Regulations under the Old-age Pensions Acts, 1908 and 1909.

PLUNKET, Governor.

PURSUANT to and in exercise of the powers in this behalf conferred upon him by “The Old-age Pensions Act, 1908,” and its amendments, His Excellency the Governor of the Dominion of New Zealand doth hereby revoke the several regulations set forth in the Second Schedule hereto, and in lieu thereof doth hereby make the following regulations, that is to say,—

INTERPRETATION.

  1. In these regulations “the principal Act” means “The Old-age Pensions Act, 1908”; “the Amendment Act, 1908,” means “The Old-age Pensions Amendment Act, 1908”; “the Amendment Act, 1909,” means “The Old-age Pensions Amendment Act, 1909”; “Minister” means the Minister of Finance; “Magistrate” means a Stipendiary Magistrate.

PENSION-CLAIMS, AND MATTERS RELATING THERETO.

  1. The pension-claim shall be in the form numbered 1 in the First Schedule hereto, and shall be issued only to or on behalf of bona fide applicants for the pension. The claim shall be made in person to the Registrar, who shall read over to the claimant the contents of his claim.

  2. If, on account of age, infirmity, or any other cause, it is not practicable for the claimant to personally interview the Registrar, or vice versa, the contents of the claim may be read over to the claimant by a Clerk of Court, constable, or Postmaster, who shall forward the claim to the Registrar to be dealt with as provided hereinafter.

  3. The Pension-claim Register shall contain particulars of each pension-claim received, and shall be in the form numbered 2 in the First Schedule hereto.

  4. The Registrar shall not record in the Pension-claim Register any claim made by a claimant who resides in another old-age pension district; but he may accept such claim, and forward it to the Registrar of the district in which the claimant resides, notifying the claimant that he has done so.

  5. The Registrar, after recording a claim in the Pension-claim Register, shall note thereon the name of the old-age pension district, and its registered claim number, and shall forthwith proceed to verify the statements of the claimant by inquiry forms lettered A, B, C, D, E, F, G, H, and I in the First Schedule hereto. Having done so, he shall then forward the claim, together with all replies to inquiries made, to the Magistrate presiding at the Court held nearest to the residence of the claimant.

  6. Under instructions from the Magistrate, the Clerk of Court shall send to the claimant a notice, in the form numbered 3 in the First Schedule hereto, of the time and place at which he may attend to support his claim. He shall likewise, where he is not himself the Registrar, notify the Registrar of the place and date fixed for the hearing of the application.

  7. The pension-claim, with a minute of the Magistrate’s decision indorsed thereon, together with the inquiry forms, shall be filed by the Registrar, and each decision shall be notified by the Magistrate to the Registrar, who in turn shall notify the claimant in the form numbered 4 in the First Schedule hereto, and shall note the purport thereof in the Pension-claim Register.

  8. If the Magistrate’s decision is that the claim is rejected, he shall notify the Registrar in the form numbered 5 in the First Schedule hereto, and shall specify all the material points which he finds to be respectively proved, disproved, and not proved. Such notification, after being noted in the Pension-claim Register, shall be forwarded to the Commissioner, who shall record and file the same:

Provided always that, where a fresh claim is lodged at any time subsequent to the rejection of a former claim, such new claim shall be recorded in the Pension-claim Register under a new number. This shall not apply where the former claim has been merely adjourned for any reason by the Magistrate. For the purposes of this proviso, the adjournment of a claim sine die shall be deemed to be equivalent to the rejection of such claim.

  1. If the Magistrate’s decision is that the claim is established, he shall fix the rate of the first year’s pension, and forward to the Registrar a certificate of establishment in the form numbered 6 in the First Schedule hereto.

  2. Forthwith upon receipt of the Magistrate’s certificate of establishment, the Registrar, after noting the Pension-claim Register, shall note the purport thereof in the Old-age Pension Register hereinafter referred to, and, after indorsing
