such rent, to the time of actual payment
thereof, and such interest shall for all purposes
whatsoever be deemed part of the rent hereby and hereon
rent payable under this demise, and be payable
and recoverable accordingly ; or (except in the
same manner as the rent reserved under this
demise) make or suffer to be made any alteration
in the buildings now or hereafter erected in any
way negative, or nullify the provisions of sub
paragraph (2) hereof, or of this demise;
(2) That if at any time the lessee requires to make
any new buildings or to alter existing in any
way whatsoever, the lessee , upon notice in writing
being given to the lessor and all necessary plans
and specifications being submitted in duplicate to
the lessee’s then known or last known place of
business, to obtain or obtain consent to his then
denised premises, specifying the land required
for that work, to obtain power and authority
from the lessor and/or the trustee thereof ; and
if the lessee fails or neglects within fourteen
days of the giving of notice, or default in such
notice to make such surrender, then the lessor
is hereby appointed attorney for and in the name
of lessee for that purpose, and shall as such
attorney have full power to execute all instru
ments and do and perform all acts, matters, and
things as may be necessary on the part of the
lessee to effect the surrender of the land so
required : Provided that the lessee shall be en
titled to such compensation as provided for by
subparagraph (1) hereof, and the power of the
lease as the case may require and as the lessor
thinks fit, by notice in writing given to the lessor
or the trustee thereof, and if the lessee so
thinks fit, the lessee hereinbefore referred to, sue
for or sue this case ;
(3) This demise will not be without lease, assign, or
sublet ;
(4) This demise will not mortgage without the prior
consent of the lessor.
And it is hereby agreed and agreed that all the expres
sions contained in this demise shall have the same meaning as
the meaning given by the Land Transfer Act, 1908.”
And the provisions contained in the Land Transfer Act, 1908,
under the said Act, which are applicable to this lease shall
be deemed to be incorporated herein and to be part of this
lease.
And it is declared and agreed that all the provisions of
regulation 69 of the Maori Land Board Regulations,
of Part II of that Act, or of those regulations aforesaid, be
included herein, and in particular the provisions of the
“The Land Transfer Act, 1908,” which apply
to these leases of Maori Lands, and to which the said
Act shall apply to and be implied or incorporated in this lease,
so as to be part of these regulations, is expressly declared and
incorporated herein.
Provided always that if the rent hereby reserved shall be
in arrear for the space of one month, or if there be a breach
of any of the days herein appointed for payment thereof,
with all its rights, defaults, and other acts, from its pay
ment thereof, or in the time shall commit any breach of
covenants, or fail to perform or observe any, of either of the
conditions, liabilities, or obligations, herein contained, or
implied on behalf of the lessee to be performed or observed,
then and in every such case it shall be lawful for the
lessor to re-enter upon the land and premises hereby
expressed to be demised or upon any part thereof in the name
and the same to have again, repossess, and enjoy ; but such
re-entry shall not release the lessee from any liability for
any rent then due or payable, or any right of distress,
action, or suit by virtue thereof, or under this agreement
by the lessor for its recovery.
And the lessee hereby accepts this lease, to be held by the
lessee for all the purposes for which it is entered, subject to
and restrictions above set forth, expressed, or implied :
Provided that if the lessee shall have any objection herein
as against the lessor, save that the lessor has not done or
performed anything for or on his behalf, or suffered him to
do anything whatever, have been discharged or surrendered
in any way whatever.

Memorandum of agreement made the

BETWEEN the District Maori Land Board
(hereinafter called “the vendor”) of the one part, and
of (hereinafter called “the purchaser”) of the other
part : Whereby the vendor in consideration whereof, all that
piece or parcel of land known as Section

Land District, containing

being all that comprised and described in the plan indorsed
hereon, and whereof the purchaser has, at the sale by public
auction, become the purchaser, sold, held
under “The Native Land Settlement Act, 1907”
[or tendered], and has duly lodged the declaration required
by section 16 of “The Native Land Settlement Act, 1907”
(hereinafter termed “the said Act”).
And the purchaser hereby agrees with the vendor to sell, and
the purchaser agrees to purchase, all that piece or parcel
of land hereinbefore described, at or for the price or sum

, payable in manner hereinafter set out, has
already been paid by way of deposit (as is hereby acknow
ledged).
2. The balance of such purchase-money (viz., the sum

) shall be paid off by
equal half-yearly
instalments of £
, payable on the 1st day of
January and the 1st day of July in each year together with
interest at the rate of five pounds per centum per annum
until payment thereof, calculated on the balance or any
instalment of principal payable hereunder, and such default
may be made in payment of any interest or instalments and

the said Act, and the vendor may take proceedings
thereunder if it thinks fit.
This agreement or contract is intended to be a contract
for the sale of land pursuant to the said Act, and the provi
sions of sections 16 to 26 thereof shall apply accordingly.

Whangaroa Acclimatisation Society’s District.—Notice
No. 1393.

ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this thirtieth
day of August, 1909.

THE HONOURABLE JAMES CARROLL PRESIDING IN COUNCIL.
IN pursuance and exercise of the powers conferred upon him
by section three of the Rabbit Nuisance
Act, 1908, His Excellency the Governor of the
Dominion of New Zealand, acting by and with the advice
and consent of the Executive Council of the said Dominion,
doth hereby declare that weasels may be killed within the
Mangonui and Whangaroa Acclimatisation Society’s Dis
trict, particularized in the First Schedule to the said Act ;
and His Excellency doth hereby further declare that this
notice in Council shall come into force on the date of the
gazetting hereof.
