ORDER IN COUNCIL.
At the Government House, at Wellington, this fifth day of July, 1909.
Present:
His Excellency the Governor in Council.
BY virtue of the power vested in him by “The Education Act, 1908,” His Excellency the Governor of the Dominion of New Zealand, with the advice and consent of the Executive Council of the said Dominion, doth hereby make the regulations set forth in the Schedule hereto for the election of members of Education Boards; and, with the like advice and consent, doth prescribe that this Order shall come into force on the date of the first publication thereof in the New Zealand Gazette.
SCHEDULE.

THE Returning Officer shall prepare a separate voting-list for each ward of the district, and such lists shall be open to inspection by persons concerned at all reasonable times.

The Returning Officer shall from time to time add to the respective lists the names of all persons who shall become entitled to be enrolled thereon, and shall remove therefrom the names of all persons who cease to be so entitled:
Provided that the validity of any election shall not be questioned on the ground that a name wrongly appears in a list or has been omitted therefrom.

For every election the voting-lists shall be closed on the day on which nominations close, and shall remain closed until the election is completed.

Any member of a School Committee may, by notice addressed to the Returning Officer posted or delivered so as to reach the Returning Officer not less than seven days before the lists are closed, object to any voting-list on some specified ground, and the Returning Officer shall forthwith after the receipt of any such objection inquire into and dispose of the same.

The voting-list for each ward shall be in the following form:—

- In any case in which a ballot becomes necessary, the Returning Officer shall immediately after the nominations are closed prepare and post to the Chairman of each School Committee in the ward for which the ballot is to be taken printed voting-papers, one for each member of that Committee, containing in alphabetical order of surnames a list of all the duly nominated candidates for whom the electors in that ward are entitled to vote, and such voting-paper shall be in the form or to the effect following:—
Voting-paper for Use at Election to be held on the day of , 19 , of Member[s] of the Education Board of the District of for the Ward thereof.
CANDIDATES.
[Set out in alphabetical order of surnames the full name of every duly nominated candidate.]
DIRECTIONS.
The number of candidates to be elected is [Specify the number].
The voter must draw a line through the name of every candidate for whom he does NOT intend to vote, and the number of candidates whose names are left uncancelled must not exceed the total number of candidates to be elected.
The voter’s name must not be written on the voting-paper. This voting-paper must be delivered to the Returning Officer in a closed envelope before 5 o’clock in the afternoon of the day of the election, or posted to him in such envelope in time to receive a post-mark not later than for that day. The envelope must bear on the outside thereof the word “Voting-paper.”
The envelope must be addressed “The Secretary to the Education Board, Returning Officer, [with the addition of the name of the town in which the office is situated].

At every election the voting-papers for the district shall be numbered consecutively, irrespective of the wards.

In any case in which the members of a Committee are entitled to more than one vote, the voting-papers sent to the Chairman of that Committee shall bear a number indicating the number of such votes, the said number being the same as appears in the last column of the voting-list opposite the name of the Committee, and in the count the Returning Officer shall give each of such voting-papers the value represented by that number.

The Chairman of the School Committee shall post or deliver a voting-paper to each member of the Committee, and shall record in the Committee’s minute-book, and produce at the first meeting of the Committee thereafter, a list of the members showing the number of the voting-paper sent to each. This list shall be regarded as confidential, and shall not be made use of for any purpose whatever other than for the purposes of an official inquiry into any irregularities connected with the election.

The form of voting-paper prescribed by Order in Council dated 11th June, 1904, is hereby revoked.
