FREDERICK BOURNE, of Wanganui, to be the Returning Officer for the purpose of conducting the first general election of members of the Gonville and Castlecliff Tramway Board under the said Act, and doth also hereby appoint Thursday, the tenth day of December, one thousand nine hundred and eight, to be the day upon which the said first general election of members of the said Board shall be held.

Validating the Public Notification of the Special Order in connection with a Loan of £1,000 applied for by the Okain's Bay Road Board.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twentieth day of November, 1908.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS the Okain's Bay Road Board lately proposed to raise a loan of one thousand pounds, under “The Local Bodies' Loans Act, 1908,” for the purpose of the erection of a new shed and wharf at Okain's Bay and a roadway to same: And whereas the provisions of section seventy-two of “The Road Boards Act, 1908,” have not been complied with, inasmuch as the requisite number of days did not elapse between the holding of the special meeting making the special order for the special rate and the subsequent meeting held to confirm the resolution passed at such special meeting, but the notice of the subsequent meeting to confirm the resolution aforesaid was duly published for four weeks prior to the holding of such subsequent meeting: And whereas it appears that the ratepayers have not been misled by such irregularity, and it is expedient to validate such irregularity:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers conferred by section one hundred and twenty-one of “The Local Bodies' Loans Act, 1908,” and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that such subsequent meeting shall be deemed to have been duly convened and held as by the provisions of section seventy-two of “The Road Boards Act, 1908,” required, and that the resolution passed at the special meeting shall be deemed to have been duly confirmed, and that the proceedings relative to the said loan shall not be called into question by reason only of the irregularity aforesaid.

Modifying Order in Council fixing Dues for Tauranga Town Wharf, and prescribing other Dues in lieu thereof.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twentieth day of November, 1908.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS it is provided by “The Harbours Act, 1908” (hereinafter termed “the said Act”), that in harbours where there is no Harbour Board the Governor in Council shall have all the powers, functions, duties, and authorities by the said Act conferred upon Harbour Boards, and may, in cases where such powers would be exercised under by-laws to be made by a Board, exercise the same under regulations to be made in manner provided in section two hundred and five of the said Act: And whereas there is no Harbour Board having jurisdiction in the Harbour of Tauranga:

And whereas by Order in Council dated the seventeenth day of October, one thousand nine hundred and four, the dues and rates specified in the Schedule thereto were prescribed for the use of the wharf in Tauranga Harbour:

And whereas by Order in Council dated the eleventh day of September, one thousand nine hundred and eight, the first-mentioned Order in Council of the seventeenth day of October, one thousand nine hundred and four, was amended by altering the Schedule thereto with the object of adding to it the dues and charges payable by vessels laying off or making use of the said wharf:

And whereas it is desirable that the said Orders in Council of the seventeenth day of October, one thousand nine hundred and four, and the seventh day of September, one thousand nine hundred and eight, should, so far as the same relate to the dues and rates prescribed thereby, be revoked, and that other dues and rates should be prescribed for the use of the said wharf:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the power and authority conferred upon him by “The Harbours Act, 1908,” and of all other powers and authorities enabling him in that behalf, doth hereby revoke the said Orders in Council of the seventeenth day of October, one thousand nine hundred and four, and the seventh day of September, one thousand nine hundred and eight, so far as the same relate to the dues and rates prescribed thereby, and in lieu thereof doth hereby prescribe that the dues and rates set forth in the Schedule hereto shall, on and after the date of the publication of this Order in Council in the New Zealand Gazette, be charged and taken by the Tauranga Borough Council for the use of the said wharf.


SCHEDULE.

SHIPPING WHARFAGE.

Every person who shall use any wharf with any vessel shall pay for the use thereof as follows, that is to say:—

For any vessel under 10 tons register, for every ton or part of a ton, at per day .. 0 2

For vessels over 10 tons register, on first 10 tons, per day .. .. .. .. 0 2

For every ton over 10 tons, per day per ton .. .. .. .. .. 0 0¼

Provided that such payment shall be 5s. per quarter of a year for a vessel under 10 tons, or 10s. per quarter of a year for a vessel over 10 tons and under 20 tons, if such payment be paid in advance on the quarter-days commencing as from the 1st days of January, April, July, and October in each year, at the office of the Council.

GOODS WHARFAGE.

Every person who shall use any wharf or landing-place under the control of the Council for landing or shipping any goods shall pay to the Council wharf dues as follows:—

(1.) For all goods (except such as are hereinafter provided for) landed on any wharf, a rate of 9d. per ton or part of a ton weight or measurement at the option of the Council, and for every parcel not exceeding 2 ft., 3d.

(2.) For all goods landed or passed over any wharf or discharged over side from one vessel into another vessel laying alongside any wharf for transhipment, 6d. per ton or part of a ton.

All goods intended for transhipment must be declared in writing before landing as intended to be landed for transhipment only (the name of the port and vessel to be given), otherwise they will be charged full rates.

Luggage shall not include furniture, commercial travellers' sample packages, merchandise of any description, theatrical scenery, property, or effects.

STORAGE.

Every person whose goods shall be stored in any shed or upon any wharf shall pay in respect of such goods and the storage thereof the following charges, that is to say:—

Upon imported goods, 3d. per ton or part of a ton per day after the first clear day, which is free of charge.

Upon goods intended for shipment, the first five days free, after that time 3d. per ton or part of a ton per day.

Upon transhipment goods, the first three days free, after that time, 3d. per ton or part of a ton per day.

Upon imported timber, 6d. per 1,000 ft. or part of a 1,000 ft. per day.

Upon transhipment timber, the first three days free, after that time the ordinary rates,
