Vesting Control of Connolly’s, Litchfield, and Fairhall Bridges, on the Middle Renwick Road, in the Omaka Road Board, and apportioning the Cost of Maintenance.

PLUNKET, Governor.

WHEREAS by section one hundred and twenty of “ The Public Works Act, 1908” (hereinafter termed “the said Act”), it is, inter alia, enacted that the Governor may, upon the terms and conditions in the said section mentioned, by Warrant publicly notified, direct that any bridge already constructed, or which may hereafter be constructed, over or across any river or arm of the sea respectively shall, from and after a date to be fixed in such Warrant, be under the exclusive care, control, and management of such local authority as shall be mentioned in that behalf in such Warrant; and may by any such Warrant as aforesaid fix and determine whether all or any, and if so what part, of the cost, whether theretofore incurred or thereafter to be incurred, of maintaining, repairing, improving, or reconstructing any such bridge is to be provided and paid by the local authority or local authorities, and, if so, by what local authority or authorities; and may by any such Warrant as aforesaid direct how, when, and to whom any such payment is to be made:

And whereas by the said Act it is further provided that the Governor may from time to time, with the view of determining whether it is expedient to vest the exclusive care, control, management, and maintenance of any such bridge in any local authority, direct any person to be a Commissioner to inquire into and report to him upon any matter which he shall deem necessary to enable him to determine any such question as aforesaid; and may by any subsequent Warrant, publicly notified from time to time, vary or alter such care, control, and management:

And whereas a Commissioner was appointed under the provisions of “The Public Works Act, 1905,” and an inquiry was duly held, with a view to determine what local authority could most conveniently and efficiently control the bridges known as Connolly’s, Litchfield, and Fairhall Bridges, mentioned in the Schedule hereto, and hereinafter referred to as “the said bridges,” and what proportion of the cost of maintaining, repairing, improving, or reconstructing the said bridges should be paid by any, and if so which, local authority or authorities:

And whereas such Commissioner did report to the Governor, after due inquiry, his opinion as to the matters respecting which he was appointed to report:

And whereas it is expedient to make provision under the said Act for the purposes and in the manner hereinafter set forth:

Now, therefore, I, William Lee, Baron Plunket, the Governor of the Dominion of New Zealand, in pursuance and in exercise of the powers and authority vested in me by the said Act, and of all other powers and authorities in anywise enabling me in this behalf, do hereby direct that the said bridges shall, from and after the date of this Warrant, be under the exclusive care, control, and management of the Omaka Road Board; and, in further pursuance of the aforesaid powers and authorities, I do hereby fix and determine that the cost of maintaining, repairing, improving, or reconstructing the said bridges shall be borne by the Omaka Road Board in the proportion of fifty-three per centum, the Wairau Road Board in the proportion of twenty-seven per centum, the Pelorus Road Board in the proportion of ten per centum, and the Council of the Borough of Blenheim in the proportion of ten per centum of the said cost respectively.

And I do hereby also further direct that any contribution hereby required to be made as aforesaid by the Wairau and Pelorus Road Boards and the Blenheim Borough Council shall be paid from time to time in the proportions hereinbefore prescribed out of the funds of the said Road Boards or Borough Council, within a period of thirty days after demand in writing made by or on behalf of the Omaka Road Board, and such payments shall be made from time to time to the Clerk of the said Road Board for and on account of such Road Board.

SCHEDULE.

THOSE bridges on the Middle Renwick Road known as Connolly’s, Litchfield, and Fairhall Bridges, all in the Omaka Road District.

Exempting Portion of Lincoln Street, Auckland, from the Provisions of Section 117 of “The Public Works Act, 1908,” subject to certain Conditions as to the Building-line.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this tenth day of August, 1909.

THE HONOURABLE GEORGE FOWlds PRESIDING IN COUNCIL.

WHEREAS by subsection one of section one hundred and seventeen of “The Public Works Act, 1908,” it is, inter alia, provided that the said section shall not apply in any case where the local authority having control of a road or street by resolution declares that the provisions thereof shall not apply to any specified road or street, or any specified part thereof, and such resolution is approved by the Governor in Council:

And whereas by subsection two of section one hundred and seventeen of “The Public Works Act, 1908,” it is provided that such approval may be either absolute or subject to such conditions as the Governor by Order in Council thinks fit to impose:

And whereas on the seventeenth day of June, one thousand nine hundred and nine, the Council of the City of Auckland, the local authority having control of the portion of the street known as Lincoln Street, being the street described in the Schedule hereto, did by resolution declare that the provisions of the said section one hundred and seventeen should not apply to the said portion of street:

And whereas it is deemed expedient that such resolution should be approved, subject to the condition hereinafter mentioned:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and in exercise of the powers conferred by the above-in-part-recited Act, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the said resolution, subject to the condition that no building or part of a building shall at any time be erected on Lots 26, 25, and 24, and part 23, of Allotment 42, Section 8, Suburbs of Auckland, within a distance of eight feet from the present street frontage.

SCHEDULE.

THAT portion of street known as Lincoln Street, in the City of Auckland, Auckland Land District, abutting on Lots 26, 25, 24, and part 23, of Allotment 42, Section 8, Suburbs of Auckland; as the said portion of street is more particularly delineated on the plan marked P.W.D. 24989, deposited in the office of the Minister of Public Works, at Wellington, in the Wellington Provincial District, and thereon coloured blue.
