Warrant vesting Portion of Great South Road in the Remuera Road Board, the One-tree Hill Road Board, the Ellerslie Town Board, and the Mount Wellington Road Board, and apportioning the Cost of the Maintenance of the same.

LIVERPOOL, Governor.

WHEREAS by section twelve of the Public Works Amendment Act, 1909 (hereinafter termed "the said Act"), it is provided that where a road or street lies along the boundary of two or more districts, whether that road or street is wholly within one or is partly within one and partly within another of those districts, or is within none of those districts, the Governor may from time to time, by Warrant under his hand and gazetted, direct which of the local authorities of those districts shall have control of the road or street or any part thereof; and may in like manner determine from time to time whether any of those local authorities shall contribute to the cost of the construction and maintenance of that road or street, and, if so, in what proportions:

And whereas the portion of road known as the Great South Road, described in the Schedule hereto, and hereinafter termed “the said road,” forms part of the boundary between the One-tree Hill Road District and the Remuera Road District, the Ellerslie Town District and the Mount Wellington Road District:

And whereas a dispute has arisen as to which local authority should have control of the said road, and what proportion of the cost of maintaining the said road should be borne by the local authorities affected: And whereas an inquiry was held and a report made in respect to the matter: And whereas it is expedient that effect should be given to the recommendations contained in the said report, and that provision should be made under the said Act for the purposes and in the manner hereinafter set forth:

Now, therefore, I, Arthur William de Brito Savile, Earl of Liverpool, the Governor of the Dominion of New Zealand, in pursuance and exercise of the power and authority vested in me by the said Act, and of all other powers and authorities in anywise enabling me in this behalf, do hereby direct that the several portions of the said road shall, from and after the date of this Warrant, be under the control respectively of the local authorities as are hereinafter mentioned; and, in further pursuance and exercise of the aforesaid powers and authorities, I do hereby fix and determine that the cost of maintaining the said road shall be borne as hereinafter mentioned—viz., that portion of the said road from Epsom Junction to centre-line of Sheep Dip Road, a distance of about sixty-nine chains, shall be under the control of and maintained by the Remuera Road Board; those portions of the said road from the centre-line of Sheep Dip Road to the centre-line of Glasgow Road, a distance of about one hundred and fifty-six chains, and from the centre-line of Church Road to Saint Anne’s Bridge, a distance of about forty-six chains, shall be under the control of and maintained by the One-tree Hill Road Board; that portion of the said road from the centre-line of Glasgow Road to the centre-line of the road which junctions with the said road at Dickson’s Corner, a distance of about fifty-two chains, shall be under the control of and maintained by the Ellerslie Town Board; and that portion of the said road from the centre-line of the road which junctions with the said road at Dickson’s Corner to the centre-line of Church Road, a distance of about fifty-eight chains, shall be under the control of and maintained by the Mount Wellington Road Board.

SCHEDULE.

All that portion of road in the Auckland Land District, known as the Great South Road, situated between the Remuera Road District, the One-tree Hill Road District, the Ellerslie Town District, and the Mount Wellington Road District, commencing at its junction with Epsom Road and running in a south-easterly direction to Saint Anne’s Bridge, being a distance of 381 chains, more or less; as the said portion of road is more particularly delineated on the plan marked P.W.D. 36153, deposited in the office of the Minister of Public Works at Wellington, in the Wellington Provincial District, and thereon coloured red and lettered X Y.

As witness the hand of His Excellency the Governor, this twenty-fourth day of August, one thousand nine hundred and fourteen.

Warrant authorizing the Wairarapa South County Council to construct a Bridge over the Waiohine River, near Carterton, and apportioning the Cost.

LIVERPOOL, Governor.

WHEREAS by section one hundred and nineteen of the Public Works Act, 1908 (hereinafter termed “the said Act”), it is, inter alia, enacted that in any case where the local authority of any district desires to construct a bridge, or to establish a ferry or ford, in any position that will, in its opinion, be of advantage or benefit to the whole or any considerable portion of the inhabitants of an adjacent district as well as to the inhabitants of its own district, and where it is in the opinion of such local authority reasonable that the local authority of such adjacent district should contribute to the cost of constructing or establishing the said bridge, ferry, or ford, the provisions of the said section shall have effect:

And whereas the Wairarapa South County Council has given notice and taken the steps required by the said Act, and has made application to the Governor to authorize the construction of the bridge mentioned in the Schedule hereto, and hereinafter referred to as “the said bridge,” and to apportion the cost of constructing and establishing the said bridge between the said Council and certain other local authorities:

And whereas it is also provided in the said Act that the Governor (with the view of determining whether or not the work should be done, or what proportion, if any, of the cost of the same should fairly be borne by any local authority, or what local authority should do the work) may direct any Magistrate or other person to be a Commissioner to inquire into and report to him on the matter:

And whereas a Commissioner was appointed, and an inquiry was duly held, in the manner provided by the said Act, in respect to the said bridge, and in respect also to the apportionment of the cost of constructing the said bridge:

And whereas such Commissioner did report to the Governor, after due inquiry, his opinion as to the matters respecting which he was appointed to report:

And whereas I am of opinion that the work should be done, and it is expedient to make provision under the said Act for the purposes and in the manner hereinafter set forth:

And whereas by the Public Works Amendment Act, 1913, it was declared and enacted that the words in subsection three of section one hundred and nineteen of the Public Works Act, 1908, “any order which may be made by the Governor hereunder” should be deemed to include any authority conferred on any local authority to execute any work and any declaration that any proportion of the cost of any work should be borne by any local authority, and that the authority to borrow conferred by the said section one hundred and nineteen should be deemed to extend to the local authority authorized to execute any work, and that the limit of any authority to borrow under the said section should, if the Governor thought fit, be set out in the Governor’s Warrant:

And whereas it is desirable to set out the limits to which the said Wairarapa South County Council and the said Featherston County Council, Carterton Borough Council, and Greytown Borough Council are respectively entitled to borrow under the said section one hundred and nineteen of the Public Works Act, 1908:

Now, therefore, I, Arthur William de Brito Savile, Earl of Liverpool, the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers vested in me by the said Act, and of all other powers and authorities in anywise enabling me in this behalf, do hereby authorize the Council of the County of Wairarapa South to execute the said work; and I do hereby declare that the cost thereof, less such contribution as may be made thereto (if any) by the Government of New Zealand, shall be borne in the following proportions, viz.: The Wairarapa South County Council to bear seven-sixteenths, the Carterton Borough Council to bear one-
