NOTICE is hereby given, in pursuance of section 326 of “The Land Act, 1908,” that the undermentioned land is open for sale or selection, and applications will be received at this office up to 4 o’clock p.m. on Wednesday, the 26th day of January, 1910.

Timber in Wellington Land District for Sale by Public Auction.

NOTICE is hereby given that the right to cut and remove about 250 dead trees—totara, &c.—on the undermentioned Crown land will be offered by public auction, in one lot, at the District Lands Office, Wellington, at 11 o’clock a.m. on Wednesday, the 17th day of November, 1909.
SCHEDULE.
WELLINGTON LAND DISTRICT.
ABOUT 250 dead trees, situated on Crown land, Block II, Waiohine Survey District. Upset price, £175.
Locality: This timber is situated on what is known as the Waiohine Totara Flat, on the banks of the Waiohine River, north of Mount Reeves, and about ten miles from Woodside Railway-station.
Conditions of Sale.

The right to cut and remove the timber will be sold generally in accordance with the provisions of “The Land Act, 1908,” the Timber Regulations made thereunder, and the following conditions:—

The purchaser of the timber specified in the Schedule shall pay the purchase-money in three instalments—10 per cent. and £1 1s. license fee being deposited on the fall of the hammer, half of the balance of purchase-money at the end of three months, and the other half at the end of six months, from date of sale. The first payment shall be made by cash or marked cheque. Two approved promissory notes payable on demand, each for one-half of the balance of purchase-money, shall be given forthwith on the day of the sale. They will be presented for payment at the ends of the periods stated above, but the Commissioner of Crown Lands reserves the right to present them at earlier dates if it is found that the licensee cuts out more than a due proportion of the timber before these dates.

The purchaser of the timber referred to herein shall have the right to cut it during a period of one year from the date of sale.

The license shall be only for the cutting and removal of the dead timber, and shall give no right to the use of the land or to cut any live or green trees growing thereon.

The licensee shall exercise due care that the operations by himself or his employees in cutting and removing the timber shall not cause any molestation of the stock grazing on land in the vicinity by the lessee having the right so to do, nor cause any damage to the adjacent forests by fires or otherwise.

The timber in the lot shall be cut in a face, and the Land Board shall have the power to demand a more systematic and better cleaning-up of the bush if deemed necessary.

The licensee shall not put, throw, or place, or allow to be put, thrown, or placed, into any river, stream, or watercourse, or into any place where it may be washed into any river, stream, or watercourse, any sawdust or other refuse.

If no bid is received for the timber, the right to cut it at the upset price quoted in the Schedule above will remain open for application until further notice.

The lot will be sold generally in accordance with the area and boundaries as shown on the sale map at the Crown Lands Office, Wellington.

No compensation will be given, nor shall any be claimed, for any error, discrepancy, or misdescription whatever in respect to the lot or in these conditions.

The attention of intending purchasers is directed particularly to clauses 9, 17, 18, 23, 22, and 27 of the Timber Regulations, copies of which may be obtained on application to the undersigned.
