Appointing Members of Prisons Board.

ISLINGTON, Governor.
ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this fifteenth day of February, 1911.

Present:

THE RIGHT HONOURABLE SIR J. G. WARD, K.C.M.G., PRESIDING IN COUNCIL.

WHEREAS by section nine of the Crimes Amendment Act, 1910, it is enacted that there shall be constituted a Board, to be called the Prisons Board, consisting of not less than three nor more than seven persons: And whereas by the said section it is provided that the members of the Board shall be appointed from time to time by the Governor in Council:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred upon him by the Crimes Amendment Act, 1910, and of every other power and authority enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby appoint

His Honour Sir Robert Stout, K.C.M.G., Chief Justice of New Zealand;

Frank Geoffrey Burton Waldegrave, Esq., Under-Secretary for Justice;

Joseph Frank Strong Hay, Esq., Inspector-General of Mental Hospitals;

John Rutherford Blair, Esq., of Wellington;

Frederick George Ewington, Esq., of Auckland;

George Fenwick, Esq., of Dunedin; and

William Reece, Esq., of Christchurch,

to be members of the Prisons Board constituted under the Crimes Amendment Act, 1910, as aforesaid.

Validating Proceedings in connection with Mataura Borough Council Loan of £7,000.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this fifteenth day of February, 1911.

Present:

THE RIGHT HONOURABLE SIR J. G. WARD, K.C.M.G., PRESIDING IN COUNCIL.

WHEREAS the Mataura Borough Council lately proposed to raise a loan of £7,000 under the Local Bodies’ Loans Act, 1908, for the purpose of supplying the borough with water and providing drainage for the inhabitants: And whereas an irregularity or defect has occurred in the procedure to obtain such loan, inasmuch as the voting-paper required by section eleven subsection (c) of the Local Bodies’ Loans Act, 1908, was not in the form numbered (1) in the Second Schedule to the Act, and also did not contain full particulars of the notice mentioned in section eight of the said Act, or a statement giving the full purport and effect of that notice, by reason that such voting-paper omitted in particular a statement of the proposed security and the provision for payment of the loan and a statement whether or not it was proposed to pay out of the loan the cost of raising the loan or the interest for the first year: And whereas it appears that the ratepayers have not been misled by such irregularity or defect, and it is expedient to validate the aforesaid proceedings:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers conferred by section one hundred and twenty-one of the Local Bodies’ Loans Act, 1908, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the said voting-paper shall be taken to be as valid as though it had contained the full particulars required by section eleven subsection (c) of the Local Bodies’ Loans Act, 1908: And His Excellency the Governor, with such advice and consent as aforesaid, doth hereby validate such proceedings, and doth further order and declare that the proceedings in connection with the said loan shall not be called in question by reason only of the irregularity or defect aforesaid.

Revoking Order in Council licensing the Kaipara Union Amateur Boating Club to use and occupy Part of the Foreshore of the Wairoa River as a Site for a Boat-shed and Stage.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this fifteenth day of February, 1911.

Present:

THE RIGHT HONOURABLE SIR J. G. WARD, K.C.M.G., PRESIDING IN COUNCIL.

WHEREAS by an Order in Council dated the first day of June, one thousand nine hundred and six, and published in the New Zealand Gazette No. 43, of the seventh day of the same month, a license was granted to the Kaipara Union Amateur Boating Club to use and occupy a part of the foreshore of the Wairoa River, Kaipara Harbour, in order to erect and maintain a boat-shed and stage thereon in the position shown on the plan marked M.D. 2951, deposited in the office of the Marine Department, at Wellington, and upon and subject to the terms and conditions therein set forth:

And whereas it is desirable that the said license should be revoked.

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in exercise of all the powers enabling him in that behalf, doth hereby revoke and determine the said recited Order in Council of the first day of June, one thousand nine hundred and six, and the rights and privileges thereby conferred.

Licensing the Kauri Timber Company (Limited) to use and occupy a Part of the Foreshore of Hokianga Harbour.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this fifteenth day of February, 1911.

Present:

THE RIGHT HONOURABLE SIR J. G. WARD, K.C.M.G., PRESIDING IN COUNCIL.

WHEREAS by Order in Council dated the twenty-seventh day of February, one thousand nine hundred and six, and published in the New Zealand Gazette No. 17, of the first day of March following, the Kauri Timber Company (Limited), (hereinafter called “the company”), was licensed to occupy a part of the foreshore and land below low-water mark in Hokianga Harbour, in order to maintain thereon wharves, saw-mills, and reclamations, erected and constructed in accordance with plans marked respectively M.D. 1719, 1818 (two sheets), 2599, and 2703, and deposited in the office of the Marine Department, at Wellington:

And whereas the company has applied to the Governor in Council for a license under the Harbours Act, 1908 (hereinafter called “the said Act”), to occupy a further portion of the foreshore and land below low-water mark in Hokianga Harbour, in order to construct a breastwork and the necessary reclamation to obtain the full benefit of the license granted by the hereinbefore-recited Order in Council; and, in accordance with the one-hundred-and-fiftieth section of the said Act, has deposited plans in the office of the Marine Department, at Wellington (marked M.D. 3578, two sheets), showing the manner in which it is proposed to construct such breastwork and reclamation, and the necessary reclamation to be constructed in order to obtain the full benefit of the license granted by the hereinbefore-recited Order in Council, the place where it is intended to construct the same, and the area of foreshore and land below low-water mark intended to be occupied for such purpose: And whereas it has been made to appear to the Governor in Council that the proposed works will not be or tend to the injury of navigation; and the said plans have, prior to the making of this Order in Council, been approved by the Governor in Council: And whereas it is expedient that a license should be granted and issued to the company under the said Act,
