Locality and Description of Reserves.
Reserve No. 1667 is situated in the Township of South Rakaia, close to the railway-station. There are upon the reserve a large store (about 33 ft. by 96 ft.), stable and trap-shed (about 24 ft. by 27 ft.), and small iron shed, yards, and fencing, all of which are let with the land, subject to the special conditions embodied in clause 12 of the conditions following.
Reserves Nos. 2447 and 2448 are situated on the western side of the Whiterock River, at the foot of the eastern slope of Mount Nimrod, about four miles and a half southward from the Cannington Homestead, and about eleven miles south-westward from Cave Railway-station. They comprise stony terrace land and river-flats, with native pasture surface-sown with English grasses. There are about 90 chains of fencing on Reserve 2447, and about 140 chains of fencing on Reserve 2448, which are the property of the outgoing tenants.
Reserve No. 2704 is situated on the northern bank of the Opihi River, near its junction with the Tengawai River, about a mile from Pleasant Point Township and railway-station. It comprises low-lying river-flats, partly liable to flood; part of the land is infested with gorse. There are on this reserve improvements consisting of a five-roomed house, with outbuildings, three-stalled stable, cowshed, orchard, and garden, boundary and subdivisional fencing, all valued at £299 13s., which sum must be paid by the purchaser of the new lease before being admitted to possession of the land.
Reserves Nos. 951 and 952 are situated in the Borough of Waimate, the former at the corner of Manse and Innes Streets, and the latter at the corner of Dobson and High Streets.
The lessees will be required to maintain the fences on the reserves in good condition, and so leave them at the end of the term of lease.
TERMS AND CONDITIONS OF LEASE.
- The purchaser of a lease shall, immediately upon the fall of the hammer, deposit an amount equal to six months’ rent at the rate offered, together with £1 1s. lease fee, and, in the case of Reserve No. 2704, the amount of valuation for improvements.
- Possession will be given on the day of sale.
- The leases will be for the terms stated in the Schedule.
- The Commissioner of Crown Lands may at any time resume possession of the land comprised in a lease, or any portion thereof, by giving to the lessee twelve months’ notice in writing of his intention so to do.
- The lessee shall have no right to compensation either for any improvements that may be placed upon the land or on account of the aforesaid resumption, or for any other cause.
- The lessee shall have no right to sublet, transfer, or otherwise dispose of the whole or any portion of the land comprised in the lease, except with the written consent of the Commissioner of Crown Lands first had and obtained.
- The land shall be used for grazing purposes only, and shall not be broken up or cropped without the written consent of the Commissioner of Crown Lands first had and obtained.
- The lessee shall destroy all rabbits on the land, and shall prevent their increase or spread, to the satisfaction of the Commissioner of Crown Lands.
- The lessee shall prevent the growth and spread of gorse, broom, and sweetbriar on the land comprised in the lease, and he shall with all reasonable despatch remove, or cause to be removed, all gorse, sweetbriar, broom, or other noxious weeds or plants, as may be directed by the Commissioner of Crown Lands.
- The rent shall be payable half-yearly in advance, free from all deductions whatsoever.
- The lease shall be liable to forfeiture in case the lessee shall fail to fulfil any of the conditions of the said lease within sixty days after the date on which the same ought to be fulfilled.
- The lessee of Reserve No. 1667 will be required, at his own cost in all things, to maintain the buildings, fences, and other erections on the reserve during the whole of the term in a good and proper state of repair to the satisfaction of the Commissioner of Crown Lands, reasonable wear-and-tear, and damage by fire, earthquake, or tempest, excepted; to paint the main store at least twice during the term with at least two coats of good paint; and to keep the buildings insured in the name of His Majesty the King for the full insurable value thereof during the whole of the term, all policies and receipts in respect thereof to be deposited with the Commissioner of Crown Lands.
