Terms: One-fifth in cash within fourteen days after acceptance of tender, one-fifth in nine months, one-fifth in eighteen months, one-fifth in twenty-seven months, and one-fifth in thirty-six months thereafter.

NOTE.—The timber on each of these sections must be cut out on a face and in a continuous and regular manner, and will be subject to the special conditions to be embodied in the timber-cutting license regarding the handing-back of area for settlement purposes.

WEST TAupo COUNTY.

Lot 2.

Part Blocks XIII and XIV, Tuhua Survey District, and I, Piopiotea Survey District (National Endowment).

Totara timber, estimated to contain 830,280 sup. ft.
Rimu timber, estimated to contain 169,344 sup. ft.
Kahikatea timber, estimated to contain 174,241 sup. ft.
Matai timber, estimated to contain 115,277 sup. ft.
Distinguishing brands, thus: X, M, & O.
Time for removal: Two years.
Upset prices: Totara 1s. 6d., matai 1s., rimu and kahikatea 6d. per 100 sup. ft.
Terms: One-third in cash within fourteen days after acceptance of tender, one-third in eight months, and one-third in sixteen months thereafter.

CONDITIONS.

  1. Intending tenderers are expected to visit the locality and satisfy themselves in every particular on all matters relating to their tenders.

  2. The aforementioned quantities, qualities, and kinds as to the said timber shall be taken as sufficiently accurate for the purpose of this sale, and no contract for purchase shall be voidable, nor shall the successful tenderer be entitled to any abatement in price, by reason of the said timber being of less quantity, quality, and kind than as stated herein or in any advertisement having reference to the said timber, nor shall any extra sum be claimed by the Crown if for any reason the quantity of timber is found to be in excess of that stated herein.

  3. No tender will be considered wherein a less royalty is offered for the timber than the upset prices as stated in each lot.

  4. The timber on the sections mentioned in Lot 1 must be cut out on a face and in a continuous and regular manner, and will be subject to the special conditions to be embodied in the timber-cutting license regarding the handing-back of area for settlement purposes.

  5. All timber, whether standing, felled, or in logs, shall remain the property of the Crown until all the instalments are paid.

  6. Should any dispute arise as to boundaries, the decision of the Commissioner of Crown Lands shall be final.

  7. In Lot 2 the quantities stated are standing measurements, and only those trees bearing the special distinguishing brands are included in the sale.

  8. In the event of the above lots not being disposed of, applications may be received and dealt with at any time within six months from the above date of closing of tenders (unless previously formally withdrawn), providing, however, that the amount offered is not less than the upset prices stated herein.

  9. All tenders must be submitted on forms which will be supplied on application to the above office, and envelopes enclosing same marked “Tender for timber,” and addressed to the Commissioner of Crown Lands, Auckland.

  10. In the event of terms of payment being arranged, any breach of the foregoing conditions will render the “on demand” promissory notes liable to be presented for immediate payment.

  11. The highest or any tender not necessarily accepted.

TERMS.

Tenders for the timber must be accompanied by a deposit of 5 per cent. on the amount of tender in cash, marked cheque, or post-office order; the balance to be paid, if tender accepted, as specified in terms of each lot, together with the timber-cutting license fee of £1 1s.

All such instalment payments shall bear interest at the rate of 5 per cent. per annum as from the date of acceptance of tender, and, with the interest added, shall be secured by “on demand” promissory notes made and indorsed to the satisfaction of the Commissioner of Crown Lands.

NOTICE is hereby given, in pursuance of section 326 of the Land Act, 1908, that the undermentioned land will be disposed of under section 129 of the said Act on or after Friday, the 29th day of September, 1911.
