PLUNKET, Governor.
ORDER IN COUNCIL.
At the Government House, at Wellington, this nineteenth day of April, 1910.
Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS proposals for a loan of twenty thousand pounds, under “The Local Bodies’ Loans Act, 1908,” repayable in thirty years, bearing interest at four and a half per cent., were duly submitted to the ratepayers of the Spreydon Road District: And whereas it was mentioned in the proposals that a special rate of two and thirteen-sixteenths of a penny in the pound was proposed to be made and levied as security for the interest and sinking fund in connection with such loan: And whereas the voting-papers used at the poll subsequently held of the ratepayers mentioned the same rate: And whereas the proposals were duly carried at a poll of the ratepayers held on the seventeenth day of September, one thousand nine hundred and eight: And whereas after the date of the said poll and before the said special order was made making and levying the said special rate “The Local Bodies’ Loans Amendment Act, 1908” (since repealed), was passed: And whereas, in pursuance of the powers enabling it under section fifteen of that Act, the said Board applied to the Honourable the Minister of Finance for a Government guarantee of the said loan: And whereas the said Act provided that every loan guaranteed under that Act should be raised by debentures payable at the expiration of thirty-three years; and, further, that the sinking fund in respect of any loan guaranteed under the Act should be one per cent. per annum, half of which sum should be paid by way of subsidy by the Minister of Finance: And whereas in consequence of the above provisions in the said Act a smaller special rate than the rate of two and thirteen-sixteenths of a penny originally proposed to be levied was required to secure the repayment of the annual charges on the said loan: And whereas the rate necessary for that purpose was the rate mentioned in the special order—namely, two and three-eighths of a penny in the pound: And whereas it appears that the ratepayers have not been misled, and it is expedient to validate such special order:
Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and in exercise of the power conferred by section one hundred and twenty-one of “The Local Bodies’ Loans Act, 1908,” and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby validate the said special order and the proceedings as taken above mentioned; and doth hereby declare that the said special order shall be and be deemed to have been good, valid, and effectual as though the said special order conformed in all respects with the proposals for the loan hereinbefore referred to.
