tion of such special order, as required by section ninety-seven of “The Counties Act, 1908”: And whereas it appears that the ratepayers of the said district have not been misled by the irregularity aforesaid, and it is expedient to validate the said special order.

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities vested in him by section one hundred and twenty-one of “The Local Bodies’ Loans Act, 1908,” and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby validate the public notices relative to the said special order so published as aforesaid with respect to the loan of one thousand pounds, and doth hereby declare that the said notifications and special order shall not be called into question by reason only of the irregularities above referred to.

Applying Closed Part of John and Stanley Streets within the Borough of Eketahuna to a Purpose of Public Utility in Terms of Section 182 (2) of “The Municipal Corporations Act, 1908.”

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this twenty-third day of August, 1909.

Present:

THE HONOURABLE J. A. MILLAR PRESIDING IN COUNCIL.

WHEREAS by the one-hundred-and-eighty-second section of “The Municipal Corporations Act, 1908” (hereinafter termed “the said Act”), it is enacted that where, in diverting, or stopping, or diminishing the width of any street, any part thereof is no longer required for public use, the Council may apply the same, or any part thereof, to any purpose of public convenience or utility approved by the Governor in Council:

And whereas application has been received from the Eketahuna Borough Council that the portion of closed streets formerly known as John and Stanley Streets within the said borough, described in the Schedule hereto, may be applied as a site for a power-house and corporation-yard, the said streets having been stopped by the Eketahuna Borough Council in accordance with the requirements of the said Act: And whereas the Governor is of opinion that the said portion of the closed streets should be so applied:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance of the power and authority conferred upon him by the said Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve that the piece of land described in the Schedule hereto shall be applied to the purposes of public utility aforesaid.


SCHEDULE.

All that piece of land in the Township of Parkville, Eketahuna Borough, bounded on the west by Stanley Street for a distance of 328·3 links; on the north and north-east by the road reserve on the left bank of the Makakahi River for a distance of 22 links and 276·4 links respectively; and on the south-east by John Street for a distance of 267·3 links, having an area of 1 rood 22·7 perches, more or less: as the same is more particularly delineated on the plan marked P.W.D. 24957, coloured green, and deposited in the office of the Minister of Public Works, at Wellington, in the Wellington Provincial District.

Consenting to Land being taken for the Grey Lynn Public School in the Borough of Grey Lynn.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this twenty-third day of August, 1909.

Present:

THE HONOURABLE J. A. MILLAR PRESIDING IN COUNCIL.

WHEREAS by “The Public Works Act, 1908” (hereinafter termed “the said Act”), it is in section fifteen (b) thereof, inter alia, enacted that there shall not be taken any land occupied by any building, yard, garden, orchard,

or vineyard, or in bona fide occupation as an ornamental park or pleasure-ground, without the previous consent of the Governor in Council:

And whereas the consent of the Governor in Council is required to the taking of land for the purposes of a public school in the Borough of Grey Lynn, which is occupied by buildings, yards, and gardens:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the land described in the Schedule hereto being taken for the purposes of a public school in the Borough of Grey Lynn.

IN pursuance and in exercise of the powers vested in him by “The Public Works Act, 1908,” and of all other powers in anywise enabling him in this behalf, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the roads described in the Schedule hereto shall, on and after the date of this Order in Council, be Government roads.
