Now, therefore, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in exercise of all the powers enabling him in that behalf, doth hereby revoke and determine the said recited Order in Council of the twenty-third day of August, one thousand eight hundred and ninety-seven, and the rights and privileges thereby conferred.

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS by an Order in Council dated the fifteenth day of September, one thousand nine hundred and eight, and published in the New Zealand Gazette No. 71, of the seventeenth day of the same month, a license was granted to Francis Joseph Sullivan, of Dunedin, to use and occupy a portion of the foreshore and land below low water in Purakanui River, Otago, in order to construct and maintain thereon a smokehouse, in the position shown on plan marked M.D. 3236, deposited in the office of the Marine Department, at Wellington, and upon and subject to the terms and conditions therein set forth:
And whereas the said Francis Joseph Sullivan desires that the said license should be revoked, and it is desirable that this should be done:
Now, therefore, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in exercise of all the powers enabling him in that behalf, doth hereby revoke and determine the said recited Order in Council of the fifteenth day of September, one thousand nine hundred and eight, and the rights and privileges thereby conferred.

WHEREAS by an Order in Council dated the third day of March, one thousand nine hundred and six, and published in the New Zealand Gazette No. 20, of the fifteenth day of the same month, a license was granted to George Swain, of Half-moon Bay, Stewart Island, to use and occupy a portion of the foreshore and land below low water in Kaipipi Bay, Stewart Island, in order to construct and maintain thereon a wharf, in the position shown on plan marked M.D. 2929, deposited in the office of the Marine Department, at Wellington, and upon and subject to the terms and conditions therein set forth:
And whereas the said George Swain desires that the said license should be revoked, and it is desirable that this should be done:
Now, therefore, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in exercise of all the powers enabling him in that behalf, doth hereby revoke and determine the said recited Order in Council of the third day of March, one thousand nine hundred and six, and the rights and privileges thereby conferred.

Revoking an Order in Council taking Land in Paeroa Survey District for Scenery-preservation Purposes.

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS by “The Public Works Amendment Act, 1909,” it is enacted that if at any time after the issue or making of any Order in Council taking land under “The Public Works Act, 1908,” and before the payment or award of any compensation in respect of the taking thereof, it is found that the land or any part thereof is not required for the purpose for which it was taken, the Governor may, by a subsequent Order in Council gazetted, revoke the former Order in Council either wholly or so far as he thinks necessary: And whereas it is found that the whole of certain land in Blocks II and III, Paeroa Survey District, taken for scenery-preservation purposes by Order in Council made under “The Public Works Act, 1905,” dated the second day of September, one thousand nine hundred and seven (hereinafter termed “the said Order in Council”), and published in the New Zealand Gazette Nos. 78, 80, 82, and 85, of the fifth, twelfth, nineteenth, and twenty-seventh days of the same month, is not required for the purpose for which the said land was taken: And whereas compensation in respect of the taking of the said land has not been paid or awarded:
Now, therefore, in pursuance and in exercise of the powers vested in him by “The Public Works Amendment Act, 1909,” and of all other powers enabling him in this behalf, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke the said Order in Council.

Vesting Management of Wharf at Waitapu in Takaka County Council, and prescribing Dues.

ORDER IN COUNCIL.
At the Government House, at Wellington, this fifth day of March, 1910.

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.
WHEREAS by section eleven of “The Harbours Act, 1908” (hereinafter termed “the said Act”), it is enacted that the Governor in Council may vest the management of any wharf the property of His Majesty in any local governing body or person, upon such terms and conditions as the Governor in Council thinks fit:
And whereas it is provided by section thirteen of the said Act that the Governor may from time to time, by Order in Council, prescribe what dues and rates shall be taken by the body or person in whom any such wharf shall be vested as aforesaid:
And whereas it is thought desirable to vest in the Takaka County Council (hereinafter called “the Council”) the management of the wharf at Waitapu, in the County of Collingwood, on the terms and conditions hereinafter set forth, and to prescribe the dues and rates which shall be taken by the Council for the use of such wharf:
Now, therefore, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the power and authority vested in him by the said eleventh and thirteenth sections of the said Act, and of all other powers and authorities in anywise enabling him in that behalf, doth hereby vest the management of the wharf at Waitapu aforesaid in the Council, subject to the conditions set forth in the First Schedule hereto; and doth hereby prescribe that the dues and rates set forth in the Second Schedule hereto shall be taken by the Council for the use of the said wharf.

In these conditions the term “Minister” means the Minister of Marine, as defined by “The Shipping and Seamen Act, 1908,” and includes any officer, person, or authority acting by or under the direction of such Minister.
