Resuming Land for a Site for a Public School, Matawai Town-
ship, Hawke’s Bay Land District.

A PROCLAMATION.

WHEREAS by section one hundred and forty-four of
the Land Act, 1908 (hereinafter termed “the said
Act”), it is, inter alia, enacted that the Governor in Council
may by Proclamation resume possession of any land leased
under Part III of the said Act, or under any corresponding
Part of the Land Act, 1892, which in his opinion is required
for any public purpose:

And whereas the land described in the Schedule hereto
forms part of land which is held under lease in perpetuity
from His Majesty the King under Part III of the Land Act,
1892, dated the twenty-fifth day of August, one thousand nine
hundred and eleven:

And whereas, in the opinion of the Governor, the land
mentioned in the Schedule hereto is required for a public
purpose—that is to say, for a site for a public school:

Now, therefore, in pursuance and exercise of the powers
and authorities conferred upon me by the Land Act, 1908,
and of all other powers and authorities in anywise enabling
me in this behalf, I, Arthur William de Brito Savile, Earl of
Liverpool, the Governor of the Dominion of New Zealand,
acting by and with the advice and consent of the Executive
Council of the said Dominion, do hereby proclaim and declare
that I hereby resume possession of the land mentioned in
the Schedule hereto for the public purpose hereinbefore
mentioned, the same being part of the land held under
lease in perpetuity as aforesaid.


SCHEDULE.

ALL that area in the Hawke’s Bay Land District, containing
by admeasurement 2 acres, more or less, being Section 16,
Block III, Matawai Township, Block X, Motu Survey Dis-
trict. Bounded towards the north-west by Kura Street for
a distance of 359·9 links; towards the north-east by Sec-
tions 15 and 25 of Block III, Matawai Township, for a dis-
tance of 507·9 links; towards the south-east by Sections 25
and 17 of said Block III, for a distance of 390·8 links; and
towards the south-west by Kerei Street for a distance of
79·87 and 469·05 links: be all the aforesaid linkages more or
less: as the same is delineated on the plan marked L. and S.
1913/919, deposited in the Head Office, Department of Lands
and Survey, at Wellington, and thereon coloured purple.

Amending Part of a Proclamation proclaiming Land as a Road
in Block VIII, Kawhia South Survey District, Kawhia
County.

A PROCLAMATION.

WHEREAS by section five of the Land Act, 1908, it is
therein provided that every Proclamation, Order
in Council, or other instrument, whether made under any
Act in force prior to the commencement of that Act, or
made under or by virtue of that Act, and all regulations,
by-laws, conditions, or rules made by the Governor, the
Minister, or any Land Board, may be altered, amended, or
revoked from time to time:

And whereas it is necessary to amend a Proclamation
issued under the said Act, proclaiming land as a road in
Kawhia South Survey District, dated the sixth day of August,
one thousand nine hundred and thirteen, and published in
the New Zealand Gazette of the fourteenth day of the same
month, and hereinafter referred to as “the said Proclama-
tion”:

Now, therefore, I, Arthur William de Brito Savile, Earl of
Liverpool, the Governor of the Dominion of New Zealand,
in pursuance and exercise of the power and authority vested
in me by the said Act, do hereby amend the said Proclama-
tion as follows—namely, by the substitution of XII in lieu
of VIII in the heading and in the third column of the Schedule
to the said Proclamation.

Most Distinguished Order of Saint Michael and
Saint George, Member of the Royal Victorian

September, in the year of our Lord one thousand

Declaring Land taken for a Public Work, and not required
for such Public Work, to be Crown Land.

A PROCLAMATION.

WHEREAS it is provided by section thirty of the
Public Works Act, 1908, that if it is found that any
land held, taken, purchased, or acquired at any time under
this or any other Act or Provincial Ordinance, or otherwise
howsoever, for any public work, is not required for such
public work, the Governor may, by an Order in Council
publicly notified and gazetted, cause the same to be sold
under the conditions therein mentioned:

And whereas it is further provided by section five of the
Public Works Amendment Act, 1909, that in the case of
any land so taken, purchased, or acquired for a Government
work and not required for that purpose, the Governor
may, on the recommendation of the Minister, and without
complying with any other requirements of the aforesaid
section thirty, by Proclamation declare such land to be
Crown land subject to the Land Act, 1908, and thereupon
the land may be administered and disposed of under that
Act accordingly:

And whereas the land described in the Schedule hereto
was taken for a road: And whereas such road has been
closed, and it is desirable to declare the land contained
therein to be Crown land: And whereas a plan has been
prepared, and the Minister has recommended the Governor
to declare such land to be Crown land:

Now, therefore, in pursuance and exercise of the powers
and authorities conferred upon me by the above-in-part-
recited Acts, and of all other powers in anywise enabling
me in this behalf, I, Arthur William de Brito Savile, Earl
of Liverpool, the Governor of the Dominion of New Zealand,
do hereby declare the land described in the Schedule hereto
to be Crown land subject to the Land Act, 1908, and that
such land may be administered and disposed of under that
Act accordingly.
