THE NEW ZEALAND GAZETTE.
at or posting to the last known address of the licensees
in New Zealand a notice in writing of any defect or want
of repair in such wharf, requiring them, within a reason-
able time, to be therein prescribed, to repair the same,
they shall with all convenient speed cause such defect to be
removed or such repairs to be made.

Nothing herein contained shall authorize the licensees
to do or cause to be done anything repugnant to or incon-sistent with any law relating to the Customs, or any regulation of the Minister of Customs, or with any provisions
of the Harbours Act, 1908, or its amendments, or any
regulations made thereunder, and that are now or may
hereafter be in force. -
The ballast of all vessels loading at the said wharf
shall be taken away by the licensees and deposited above
high-water mark, or at such place as may be approved of
by the Minister, or by any person appointed by the Minis-ter for that purpose. -
The rights, powers, and privileges conferred by or
under this Order in Council shall continue to be in force
for fourteen years from the date hereof, unless in the meantime such rights, powers, and privileges shall be
altered, modified, or revoked by competent authority; and
the licensees shall not assign, charge, or part with any
such right, power, or privilege without the previous written consent of the Minister first obtained. -
The said rights, powers, and privileges may be at
any time resumed by the Governor, without payment of
any compensation whatever, on giving to the licensees
three calendar months' previous notice in writing. Any
such notice shall be sufficient if given by the Minister, and
delivered at or posted to the last known address of the
licensees in New Zealand. -
The licensees shall be liable for any injury which
the said wharf may cause any vessel or boat to sustain
through any default or neglect on their part. -
In case the licensees or either of them shall—
(1.) Commit or suffer a breach of the conditions herein-before set forth, or any of them;
(2.) Cease to use or occupy the said wharf for a period
of thirty days;
(3.) Become bankrupt, or be in any manner brought
under the operation of any law for the time
being in force relating to bankruptcy; or
(4.) Fail to pay the sums specified in clause 3 of these
conditions,—
then and in either of the said cases this Order in Council,
and every right, power, or privilege, may be revoked and
determined by the Governor in Council, without any notice
to the licensees or other proceeding whatsoever; the publi-cation in the New Zealand Gazette of an Order in Council
containing such revocation shall be sufficient notice to the
licensees, and to all persons concerned or interested, that
this Order in Council, and the license, rights, and privi-leges thereby granted and conferred, have been revoked
and determined. -
The erection of the wharf shall be sufficient evidence
of the acceptance by the licensees of the terms and condi-tions of this Order in Council.

Vesting a Cemetery Reserve in the Manunui Town Board.
ISLINGTON, Governor.
ORDER IN COUNCIL.
At the Government House, at Wellington, this twenty-third day of September, 1912.
Present:
His Excellency THE GOVERNOR IN COUNCIL
WHEREAS the land described in the Schedule hereto
has been duly set apart for a public cemetery:
And whereas, in the opinion of the Governor, it is expedient to vest the said reserve in the Manunui Town Board:
Now, therefore, His Excellency the Governor of the
Dominion of New Zealand, acting by and with the advice
and consent of the Executive Council of the said Dominion,
and in exercise of the powers and authorities conferred upon him by the fourth section of the Public Reserves and Do-mains Act, 1908, doth hereby declare that, from and after
the day of the date hereof, the reserve described in the Sche-dule hereto shall become vested in the Manunui Town Board,
in trust, for a public cemetery.
SCHEDULE.
All that area in the Wellington Land District, containing
by admeasurement 4 acres and 38 perches, more or less.
being Section No. 139, Block II, Hunua Survey District,
commencing at a point on the eastern side of the North
Island Main Trunk Railway line immediately opposite the
north-western boundary of Section No. 95, Block II, Hunua
Survey District. Bounded towards the north-east and
south - east generally by a public road, and towards the
south-west by the North Island Main Trunk Railway; as
the same is delineated on the plan marked L. 1683/1, de-posited in the Head Office, Department of Lands and Survey,
at Wellington, and thereon bordered red.

(Incorporated).

ORDER IN COUNCIL.

Library (Incorporated):

links : be all the aforesaid linkages more or less : as the
same is delineated on the plan marked L. and S. 18290/8,
deposited in the Head Office, Department of Lands and
Survey, at Wellington, and thereon bordered red.

Extending Time for Return of the Writ for the Egmont Electoral
District.

ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this twenty-fifth day of September, 1912.
Present:
The Honourable W. F. Massey Presiding in Council.
WHEREAS in pursuance and in exercise of the provi-sions of the Legislature Act, 1908, the Clerk of the
Writs caused to be issued to the Returning Officer for the
Electoral District of Egmont a writ directing him to proceed
according to law to the election of a member of Parliament
to serve in the House of Representatives for the said electoral district : And whereas such writ should have been returned
to the Clerk of the Writs on or before the twenty-third day of
September, one thousand nine hundred and twelve, being the
day fixed in the said writ for the return of the same : And
whereas the Returning Officer for the said electoral district,
owing to the unavoidable delay in receiving some of the
returns of votes polled in connection with the said election,
was unable to return the writ on the said twenty-third day
of September, one thousand nine hundred and twelve : And
whereas section two hundred and thirty-eight of the Legis-lature Act provides, inter alia, that within twenty-one days
before or after the day appointed for doing any act, matter,
or thing required by that Act to be done on or before a certain
day, the Governor in Council may extend the time allowed
for doing any such act, matter, or thing : And whereas it
