Regulations under “The Sale of Food and Drugs Act, 1908.”

PLUNKET, Governor.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-first day of December, 1909.

Present:

His Excellency the Governor in Council.

WHEREAS by section twenty-seven of “The Sale of Food and Drugs Act, 1908” (hereinafter called “the said Act”), it is enacted that the Governor may from time to time, by Order in Council gazetted, make regulations for, among other things, prescribing the mode of labelling food or drugs sold in packages, and the matter to be contained in such labels:

And whereas it is expedient to make the regulations hereinafter set forth with respect to the mode of labelling packages containing jam or marmalade, or mixed or compounded jam or marmalade, or jelly, as defined by regulations made under the said Act by Order in Council dated the tenth day of February, one thousand nine hundred and eight, and published in the New Zealand Gazette of the twentieth day of the same month, and of the matter to be contained in such labels:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities vested in him by the said Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby make the regulations set forth in the Schedule hereto, and doth hereby declare that the said regulations shall come into force on the first day of April, one thousand nine hundred and ten.

SCHEDULE.

JAM-LABELLING REGULATIONS.

  1. EVERY package containing jam or marmalade, or mixed or compounded jam or marmalade, or jelly, as defined by the said regulations made on the 10th day of February, 1908, shall be labelled so that it shall show clearly and distinctly the contents of the package, and the name and address of the manufacturer of such contents, in addition to any brand or other device which the manufacturer may desire to display on his goods.

  2. Every label affixed to such packages containing mixed or compounded jam or marmalade shall also have the name of each of the mixed or compounded fruits stated thereon in clear and distinct consecutive characters of equal size:

Provided that where a mixed or compounded jam does not contain more than 20 parts per centum of apple-pulp it shall be sufficient to state on the label the amount of such pulp in the following form:—

THIS IS A MIXED JAM, CONTAINING NOT MORE THAN 20 PER CENT. OF APPLE.

Such statement shall be printed on the label in the characters known as 10-point condensed Gothic capitals, parallel to and immediately beneath the characters designating the first-named fruit; and on a background of such colour as shall display the words clearly and distinctly.

  1. Apple-juice or gooseberry-juice may be added to jam to an amount not exceeding 10 parts per centum, and in such case it shall not be necessary to indicate on the label that the said jam contains such juice, or that it is a mixed or compounded jam.

  2. If any person fails to observe or commits a breach of the foregoing regulations, he shall, upon conviction, be liable to a penalty not exceeding £20.

Domain Board appointed to have Control of the Pukearuhe Domain.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this thirtieth day of December, 1909.

Present:

The Right Honourable Sir J. G. Ward, K.C.M.G., presiding in Council.

IN pursuance and exercise of the powers and authority conferred by “The Public Reserves and Domains Act, 1908” (hereinafter termed “the said Act”), His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby appoint

ARTHUR ROBERT DAVIS,
HERBERT WELLS, and
PETER GODINAGH

to be the Pukearuhe Domain Board, having, subject to the said Act and in the place of the Clifton County Council, control of the lands described in the Schedule hereto, which lands are a public domain, and shall be called the Pukearuhe Domain; and also doth hereby appoint Friday, the twenty-eighth day of January, one thousand nine hundred and ten, at seven o’clock p.m., as the time when, and the office of Arthur Robert Davis, Page Street, Pukearuhe, as the place where, the first meeting of the said Board shall be held.

SCHEDULE.

PUKEARUHE DOMAIN.

ALL that area in the Taranaki Land District, containing by admeasurement 12 acres, more or less, being Sections Nos. 1, 2, 3, 4, 5, 6, 25, 26, 27, 28, 29, and 30, Pukearuhe Township, Block VI, Mimi Survey District. Bounded towards the north-east by Gregory Street, 1000 links; towards the south east by Messenger Street, 1200 links; towards the south-west by Stirling Street, 1000 links; and towards the north-west by Rotter Street, 1200 links.

Also all that area in the Taranaki Land District, containing by admeasurement 8 acres 2 roods, more or less, being Section No. 2, Pukearuhe Town Belt, Block VI, Mimi Survey District. Bounded generally towards the north by Tasman Sea; towards the south-east by Section No. 1, Pukearuhe Town Belt, 340 links; towards the south and south-west by Page Street, 640·4 links and 2264·9 links respectively; again towards the south-east by Rotter Street, 700 links; again towards the south-west by Boyd Street, 35 links; and towards the north-west by Tasman Sea.

Also all that area in the Taranaki Land District, containing by admeasurement 5 acres, more or less, being Section No. 9, Pukearuhe Town Belt, Block VI, Mimi Survey District. Bounded towards the north-east by Boyd Street, 50 links; towards the south east by Rotter Street, 2500 links; towards the south-west by Stirling Street, 40 links; and towards the north-west by Tasman Sea.

Also all that area in the Taranaki Land District, containing by admeasurement 3 acres, more or less, being Sections Nos. 13, 14, 15, Pukearuhe Township, Block VI, Mimi Survey District. Bounded towards the north-east by Page Street, 500 links; towards the south-east by Sections Nos. 16, 17, and 18, Pukearuhe Township, 600 links; towards the south-west by Boyd Street, 500 links; and towards the north-west by Rotter Street, 600 links.

Be all the aforesaid linkages more or less; as the same are delineated on the plan marked L. 1355, deposited in the Head Office, Department of Lands, at Wellington, and thereon bordered red.

Netting in New River Estuary.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this thirtieth day of December, 1909.

The Right Honourable Sir J. G. Ward, K.C.M.G., presiding in Council.

WHEREAS it is enacted by “The Fisheries Act, 1908,” that the Governor in Council may from time to time, by Order in Council gazetted, make regulations (to have force and effect throughout New Zealand or only in such waters or places as are specified in such regulations) for, amongst other things, imposing conditions and restrictions on the taking of fish, providing for the more effectual protection and improvement of fish, and prohibiting the use of nets or seines of all descriptions or of any specified description:

And whereas by Orders in Council dated the twenty-first day of September, one thousand nine hundred and four, the twenty-third day of August, one thousand nine hundred and seven, and the twenty-first day of October, one thousand nine hundred and seven, and published in the New Zealand Gazette No. 78, of the twenty-second day of September, one thousand nine hundred and four, and No. 76, of the twenty-ninth day of August, one thousand nine hundred and seven, and No. 92, of the twenty-fourth day of October, one thousand nine hundred and seven, regulations were made
