Adjustment of a Loan between the One-tree Hill Road Board and Onehunga Borough Council.

ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this eleventh day of February, 1913.

THE HONOURABLE W. F. MASSEY PRESIDING IN COUNCIL.
WHEREAS by section ninety-one of the Local Bodies’ Loans Act, 1908 (hereinafter called “the said Act”), it is provided that where part of the area over which a special rate is made as security for a loan is merged or included within the district of a local authority other than the local authority that made the rate, then, upon the written application of the local authority that raised the loan, or of the Minister, the Governor in Council may adjust or apportion the liability in respect of such loan among the respective local authorities affected by such merger or inclusion: And whereas part of the area over which the special loan of one thousand five hundred pounds for remaking about one mile and a quarter of Manukau Road was raised by the One-tree Hill Road Board has been included in the Borough of Onehunga: And whereas the inscribed amount of such loan is one thousand five hundred and forty-one pounds eighteen shillings and fourpence: And whereas it has been mutually agreed between the One-tree Hill Road Board and the Onehunga Borough Council that, upon payment of the sum of fifty-seven pounds eleven shillings by the said Council to the said Board, the One-tree Hill Road Board would release and discharge the area so included in the said borough as aforesaid, and also the said borough from the payment of the said special loan of one thousand five hundred pounds, and any part thereof, and from the special rate levied in respect thereof: And whereas written application has been made to the Governor in Council to adjust the liability in respect of such loan in accordance with the said agreement:
Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred on him by the said Act, and of every other power and authority enabling him in this behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby declare that from the date of the payment of the said sum of fifty-seven pounds eleven shillings by the Onehunga Borough Council to the One-tree Hill Road Board the liability in respect of the said loan of one thousand five hundred pounds shall be and continue to be the liability of the said One-tree Hill Road Board in respect of the One-tree Hill Road District as now constituted, and the said liability is hereby adjusted accordingly.

Altering the Boundaries of Ohura and Whangamomona Counties.

WHEREAS, in exercise of the powers conferred by section sixteen of the Counties Act, 1908 (hereinafter termed “the said Act”), the Ohura County Council and the Whangamomona County Council respectively did, by an instrument bearing date the twentieth day of December, one thousand nine hundred and twelve, formally agree that the boundaries of the said counties should be altered to the extent set forth in the said instrument and also in the Schedule hereto: And whereas it is expedient that such alteration of boundaries be approved by the Governor in Council, and that such altered boundaries be defined in terms of the said Act:
Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred by the said Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that, on and after the publication of these presents in the New Zealand Gazette, the boundaries of the Counties of Ohura and Whangamomona respectively shall be those set forth under their respective headings in the Schedule hereto.
SCHEDULE.
OHURA COUNTY.
ALL that area in the Taranaki Land District bounded towards the north generally by the Paraheka Stream from the left bank of the Mokau River to the north-eastern corner of the Umukaimata No. 5B Block, Section No. 2; thence by the south-eastern boundary of that section to Section No. 2, Block V, Aria Survey District; thence by the said Section No. 2 and Sections Nos. 3 and 8 of the said Block V to the Waitewhena Road; thence across and by that road to the south-western corner of Section No. 6, Block VI, Aria Survey District; thence by Sections Nos. 6, 9, and 10 of Block VI aforesaid, and Section No. 7 of Block III of the said district to the Mokau Road; thence across that road and by Section No. 10 of Block III aforesaid, to the Puhanga Block; thence by part of the south-western boundary of that block and by the southern boundary of Block IV, Aria Survey District, and Blocks I, II, and III, Tangitu Survey District, to the Ongarue River; thence towards the south-east generally by that river to its junction with the Wanganui River; thence by the Kaitieke County, as described in the First Schedule to the Kaitieke County Act, 1910, to a point opposite the mouth of the Ohura River; thence towards the south-west generally by a right line to and by the middle of the Ohura River till it is intersected by the 39th parallel of south latitude; towards the south by the said 39th parallel of south latitude to the west boundary of Block IV, Pouatu Survey District; towards the west generally by that boundary and the west boundary of Block XVI, Waro Survey District, to the confiscation boundary-line; thence by that line to the Tarangahakau Stream; thence by that stream, and by the Waitaanga Stream to the Kotare Road at the southern boundary of Section No. 2, Block VII, Waro Survey District; thence by the Clifton County, as described in the New Zealand Gazette No. 65, of the 1st August, 1912, page 2379, to the Mokau River, and by that river to the place of commencement.
WHANGAMOMONA COUNTY.
All that area in the Taranaki Land District bounded towards the north-west generally by the Clifton County, from the northern boundary of Stratford County to the south-western corner of the Ohura County, hereinbefore described; thence towards the north by the last-mentioned county to the middle of the Wanganui River; thence towards the south-east by a line along the middle of that river to its confluence with the Tarangahakau Stream, and thence by a right line to the Trig. Station on Mount Humphries; and thence towards the south-west generally by the Stratford County to the place of commencement.
