Special Provisions for making and collecting Rates in Portion of the Levels County recently added to Borough of Timaru.

A PROCLAMATION.

WHEREAS by Order in Council dated the first day of June, one thousand nine hundred and ten, His Excellency the Governor, in pursuance and exercise of the powers and authorities vested in him by the Municipal Corporations Act, 1908, altered the boundaries of the Borough of Timaru by including therein an area of land which had theretofore formed portion of the Gleniti Riding of the Levels County :

And whereas it is, inter alia, provided by paragraph (e) of section one hundred and thirty of the Municipal Corporations Act, 1908, that the Governor may by Proclamation provide for the making and collecting of any rates in such case, and do any act for more effectively carrying out the provisions of the fourth division of the said Act, either generally or in any particular case :

And whereas it is expedient that the Council of the Levels County should make and collect the necessary rates upon the portion of the Levels County so added to the Borough of Timaru for the period from the first of April, one thousand nine hundred and ten (being the commencement of the yearly rating period of the Levels County), to the thirty-first of December, one thousand nine hundred and ten (being the termination of one of the half-yearly rating periods of the Borough of Timaru), and should pay to the Timaru Borough Council a proportionate part of such rates for the period from the first of June to the thirty-first of December, one thousand nine hundred and ten, less a proportionate part of the reasonable expenses of levying and collecting such rates, and that the other acts hereinafter mentioned should be done for more effectively carrying out the provisions of the fourth division of the said Act :

Now, therefore, by virtue and in exercise of the powers and authorities vested in me by paragraph (e) of section one hundred and thirty of the Municipal Corporations Act, 1908, and of every other power and authority enabling me in this behalf, I, John Poynder Dickson-Poynder, Baron Islington, the Governor of the Dominion of New Zealand, do hereby proclaim and declare as follows :—

  1. The Council of the Levels County shall make and collect, in accordance with the provisions of the Rating Act, 1908, a general rate of ¾d. in the pound upon all the rateable property in that portion of the Gleniti Riding of the Levels County which was included in the Borough of Timaru by Order in Council dated the 1st of June, 1910, for the period from the 1st day of April, 1910, to the 31st day of December, 1910.

  2. The Council of the Levels County shall pay to the Timaru Borough Council seven-ninths of the moneys collected in pursuance of such general rate.

  3. The Timaru Borough Council shall bear a proportionate part of the reasonable costs of making and collecting such rates, which the Council of the Levels County is hereby authorized to deduct from the proceeds of the proportion of the said rate payable as aforesaid to the Timaru Borough Council.

  4. The Timaru Borough Council is hereby empowered to collect and recover all water rates and charges for water-supply in respect of properties in that portion of the Gleniti Riding of the Levels County which was included in the Borough of Timaru as aforesaid for the period from the 1st of April, 1910, to the 31st of December, 1910, in the same manner as if the said portion of the Gleniti Riding remained portion of the Levels County up to the said 31st day of December.

  5. All special rates made by the Timaru Borough Council under section 21 of the Timaru Borough Loans Consolidation Act, 1909, and the Local Bodies’ Loans Act, 1908, (including its amendments), or either of them, after the said extension of the Borough of Timaru shall be made and levied on the rateable values as appearing from time to time in the valuation rolls of the said borough, as the said borough is now constituted or may be hereafter extended or altered.

Given under the hand of His Excellency the Right Honourable John Poynder Dickson-Poynder, Baron Islington, Governor and Commander-in-Chief in and over His Majesty’s Dominion of New Zealand and its Dependencies; and issued under the Seal of the said Dominion, at the Government House, at Wellington, this twenty-eighth day of November, in the year of our Lord one thousand nine hundred and ten.

ERRATA.—In the notification of the appointment of members of Kawakawa Domain Board, published in the New Zealand Gazette No. 98, of the 10th November, 1910, page 3953, for “Arthur Clough Blundell” read “Harry Clough Blundell.”

In the Schedule to the Order in Council varying an Order in Council prohibiting all private alienation of certain Native land, published in Gazette No. 102, page 4069, of the 24th November, 1910, for “J4 No. 1” read “J4F No. 1.”

In the New Zealand Gazette, 1910, on page 4084, “Notice Fixing Closing-hours of Hairdressers’ and Tobacconists’ Shops in the Borough of Wanganui” should read “Varied Notice, &c.” Insert in the said notice, before “Dated at Wellington,” the following paragraph: “The notice gazetted on the 12th September, 1907, fixing the closing-hours of all such shops is hereby varied accordingly.”
