Making Further Regulation under the Land and Income Assessment Act, 1908.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-eighth day of October, 1912.

Present:
His Excellency the Governor in Council.

IN exercise and pursuance of all powers and authorities vested in him by the Land and Income Assessment Act, 1908, and its amendments (hereinafter termed “the Acts”), His Excellency the Governor of the Dominion of New Zealand, by and with the advice and consent of the Executive Council of the said Dominion, doth hereby make the following regulation under and for the purposes of the said Acts, that is to say.

REGULATION.

The form of return of income required by the Acts to be made by or on behalf of an agent of a non-resident trader, or by or on behalf of a non-resident trader or a consignee, shall be that set forth in the Schedule hereto.

This regulation takes the place of Regulation No. 16, made by Order in Council dated the 18th day of March, 1901, and published in the New Zealand Gazette of the 28th March, 1901.

SCHEDULE.

RETURN OF INCOME BY AGENT, CONSIGNEE, OR NON-RESIDENT TRADER.

The Land and Income Assessment Act, 1908, and the Land and Income Assessment Amendment Act, 1912.

In pursuance of the above Acts, every agent for a non-resident trader, every consignee, or non-resident trader within the meaning of the said Acts, is required to fill up the following return as far as is applicable to his particular case, and deliver the same at or forward it by post to the office of the Commissioner of Taxes, Wellington, on or before the 1st day of June, 191 .

NOTE.—Any person failing or neglecting to furnish a return at the prescribed time, or any person making a false return, is liable to a penalty of not less than £2 nor more than £100, and to pay treble extra duty.

Netting in New River Estuary.

ISLINGTON, Governor.
ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-eighth day of October, 1912.

His Excellency the Governor in Council.

WHEREAS by Orders in Council dated the twenty-first day of October, one thousand nine hundred and seven, the fourteenth day of December, one thousand nine hundred and nine, the thirtieth day of December, one thousand nine hundred and nine, and the twenty-fourth day of October, one thousand nine hundred and ten, and published in the New Zealand Gazette No. 92, of the twenty-fourth day of October, one thousand nine hundred and seven, No. 105, of the sixteenth day of December, one thousand nine hundred and nine, No. 1, of the thirteenth day of January, one thousand nine hundred and ten, and No. 96, of the third day of November, one thousand nine hundred and ten, respectively, regulations were made governing the netting and sale of trout in the New River Estuary :

And whereas it is desirable to make additional regulations for the purpose aforesaid :

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred upon him by the Fisheries Act, 1908, and of all other powers and authorities enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby make the following additional regulations ; and doth hereby declare that such regulations shall have force and effect in such of the waters of the New River Estuary and the mouth or entrance thereof, and in such of the rivers and streams running into the estuary, as are not within the boundaries of the “netting prohibited areas.”

REGULATIONS.

  1. Licenses to net trout shall be granted to bona fide fishermen only. The definition of “bona fide fisherman” shall mean a person who has earned his sole living by taking fish for sale during a period of not less than nine months in the twelve months immediately preceding the date of his application for such license.
