Order under Section 39 of “The Native Land Court Act, 1894.”
IN THE NATIVE LAND COURT OF NEW ZEALAND, GISBORNE DISTRICT.
In the matter of an application under section 39 of “The Native Land Court Act, 1894,” by Hori Mahue to the Chief Judge of the said Court to amend the order of the Court appointing a successor to Ani Topeka, deceased, in the Whangaparaoa No. 2 Block.
WHEREAS the above application has been referred to the Native Land Court for inquiry and report, and the same has been duly reported upon: And whereas it appears that the order made appointing a successor to Ani Topeka, deceased, in the Whangaparaoa No. 2 Block was made in error:
Now, therefore, for the purpose of rectifying the said error, and in exercise of the power in that behalf vested in me as Chief Judge of the said Court by section 39 aforesaid, I hereby order that the order dated the 28th day of June, 1897, appointing a successor to Ani Topeka, deceased, in the Whangaparaoa No. 2 Block, is hereby amended by striking out the name of Hori Mahue as successor to Ani Topeka, deceased, and awarding the interest of the said deceased to Horowai Henihana, f. 15 years; and that all orders founded upon such succession order be amended accordingly. And it is hereby further ordered that Everhard Hannan Henderson be trustee for the said Horowai Henihana.
