Land taken for the Purposes of Access to Drill-shed, Auckland, in Block VIII, Rangitoto Survey District.

A PROCLAMATION.

WHEREAS the land described in the Schedule hereto is required to be taken, under the Public Works Act, 1908, for a certain public work—to wit, for the purposes of access to drill-shed, Auckland, in Block VIII, Rangitoto Survey District:

And whereas all the conditions precedent required by law to be observed and performed prior to the taking of such land for the purposes hereinbefore specified have been observed and performed:

Now, therefore, I, Arthur William de Brito Savile, Earl of Liverpool, the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities vested in me by the Public Works Act, 1908, and of every other power and authority in anywise enabling me in this behalf, do hereby proclaim and declare that the land described in the Schedule hereto is hereby taken for the purposes of access to the said drill-shed; and I do also declare that this Proclamation shall take effect on and after the thirteenth day of February, one thousand nine hundred and fifteen.

SCHEDULE.

APPROXIMATE area of the piece of land taken: 12·12 perches. Being Lot 8 of Allotment 5 of Section 13, City of Auckland (16784, blue).

Situated in Block VIII, Rangitoto Survey District.

In the Auckland Land District; as the same is more particularly delineated on the plan marked P.W.D. 32494, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Provincial District, and thereon edged pink.

Given under the hand of His Excellency the Right Honourable Arthur William de Brito Savile, Earl of Liverpool, Knight Grand Cross of the Most Distinguished Order of Saint Michael and Saint George, Member of the Royal Victorian Order, Governor and Commander-in-Chief in and over His Majesty’s Dominion of New Zealand and its Dependencies; and issued under the Seal of the said Dominion, at the Government House at Wellington, this twentieth day of January, in the year of our Lord one thousand nine hundred and fifteen.

Revoking a Proclamation taking Land for the Purposes of a Road in Block V, Waiawa Survey District.

A PROCLAMATION.

WHEREAS by the Public Works Amendment Act, 1909, it is enacted that if at any time after the issue of any Proclamation taking land under the Public Works Act, 1908, and before the payment or award of any compensation in respect of the taking thereof, it is found that the land or any part thereof is not required for the purpose for which it was taken, or that any error in form or substance exists in or in relation to that Proclamation, or the making or gazetting thereof, the Governor may, by a subsequent Proclamation gazetted, revoke the former Proclamation either wholly or so far as he thinks necessary:

And whereas it is found that the land in Block V, Waiawa Survey District, taken for the purposes of a road by a Proclamation made under the Public Works Act, 1908, dated the thirty-first day of July, one thousand nine hundred and fourteen (hereinafter termed “the said Proclamation”), and published in the New Zealand Gazette No. 76, page 3052, of the sixth day of the following month, is not required for the purpose for which it was taken: And whereas compensation in respect of the taking of the said land has not been paid or awarded:

Now, therefore, I, Arthur William de Brito Savile, Earl of Liverpool, the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers vested in me by the Public Works Amendment Act, 1909, and of all other powers enabling me in this behalf, do hereby revoke the said Proclamation.

Bringing certain Provisions of the Mining Act into Force within certain Parts of New Zealand.

LIVERPOOL, Governor.

ORDER IN COUNCIL.

At the Government House at Wellington, this nineteenth day of January, 1915.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by section two of the Mining Amendment Act, 1911, it is provided that the Governor, by Order in Council, may from time to time declare that any of the provisions of the Mining Act, 1908, shall apply to prospecting and mining for and the storage of petroleum and other mineral oils and of natural gas, and also define the districts within which any such Order in Council shall take effect:

Now, therefore, in pursuance and exercise of the powers and authorities conferred on him by the said Act, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby declare that the provisions of the Mining Act, 1908, set out in the First Schedule hereto shall apply to prospecting and mining for and the storage of petroleum and other mineral oils and of natural gas within the district described in the Second Schedule hereto.

WHEREAS there being no Harbour Board empowered to grant the license hereinafter mentioned under the Harbours Act, 1908 (hereinafter called “the said Act”), Albyn Walter Cheeseman, Murdoch Munro, and Henry Norman, as trustees for the inhabitants of the district (hereinafter called “the licensees”), have applied to the Governor in Council for a license under the said Act to occupy a part of the foreshore, and land below low-water mark adjacent thereto,
