Consenting to closing a Road in Block VI, Newcastle Survey District, Raglan County.

ORDER IN COUNCIL.
At the Government House, at Wellington, this eighteenth day of November, 1912.
Present:
His Excellency the Governor in Council.
WHEREAS by section one hundred and thirty-three (a) of the Public Works Act, 1908, it is enacted that a local authority shall not declare any county road or district road to be stopped until the consent thereto of the Governor by Order in Council gazetted is obtained:
And whereas the Raglan County Council has applied for such consent in respect to the road described in the Schedule hereto:
Now, therefore, in pursuance and exercise of the above-in-part-recited Act, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the Raglan County Council closing the road described in the Schedule hereto.

Consenting to the Chief Judge of the Native Land Court granting Leave to Appeal.

ORDER IN COUNCIL.
At the Government House, at Wellington, this eighteenth day of November, 1912.

His Excellency the Governor in Council.
WHEREAS subsection one of section fifty of the Native Land Act, 1909, enacts that at any time and from time to time, on application made ex parte or otherwise by any person interested, the Chief Judge may, if he thinks fit, on being satisfied that the applicant has shown a prima facie case of error, whether of fact or law, in any final order of the Native Land Court, grant leave to the applicant to appeal to the Appellate Court against that order, notwithstanding the fact that, owing to lapse of time or for any other reason, the applicant has no appeal as of right to that Court:
And whereas subsection two of that section further enacts that, save with the precedent consent of the Governor in Council, leave to appeal shall not be granted by the Chief Judge under this section unless application for same is made within five years after the making of the order appealed from:
And whereas application having been made to His Honour the Chief Judge of the Native Land Court to grant leave to appeal against the decision of the Native Land Court, dated the twentieth day of October, one thousand eight hundred and ninety-eight, in respect of the succession to the interests of Tihirangi, deceased, in Ngatitanewai and other blocks: And whereas it is expedient that such leave to appeal should be granted:
Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred upon him by subsection two of section fifty of the Native Land Act, 1909, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the Chief Judge granting the applicant leave to appeal as aforesaid. And it is hereby declared that this Order in Council is made under the provisions in that behalf of the Native Land Act, 1909, and shall operate accordingly as a consent of the Governor in Council to the proceedings hereby authorized.

Declaring Portions of Roads, known as Kumara to Beach, Kumara to Ross Main Road, and Kumara to Springfield Main Road, in the Westland County, to be County Roads.

At the Government House, at Wellington, this eighteenth day of November, 1912.

His Excellency the Governor in Council.
IN pursuance and exercise of the powers vested in him by the Public Works Act, 1908, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the portions of roads described in the Schedule hereto shall, on and after the date of this Order in Council, become county roads.

SCHEDULE.
ALL that portion of road situated in the Westland Land District, Westland County, known as the Kumara to Beach Road, commencing at its junction with the north-western boundary of the Kumara Borough, and proceeding thence in a north-westerly direction generally through Reserve No. 203 (Kumara Borough Endowment), forming the north-eastern boundaries of Sections 609, 580 to 592, Blocks VII, XI, and XII, Waimea Survey District; thence through the remainder of Block VII, Waimea Survey District, to the sea-beach, and terminating near the northernmost corner of Section 1289 of the said Block VII, Waimea Survey District, being a distance of about five miles.
Also all that portion of road situated in the Westland Land District, Westland County, known as the Kumara to Ross main road, commencing at its junction with the south-western boundary of the Borough of Kumara, and proceeding thence in a southerly direction generally through part of Block XII and Block XVI, Waimea Survey District; thence in a north-westerly direction generally through Blocks XV and XIV, Waimea Survey District; thence in a south-westerly direction generally through Block XIII, Waimea Survey District, and part of Block I, Kanieri Survey District, to its junction with the north-eastern boundary of the Hokitika Borough, being a distance of about seventeen miles. Commencing again at its junction with the south-eastern boundary of the Hokitika Borough, and proceeding thence in a southerly direction generally through Blocks I and IV, Kanieri Survey District; thence in a south-westerly direction generally through Blocks VIII, XII, XI, XV, and XIV, Mahinapua Survey District, and terminating at its junction with the north-eastern boundary of the Ross Borough, being a distance of about twenty miles.
Also all that portion of road in the Westland Land District, Westland County, known as the Kumara-Springfield main road, commencing at its junction with the south-eastern boundary of the Kumara Borough, and proceeding thence in a south-easterly direction generally through part of Block XII and Block XVI, Waimea Survey District, south-western corner of Block XIII, Hohonu Survey District, Blocks I, II, and VI, Turiwhate Survey District; thence in a north-easterly direction generally through Block VII, north-western corner of Block VIII, through Block IV, Turiwhate Survey District; thence in a south-easterly direction generally through Blocks I, VI, and part of Block VII, Otira Survey District; thence in a south-westerly direction generally through part of Block VII, south-eastern corner of Block VI, and part of Block X, Otira Survey District, and terminating at a point in the said Block X, Otira Survey District, opposite the Otira Railway-station, being a distance of about forty miles.
As the said roads are more particularly delineated on the plan marked P.W.D. 32588, deposited in the office of the Minister of Public Works, at Wellington, in the Wellington Provincial District, and thereon coloured red.
