A PROCLAMATION.

WHEREAS the land mentioned in the Schedule hereto
is required to be taken for a portion of the Waimea-
Switzers Railway:

And whereas all conditions precedent required by law to be
observed and performed prior to the taking of such land for
the purpose hereinbefore specified have been observed and
performed:

Now, therefore, I, John Poynder Dickson-Poynder, Baron
Islington, the Governor of the Dominion of New Zealand, in
pursuance and in exercise of the powers and authorities
conferred on me by section one hundred and eighty-eight of
the Public Works Act, 1908, and of every other power and
authority in anywise enabling me in this behalf, do hereby
proclaim and declare that the land mentioned in the Schedule
hereto is hereby taken for a portion of the said line of rail-
way hereinbefore specified.

SCHEDULE.

THE several parcels of land mentioned hereunder:—

All in the Land District of Southland; as the same are more
particularly delineated on the plan marked P.W.D. 25138,
deposited in the office of the Minister of Public Works, at
Wellington, in the Provincial District of Wellington, and
thereon coloured as above.

WHEREAS the land mentioned in the Schedule hereto
is required to be taken, under the Public Works
Act, 1908, for a certain public work, to wit, for the pur-
poses of a road in Block XI, Howard Survey District:

And whereas all conditions precedent required by law to
be observed and performed prior to the taking of such land
for the purposes hereinbefore specified have been observed
and performed:

Now, therefore, I, John Poynder Dickson-Poynder, Baron
Islington, Governor of the Dominion of New Zealand, in
pursuance and in exercise of the powers and authorities
vested in me by the Public Works Act, 1908, and of every
other power and authority in anywise enabling me in this
behalf, do hereby proclaim and declare that the land men-
tioned in the Schedule hereto is hereby taken for the pur-
poses of a road, and I do also hereby declare that this
Proclamation shall take effect on and after the thirty-first
day of August, one thousand nine hundred and ten.

Consenting to Land being taken for a Road in Block IV, Maramarua Survey District.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-
fifth day of July, 1910.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by the Public Works Act, 1908, it is, in
section 15 thereof, inter alia, enacted that, except
for the purpose of a railway or defence purposes, or for the
purposes of any other work to be made under the authority
of a special Act, nothing in this Act contained shall authorise
the taking of any land occupied by any building, yard,
garden, orchard, or vineyard, or in bona fide occupation as an
ornamental park or pleasure-ground, without the previous
consent of the Governor in Council:

And whereas portion of the land described in the Schedule
hereto is occupied by a building:

And whereas the Minister has recommended the Governor
to issue an Order in Council under the said Act consenting
to the taking of the said land for the purposes of a road:

Now, therefore, His Excellency the Governor of the
Dominion of New Zealand, acting by and with the advice
and consent of the Executive Council of the said Dominion,
doth hereby consent to the land described in the Schedule
hereto being taken for the purposes above mentioned.
