unless they shall first have received permission
to do so from the officer in charge or a member of the Board.

(5.) No person other than an officer or member, or the wife
or child of an officer or member, of the brigade shall sleep in
or on any station, or in or on any of the Board’s premises,
without the written permission of the Superintendent.

(6.) For the purpose of the preceding paragraphs of this
part numbered (1), (2), and (3), the words “officer or mem-
ber of the brigade” shall be deemed to include officer, or
member, or auxiliary member of a volunteer fire brigade.

PART III.

In respect to the Enrolment of Persons as a Volunteer Fire
Brigade, and Control and Duties of such Persons.

  1. The Board may enrol such persons desirous of being
    so enrolled as it thinks fit as a volunteer fire brigade, and may
    from time to time enrol or deprive from membership such
    officers or members of such fire brigade as it deems necessary
    for the administration of the Act.

The volunteer fire brigade shall be under the control of
the Superintendent, and shall perform such duties as he may
appoint.

PART IV.

Conditions of Service.

  1. (1.) Every member shall obey all orders of the persons
    in authority.

(2.) Every member shall obey and conform to such regula-
tions as may from time to time be made by the Board.

(3.) No member shall absent himself from his duties unless
he shall first have received written permission from the
Superintendent, or unless he shall have given to such officer
two hours’ notice in writing.

(4.) Every member shall be liable to immediate dismissal
for negligence or misconduct, and to forfeiture of any pay
due to him not exceeding £5.

(5.) Every member shall be liable to suspension by the
Superintendent, or, in his absence, by any other responsible
officer of the brigade, for negligence or misconduct. Every
case of suspension shall be brought before the Board at its

first meeting after the suspension, and the Board may either
reinstate the member or continue the suspension for a further
period, or dismiss the member from the service.

(6.) Any member dismissed from the service, or who may
resign from the service, shall immediately thereafter deliver
up all clothes and accoutrements that have been supplied to
him by the Board; and if, in the opinion of the Superinten-
dent, any article or articles shall have been improperly used
or damaged, a deduction from the pay or moneys due to the
member shall be made sufficient to cover the loss sustained,
or such loss may be recovered by process of law.

(7.) Every member in the employ of the Board will, as
often as the Board shall consider necessary, be supplied with
a suitable uniform and accoutrements, for the safety, cleanli-
ess, and good of which the member will be held responsible.
Such uniform and accoutrements remain and are the pro-
perty of the Board; any member wilfully damaging or dis-
posing of all or any portion thereof will be prosecuted.

(8.) Every member on joining a brigade is required to
make himself acquainted with the regulations in force, and
also with such other regulations as may be made from time to
time by the Board.

(9.) No member under any pretence whatever shall leave
the locality of a fire without the instruction or permission
of the officer in charge of the fire.

(10.) No member shall be allowed to take any intoxicating
liquors while on duty without permission of the officer in
charge at a fire, or practice, or other duties.

(11.) No member shall be entitled to any pay during the
time he shall remain under suspension from duty, unless the
Board, on investigation of the circumstances, acquit him
from all blame in the matter.

(12.) Unless otherwise provided, two weeks’ written notice
given on either side shall terminate the agreement for service.

(13.) Any member being desirous of absenting himself
from the town for any reason must first obtain permission
from the Superintendent, and should the Superintendent so
desire the member must provide a substitute during such
absence.

(14.) The Superintendent may grant leave of absence at
any time to such number of the men as the Board may approve.

(15.) There shall be held during each year not less than
twelve drills or practices at times and places to be decided
upon by the Superintendent. Any member of the brigade
who fails to attend two-thirds of the practices or drills, or
two-thirds of the fire-calls received during each year, shall
be deemed to have forfeited his membership, and must be
dismissed by the Superintendent.

The foregoing by-laws were made by the New Plymouth
Fire Board on the 24th day of September, 1915, and sealed
on the 13th day of October, 1915.

Brigade.

I HEREBY apply to be enrolled as a member of the New
Plymouth Volunteer Fire Brigade, and, if accepted, agree to
serve under the conditions set forth in a by-law of the New
Plymouth Fire Board intituled “By-law for the Enrolment
of Persons as a Volunteer Fire Brigade, and Control and Duties
of such Persons,” and to obey all lawful orders given by the
Superintendent or other superior officer. I further agree to
serve three months, or until I shall be lawfully discharged;
and I declare that the answers given to the questions below
are true and correct in every particular.
