His Majesty or the Governor, and all officers in the Government service acting in the execution of their duty, shall at all times have free ingress, passage, and egress into, through, over, and out of the said store, warehouse, and offices without payment.

The licensee shall maintain the above-mentioned store, warehouse, and offices in good order and repair.

Any person authorised by the Minister may at all reasonable times enter upon the said store, warehouse, and offices and view the state of repair thereof; and upon such Minister leaving at or posting to the last known address of the licensee a notice in writing of any defect or want of repair in such store, warehouse, and offices, requiring him, within a reasonable time, to be therein prescribed, to make good the same, the licensee shall with all convenient speed cause such defect to be removed or such repairs to be made, as the case may be.

Nothing herein contained shall authorise the licensee to do or cause to be done anything repugnant to or inconsistent with any law relating to the Customs, or any regulation of the Minister of Customs, or with any provisions of “The Harbours Act, 1908,” or its amendments, or any regulations made thereunder, and that are now or may hereafter be in force.

The rights, powers, and privileges conferred by or under this Order in Council shall continue in force for fourteen years from the date hereof, unless in the meantime such rights, powers, and privileges shall be altered, modified, or revoked by competent authority; and the licensee shall not assign, charge, or part with any such right, power, or privilege without the written consent of the Minister first obtained.

The said rights, powers, and privileges may be at any time resumed by the Governor, without payment of any compensation whatever, on giving to the licensee three calendar months’ previous notice in writing. Any such notice shall be sufficient if given by the Minister and delivered at or posted to the last known address of the licensee.

In case the licensee shall—
(1.) Commit or suffer a breach of the conditions hereinbefore set forth, or any of them; or
(2.) Cease to use or occupy the said store, warehouse, and offices for the purposes aforesaid;
(3.) Become bankrupt, or be in any manner brought under the operation of any Act in force for the time being relating to bankruptcy; or
(4.) Fail to pay the sums specified in clause two of these conditions,
then and in any of the said cases this Order in Council, and every license, right, power, or privilege thereby conferred, may be revoked and determined by the Governor in Council, without any notice to the licensee or other proceeding whatsoever; and publication in the New Zealand Gazette of an Order in Council containing such revocation shall be sufficient notice to the licensee, and to all persons concerned or interested, that this Order in Council, and the license, rights, and privileges thereby granted and conferred, have been revoked and determined.

Revoking Order in Council Licensing Alexander McKay to use and occupy a Part of the Foreshore of Mangonui Harbour as a Site for a Warehouse and Offices.

At the Government Buildings, at Wellington, this twenty-fourth day of March, 1910.

PRESIDING IN COUNCIL.
WHEREAS by an Order in Council dated the seventh day of January, one thousand nine hundred and seven, and published in the New Zealand Gazette No. 2, of the tenth day of the same month, a license was granted to Richard Theophilus Wrathall, of Mangonui, to use and occupy a portion of the foreshore and land below low water in Mangonui Harbour, in order to construct and maintain thereon a building to be used as a warehouse and offices, in the position shown on plan marked M.D. 3027 (three sheets), deposited in the office of the Marine Department, at Wellington, and upon and subject to the terms and conditions therein set forth:
And whereas the said license has, with the consent of the Minister of Marine, been transferred to Alexander McKay, of Mangonui, and he has asked that it may be revoked:
Now, therefore, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in exercise of all the powers enabling him in that behalf, doth hereby revoke and determine the said recited Order in Council of the seventh day of January, one thousand nine hundred and seven, and the rights and privileges thereby conferred.

Amended Regulations.—Leave of Absence.

ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this twenty-fourth day of March, 1910.

PRESIDING IN COUNCIL.
IN pursuance and exercise of the powers and authorities vested in him by “The Civil Service Act, 1908,” and of all other powers and authorities thereunto enabling him, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke the regulations as to leave of absence in the public service made by Order in Council dated the twenty-ninth day of February, one thousand nine hundred and four, and also regulations one to five of the regulations made for the same purpose by Order in Council dated the twentieth day of September, one thousand nine hundred and nine, and in lieu thereof doth hereby make the following regulations respecting leave of absence of officers of the public service of New Zealand, and doth direct that such regulations shall come into force on the first day of April, one thousand nine hundred and ten:—
REGULATIONS.
Leave of Absence.

Every officer in the public service, whether permanently or temporarily employed, may be granted by the Minister in charge of the Department leave of absence for recreation, on the following scale:—
(1.) When an officer has served for fifteen years or upwards, not exceeding three weeks in each year.
(2.) When he has served less than fifteen years, not exceeding two weeks in each year. -
The granting of any such leave of absence shall be subject to the express conditions:—
(1.) That the behaviour of the officer has been in every way satisfactory;
(2.) That the total intermittent leave during the previous twelve months has not exceeded five days;
(3.) That absence from illness or accident has not exceeded one week; and,
(4.) More generally, that his official duties have been properly performed.
Any or all of the days of absence in excess of the number of days allowed for intermittent leave or sick-leave may be deducted from the annual leave of absence granted for recreation.

No officer shall be entitled to claim leave of absence as a right, and if for any cause the head of the Department thinks such leave ought not to be granted, he may refuse the same in any case, subject to the approval of his action by the Minister.

An officer failing to avail himself of the annual leave provided for will not on that account be entitled to a more lengthened leave in any subsequent year unless under special circumstances approved by the Minister.

In cases of absence from illness or accident for any period extending over two days a medical certificate shall be supplied, but heads of Departments or other responsible officers may require that a certificate be supplied forthwith. The certificate should state the nature of the illness or accident.

All existing regulations as to leave of absence of officers of the public service not hereinbefore revoked are hereby modified in so far as they are inconsistent with these regulations.

These regulations shall apply to all Departments of the public service, except the Government Railways Department.
