Authorizing the Otago Harbour Board to reclaim Land in Koputai Bay, Otago Harbour.

ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this thirty-first day of May, 1913.
Present:
THE HONOURABLE W. F. MASSEY PRESIDING IN COUNCIL.
WHEREAS it is provided by the one-hundred-and-fifty-eighth section of the Harbours Act, 1908 (hereinafter termed “the said Act”), that where a Harbour Board is desirous of executing or constructing any harbour-works upon lands vested in such Board, or upon lands of the Crown, of such a nature that the same could, but for this section, only be carried out and executed under the authority of a special Act, the Board may apply to the Governor in Council for a special order, and, if the Governor in Council thinks fit, such order may be made and granted:
And whereas the Otago Harbour Board (hereinafter called “the Board”) is desirous of reclaiming from the sea certain land in Koputai Bay, Otago Harbour, for the purpose of constructing the reclamation hereinafter described, and the said work is of such a nature as aforesaid, and the Board has applied to the Governor in Council for the issue of a special order:
And whereas the conditions precedent to the granting of a special order prescribed by the said Act have been duly performed and observed, and it appears expedient that such order should be made:
And whereas it has been made to appear to the Governor in Council that the proposed work will not be or tend to the injury of navigation:
Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the power and authority vested in him by the said Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby authorize and empower the Board to reclaim certain land from the sea in Koputai Bay, Otago Harbour, as shown on plan marked M.D. 4069, such reclamation to be carried out and constructed in accordance with plan marked M.D. 4069, subject to the provisions of the said Act, the work to be completed within three years from the first day of July, one thousand nine hundred and thirteen.

At the Government Buildings, at Wellington, this seventh day of June, 1913.

WHEREAS by the Public Works Act, 1908, it is, in section fifteen thereof, inter alia, enacted that, except for the purpose of a railway or defence purposes, or for the purposes of any other work to be made under the authority of a special Act, nothing in this Act contained shall authorize the taking of any land occupied by any building, yard, garden, or vineyard, or in bona fide occupation as an ornamental park or pleasure-ground, without the previous consent of the Governor in Council:
And whereas part of the land described in the Schedule hereto is occupied by orchards, yards, gardens, or buildings, and the Minister of Public Works has recommended the Governor to issue an Order in Council under the said Act consenting to the taking of the said land for the purposes of the development of the Lake Coleridge Water-power Scheme in Blocks X and XI, Christchurch Survey District, Waimairi County:
Now, therefore, in pursuance and exercise of the above-in-part-recited Act, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the land described in the Schedule hereto being taken for the purposes above mentioned.

Declaring Portion of the Oio Road, in the Kaitieke County, to be a County Road.

ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this thirty-first day of May, 1913.

THE HONOURABLE W. F. MASSEY PRESIDING IN COUNCIL.
IN pursuance and exercise of the powers vested in him by the Public Works Act, 1908, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the portion of road described in the Schedule hereto shall, on and after the date of this Order in Council, become a county road.
SCHEDULE.
ALL that portion of road in the Wellington Land District, Kaitieke County, known as the Oio Road, commencing at the boundary between Section 18, Block III, and Section 9, Block VII, Kaitieke Survey District, and proceeding generally in a south-westerly direction for a distance of 62 chains or thereabouts along the frontage of Section 9, Block VII aforesaid; as the said portion of road is more particularly delineated on the plan marked P.W.D. 33560, deposited in the office of the Minister of Public Works, at Wellington, in the Wellington Provincial District, and thereon coloured red.
