ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this second day of August, 1909.
Present:
THE HONOURABLE J. A. MILLAR PRESIDING IN COUNCIL.
WHEREAS by section four of “The Native Land Laws Amendment Act, 1895,” it is enacted that the Governor may, by Order in Council, except from the operation of section one hundred and seventeen of “The Native Land Court Act, 1894” (hereinafter called “the said Act”), for a limited period or otherwise, and either generally or for such purposes and subject to such restrictions as shall be in such Order specified, any land, wheresoever situate, which is for the time being subject to the operation of the said section, or any interest therein or right over the same, or may in like manner make such exception in favour exclusively of any lessee or other person who has been bona fide in occupation of and has made improvements on such land, or has paid money to Native owners for lease or purchase thereof, prior to the passing of the said Act: Provided that no Order in Council under the provisions of this section shall take effect until after the expiration of two months from the date of the publication thereof in the Gazette:
And whereas the Aotea District Maori Land Board, by a recommendation made on the twenty-fourth day of June, one thousand nine hundred and nine, and received on the twenty-second day of July, one thousand nine hundred and nine, has recommended the Governor to except from the operation of section one hundred and seventeen of “The Native Land Court Act, 1894,” for the purpose of alienation by way of mortgage to a lending Department of the Government, the block or parcel of land particularised and set out in the Schedule hereto:
Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred upon him by section four of “The Native Land Laws Amendment Act, 1895,” and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby except the said land from the operation of section one hundred and seventeen of “The Native Land Court Act, 1894,” for the purpose of alienation by way of mortgage as aforesaid.

SCHEDULE.
ALL that piece or parcel of land, situate in the Nukumaru Survey District, containing 150 acres, more or less, and bounded as follows: On the east, south, and west by the eastern, southern, and western boundaries of Pakaraka No. 1k, 7911·9 links, 1869·4 links, and 7858·8 links respectively; and on the north, 1945·1 links, by a line the western extremity of which is distant 617·5 links from the Great North-western Road, and the eastern extremity of which is distant 2003 links from the said road: which said area is a portion of the land known as Pakaraka No. 1k, and comprised in a certificate of title, Vol. 135, folio 38, of the Register-book of the Wellington District.

Regulations under the Education Acts.—Grants to Secondary Schools.

IN exercise and pursuance of the powers and authorities vested in him by the Education Act, 1908, and the Education Amendment Act, 1908, the Governor, with the advice and consent of the Executive Council of the Dominion, doth hereby amend the regulations made by Order in Council on the seventeenth day of December, one thousand nine hundred and eight, as to grants in secondary schools, by striking out the words “1st January in each year,” and inserting in lieu thereof the words “1st March in each year”; and with the like advice and consent doth prescribe that this Order shall come into force on the date of the first publication thereof in the New Zealand Gazette.

IN pursuance and exercise of the powers and authorities vested in him by “The Agricultural and Pastoral Societies Act, 1908,” His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby incorporate the members of the Inangahua Agricultural and Pastoral Association, and such persons as shall hereafter be admitted members of the said association agreeably to the rules of the said association and the provisions of the said Act, into a body corporate under the style and title of “The Inangahua Agricultural and Pastoral Association.”

Licensing H. H. Dacre to use and occupy a Part of the Foreshore of Mangonui Harbour for Boat-slip Site.

ORDER IN COUNCIL.
At the Government Buildings, at Wellington, this second day of August, 1909.

THE HONOURABLE J. A. MILLAR PRESIDING IN COUNCIL.
WHEREAS, there being no Harbour Board empowered to grant the license hereinafter mentioned under “The Harbours Act, 1908” (hereinafter called “the said Act”), Hubert Henry Dacre, of Mangonui, Dentist (hereinafter called “the licensee”), has applied to the Governor in Council for a license under the said Act to occupy a part of the foreshore of Mangonui Harbour, in order to erect a boat-slip thereon; and, in accordance with the one-hundred-and-fiftieth section of the said Act, has deposited plans (two sheets) in the office of the Marine Department at Wellington (marked M.D. 3362) showing the area of foreshore intended to be occupied, and the manner in which it is proposed to erect the boat-slip: And whereas it has been made to appear to the Governor in Council that the proposed work will not be or tend to the injury of navigation, and the said plan has, prior to the making of this Order in Council, been approved by the Governor in Council: And whereas it is expedient that the license under the said Act should be granted and issued to the licensee, for the purpose aforesaid, on the terms and conditions hereinafter expressed:
Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the power and authority vested in him by the said Act, and of all other powers and authorities enabling him in that behalf, and by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the object for which the said license is required by the licensee as aforesaid; and, in further pursuance and exercise of the said power and authority, and with the like advice and consent as aforesaid, doth hereby license and permit the licensee to use and occupy that part of the foreshore on which the boat-slip is to be erected, as shown on the plans so deposited as aforesaid, for the purpose of erecting and maintaining the said boat-slip thereon, such license to be held and enjoyed by the licensee upon and subject to the terms and conditions set forth in the Schedule hereto.

SCHEDULE.

In these conditions the term “Minister” means the Minister of Marine as defined by “The Shipping and Seamen Act, 1908,” and includes any officer, person, or authority acting by or under the direction of such Minister.

The concessions and privileges conferred by this Order in Council shall extend and apply only to the part of the foreshore necessary for the erection of the boat-slip, as shown on plan marked M.D. 3362 (sheet 1).

In consideration of the concessions and privileges granted by this Order in Council, the licensee shall, on being supplied with a copy thereof, pay to the Minister the sum of two pounds ten shillings, and thereafter an annual sum of ten shillings, dating from the date hereof, the first of such annual payments to be made on the licensee being supplied with a copy of this Order in Council.
