Prohibiting all Private Alienation of certain Native Land.

ISLINGTON, Governor.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-sixth day of September, 1911.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

ON the recommendation of the Native Land Purchase Board, referred to in section three hundred and sixty-three of the Native Land Act, 1909, and in exercise of the power in this behalf conferred upon him by that section, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council thereof, doth hereby prohibit, for the period of one year from the date of this Order in Council, all alienation of the Native land specified in the Schedule hereto other than an alienation in favour of the Crown.

SCHEDULE.

ALL that piece or parcel of land situate in the Wairoa Survey District, containing 39 acres and 6 perches, more or less, being part of the land known as Section 398, Block VIII of the said survey district, being bounded as follows: On the north by the Momohaki State Experimental Farm, on the west generally by a public road, on the south generally by a public road, and on the east by the Momohaki State Experimental Farm aforesaid; and being the land which is more particularly delineated on a plan thereof lodged in the office of the Under-Secretary, Native Department, Wellington, and thereon bordered red.

Regulation as to the Passage of Fish up the Rivers and Streams in the Taranaki Acclimatization District.

ISLINGTON, Governor.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-sixth day of September, 1911.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by sections eighty-three and ninety-four of the Fisheries Act, 1908, it is enacted that the Governor may from time to time, by Order in Council gazetted, make regulations, to have force and effect throughout New Zealand or only in such waters or places as are specified in the regulations, for, amongst other things, the erection or construction in any river, stream, or waters in which salmon or trout exist, or have been liberated or may hereafter be liberated, of fish-ladders or other means of ingress and egress for fish, by persons constructing dams or weirs, so as to allow fish to pass and return at all times:

And whereas it is desirable to make regulations for the purposes hereinbefore mentioned:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in exercise of the hereinbefore-recited power and authority, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby make the following regulation.

REGULATION.

  1. EVERY person who shall construct or who has constructed a dam or weir in any river, stream, or waters in the Taranaki Acclimatization District in which salmon or trout exist, or have been liberated, or may hereafter be liberated, shall erect or construct proper fish-ladders or other means of ingress and egress for fish so as to allow fish to pass and return at all times.

  2. Any person who fails to comply with or commits a breach of this regulation is liable to a fine not exceeding £50.
