And whereas His Excellency the Governor is of opinion that the said local authority can conveniently construct and maintain the said road:

Now, therefore, I, Arthur William de Brito Savile, Earl of Liverpool, the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities vested in me by section one hundred and ninety-seven of the Public Works Act, 1908, and of every other power and authority in anywise enabling me in this behalf, do hereby proclaim and declare that the land described in the Schedule hereto shall, upon the publication hereof in the New Zealand Gazette, become a road, and that the said road shall be under the control of the Dannevirke County Council, and shall be maintained by the said Council in like manner as other public highways are controlled and maintained by the said Council.

Given under the hand of His Excellency the Right Honourable Arthur William de Brito Savile, Earl of Liverpool, Knight Commander of the Most Distinguished Order of Saint Michael and Saint George, Member of the Royal Victorian Order, Governor and Commander-in-Chief in and over His Majesty's Dominion of New Zealand and its Dependencies; and issued under the Seal of the said Dominion, at the Government House, at Wellington, this fourth day of September, in the year of our Lord one thousand nine hundred and thirteen.

A PROCLAMATION.

WHEREAS the land described in the Schedule hereto is required to be taken for a portion of the East Coast Main Trunk Railway (Maunganui Bluff–Te Puke Section) and for a road approach thereto:

And whereas all the conditions precedent required by law to be observed and performed prior to the taking of such land for the purposes hereinbefore specified have been observed and performed:

Now, therefore, I, Arthur William de Brito Savile, Earl of Liverpool, the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred on me by section one hundred and eighty-eight of the Public Works Act, 1908, and of every other power and authority in anywise enabling me in this behalf, do hereby proclaim and declare that the land described in the Schedule hereto is hereby taken for a portion of the said line of railway hereinbefore specified, and for the road approach thereto as aforesaid.

Altering the Boundaries of Mangonui and Whangaroa Counties.

LIVERPOOL, Governor.

ORDER IN COUNCIL.

At the Government House, at Wellington, this tenth day of November, 1913.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS in exercise of the powers conferred by section sixteen of the Counties Act, 1908 (hereinafter termed “the said Act”), the Mangonui County Council and the Whangaroa County Council respectively did, by an instrument bearing date the twenty-second day of September, one thousand nine hundred and thirteen, formally agree that the boundaries of the said counties shall be altered to the extent set forth in the said instrument and also in the Schedule hereto: And whereas it is expedient that such alteration of boundaries be approved by the Governor in Council, and that such altered boundaries be defined in terms of the said Act:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred by the said Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that, on and after the publication of these presents in the New Zealand Gazette, the boundaries of the Counties of Mangonui and Whangaroa respectively shall be those set forth under their respective headings in the Schedule hereto.

SCHEDULE.

MANGONUI COUNTY.

ALL that area in the Auckland Land District bounded towards the north and north-east generally by the sea from Cape Maria van Diemen to a point in line with the western boundary of Section No. 73, Block III, Mangonui Survey District; thence towards the east generally by a right line across a road reserve to the north-western corner of the said Section No. 73; thence by that section, Motukahakaha No. 1 Block, Section No. 9, Block VII, Mangonui Survey District, and the northern and southern parts of Section No. 61 to Stony Stream; thence by Stony Stream to Old Land Claim No. 103 (J. Berghan) in Block XI, Mangonui Survey District; thence by the north-eastern boundary of the said old land claim to Section No. 1, Kohumaru Parish; thence by that section to the Wainui River, across that river, by the north-western portion of Section No. 114, the abutment of a road, Section No. 113, Kohumaru Parish, and Mangahoutoa Block to the road forming the eastern boundary of Section No. 68, Mangonui Parish; thence by the eastern side of the road forming the eastern boundaries of Sections Nos. 68, 67, 64, 63, Mangonui Parish, and forming the south-eastern boundaries of Sections Nos. 10 and 7, Block III, Maungataniwha Survey District, to the north-eastern boundary of Maungataniwha East Parish; thence by the north-eastern boundary of that parish to the Wainui River; thence towards the south-east generally by the northern boundary of Hokianga County as described in the First Schedule to the Counties Act, 1876, to the Herekino River, and by that river to the sea; and thence towards the south-west generally by the sea to Cape Maria van Diemen, the place of commencement.
