Timber in Auckland Land District for Sale by Public Tender.

NOTICE is hereby given, in terms of “The Land Act, 1892,” and amendments and Timber Regulations thereunder, that written tenders will be received at this office from the proprietors of existing sawmills, and logging contractors, up till 12 o’clock noon on Monday, the 27th day of April, 1908, for the purchase of the kauri and other milling-timbers standing on the undermentioned lots.
SCHEDULE.
AUCKLAND LAND DISTRICT.
HOKIANGA COUNTY.
Lot 1.
Section 2, Block XIV, Punakitere Survey District.
1,683 GREEN and 66 dry kauri-trees, containing (approximately) 3,879,591 sup. ft. (standing measurement).
Distinguishing-brand thus: ||.
Time for removal: Three years.
Upset price: 2s. per 100 sup. ft.
Terms: One-fifth in cash within seven days after acceptance of tender, one-fifth in seven months, one-fifth in fourteen months, one-fifth in twenty-one months, and one-fifth in twenty-eight months thereafter.

Lot 3.
Section 16, Block XIII, Rotorua Survey District.
10 totara-trees, containing (approximately) 8,120 sup. ft. (standing measurement).
1,377 rimu-trees, containing (approximately) 1,309,520 sup. ft. (standing measurement).
110 kahikatea-trees, containing (approximately) 123,167 sup. ft. (standing measurement).
93 matai-trees, containing (approximately) 43,249 sup. ft. (standing measurement).
264 tanekaha-trees, containing (approximately) 150,325 sup. ft. (standing measurement).
Distinguishing-brand thus: ||.
Time for removal: Two years.
Upset price for rimu: 1s. per 100 sup. ft.; other timbers at schedule rates.
Terms: One-third in cash within seven days after acceptance of tender, one-third in eight months, and one-third in sixteen months thereafter.
Faulty and undersized trees not included in this sale, and branded F R ∧—viz., 5 totara, 103 rimu, 9 kahikatea, 16 matai, and 17 tanekaha.
CONDITIONS.

Intending tenderers are expected to visit the locality and to satisfy themselves in every particular on all matters relating to their tender.

The aforementioned quantities, qualities, and kind as to the said timber shall be taken as sufficiently accurate for the purpose of this sale; and no contract for purchase shall be voidable, nor shall the successful tenderer be entitled to any abatement in price, by reason of the said timber being of less quantity, quality, and kind than as stated hereon or in any advertisement having reference to the said timber, nor shall any extra sum be claimed by the Crown if for any reason the quantity of timber is found to be in excess of that stated hereon.

No tender will be considered wherein a less royalty is offered for kauri and rimu than the upset prices as stated in terms of each lot; other timbers not less than minimum schedule rates of royalty in terms of the Timber Regulations.

All timber on each lot, whether standing or in logs, shall remain the property of the Crown until all the instalments are paid.

The successful tenderer shall make and deliver to the Commissioner of Crown Lands, quarterly, or at a period fixed by the Commissioner, a statement, with statutory declaration, of the number of trees felled, and showing the numbers scribed by the Crown thereon; also the total quantity of timber felled and removed under each cutting license.

In all lots the quantities stated are standing measurements.

Should any dispute arise as to boundaries, the decision of the Commissioner of Crown Lands shall be final.

Offers will be considered from the successful tenderers for the purchase of the faulty and undersized trees standing on each lot as stated.

In the event of any of the above lots not being disposed of, consideration will be given to applications made at any time within six months from the above date of closing of tenders (unless previously formally withdrawn), providing, however, that the amount offered is not less than the upset price stated hereon.

No extension of time for removal of timber will be allowed successful tenderers who bleed kauri-trees included in this sale unless full payment of purchase-money is made.

All tenders must be submitted on forms which will be supplied on application to the above office, and envelopes enclosing same to be marked “Tender for Timber,” and addressed to the Commissioner of Crown Lands, Auckland.

The highest or any tender not necessarily accepted.
TERMS.
Separate tenders for the various lots of timber must be accompanied with a deposit of 5 per cent. on the amount of tender, in cash, marked cheque, or post-office order; the balance to be paid, if tender accepted, as specified in the terms of each lot.
All such instalment-payments shall bear interest at the rate of 5 per cent. per annum as from the date of acceptance of tender, and, with the interest, shall be secured by promissory notes made and indorsed to the satisfaction of the Commissioner of Crown Lands.
NOTE.—Poster plans (Local 24) and full particulars of sale may be seen at the principal post-offices throughout the Auckland District, or copies will be forwarded on application being made to the above office.

NOTICE is hereby given, in pursuance of section 240 of “The Land Act, 1892,” that the undermentioned land will be disposed of to the holder of adjoining land, under section 114 of the said Act, on or after Thursday, the 30th day of April, 1908.
