Exempting Portion of the North Side of Grendon Street and Portion of the South Side of Burwood Avenue, in the Borough of Maori Hill, from the Provisions of Section 117 of the Public Works Act, 1908, subject to certain Conditions as to the Building-line.

ORDER IN COUNCIL.
At the Government House, at Wellington, this thirteenth day of March, 1912.
Present:
His Excellency the Governor in Council.
WHEREAS by subsection one of section one hundred and seventeen of the Public Works Act, 1908, it is, inter alia, provided that the said section shall not apply in any case where a local authority having control of a road or street by resolution declares that the provisions thereof shall not apply to any specified road or street, or any specified part thereof, and such resolution is approved by the Governor in Council:
And whereas by subsection two of section one hundred and seventeen of the Public Works Act, 1908, and clause (b) of subsection one of section thirteen of the Public Works Amendment Act, 1911, it is provided that such approval may be either absolute or subject to such conditions as the Governor in Council thinks fit to impose, and may refer to one or both sides of the road or street:
And whereas the Maori Hill Borough Council, the local authority having control of the portions of streets described in the Schedule hereto, did by resolution declare that the provisions of the said section one hundred and seventeen should not apply to the said streets:
And whereas it is deemed expedient that such resolution should be approved in so far as it refers to the north side of the portion of Grendon Street described in the Schedule hereto, and to the south side of the portion of Burwood Avenue described in the said Schedule, subject to the conditions hereinafter mentioned:
Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers conferred by the above-in-part recited Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the said resolution to the extent hereinbefore mentioned, subject to the conditions that no building or part of a building shall be erected at any time within thirty-three feet of the centre-line on the north side of that part of Grendon Street described in the Schedule hereto, and on the south side of that part of Burwood Avenue described in the Schedule hereto.

SCHEDULE.
ALL that portion of Grendon Street, in the Borough of Maori Hill, adjoining Allotments 10 and 11, Grendon, being subdivisions of part of Section 11, Block I, Upper Kaikorai Survey District.
Also all that portion of Burwood Avenue adjoining Allotments 10, 11, 12, and 13, Newington, being subdivisions of part of Section 9, Block I, Upper Kaikorai District.
As the said portions of streets are more particularly delineated on the plan marked P.W.D. 29784, deposited in the office of the Minister of Public Works, at Wellington, in the Wellington Provincial District, and thereon coloured red.

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers conferred by the above-in-part-recited Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the said resolution.

ALL that portion of road in the Otago Land District, Taieri County, known as Gladstone Road, abutting on Section 20 and part Section 21, Irregular Block, East Taieri Survey District; as the said portion of road is more particularly delineated on the plan marked P.W.D. 31245, deposited in the office of the Minister of Public Works, at Wellington, in the Wellington Provincial District, and thereon coloured blue.

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and in exercise of the powers conferred by the above-in-part-recited Act, doth hereby approve of the said resolution in so far as it affects the northern side of the said portion of the said street.
