At the Government Buildings, at Wellington, this twenty-ninth day of January, 1908.

THE RIGHT HONOURABLE SIR J. G. WARD, K.C.M.G., PRESIDING IN COUNCIL.
WHEREAS the Waitomo County Council on the sixth day of October, one thousand nine hundred and six, caused a poll of the ratepayers to be taken for the purpose of voting upon a proposal to raise a loan of seven thousand pounds for the purpose of improving and metalling the road from Oparure westward through the Mairoa Riding: And whereas the voting-paper used at such poll was not in the form prescribed in the Schedule to “The Local Bodies' Loans Amendment Act, 1903”: And whereas the Governor is satisfied that the ratepayers of the said county have not been misled, and it is expedient to validate such irregularity:
Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the power conferred by section ten of “The Local Bodies' Loans Amendment Act, 1902,” and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the voting-papers so used as aforesaid shall be deemed and taken to be as valid as though the same were in due form, and that the proceedings relative to the said loan shall not be called in question by reason of the irregularity aforesaid.

Exempting Hill Street, City of Wellington, from the Provisions of Section 117 of “The Public Works Act, 1905.”

THE RIGHT HONOURABLE SIR J. G. WARD, K.C.M.G., PRESIDING IN COUNCIL.
WHEREAS by subsection one of section one hundred and seventeen of “The Public Works Act, 1905,” it is, inter alia, provided that the said section shall not apply in any case where the local authority having control of a road or street by resolution declares that the provisions thereof shall not apply to any specified road or street, or any specified part thereof, and such resolution is approved by the Governor in Council:
And whereas by section three of “The Public Works Act Amendment Act, 1906,” it is provided that such approval may be either absolute or subject to such conditions as the Governor by Order in Council thinks fit to impose:
And whereas on the sixth day of June, one thousand nine hundred and seven, the Council of the City of Wellington, the local authority having control of the road known as Hill Street, being the street described in the Schedule hereto, did by resolution declare that the provisions of the said section one hundred and seventeen should not apply to the said street:
And whereas it is deemed expedient that such resolution should be approved:
Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and in exercise of the powers conferred by the above-in-part-recited Acts, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve the said resolution.

SCHEDULE.
That portion of the street in the City of Wellington, in the Wellington Land District, known as Hill Street, running from Molesworth Street to Tinakori Road, being a distance of 24 chains, more or less; as the said street is more particularly delineated on the plan marked R. 9410, deposited in the office of the Chief Engineer of Roads, at Wellington, in the Wellington Land District, and thereon coloured pink.

And whereas it is deemed expedient that such resolution should be approved:
Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and in exercise of the powers conferred by the above-in-part-recited Acts, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the said resolution.

SCHEDULE.
All that road commencing at the north-west corner of Section 6, and running in a south-easterly direction along the frontage of the said Section 6, and along part of the frontage of Section 5 till it junctions with the road running in a south-westerly direction through the said Section 5, all in Block LIII, Tokomairiro Survey District, being a distance of 25 chains, more or less.
Also all that road commencing at the north-eastern boundary of Section 6, Block LIII, Tokomairiro Survey District, and running in a south-easterly direction till it meets the road running in a south-westerly direction through the said Section 6, being a distance of 11 chains, more or less.
Also all that road commencing at the north-eastern boundary of Section 7, Block LIV, Tokomairiro Survey District, and running in a southerly direction till it meets the south-eastern boundary of the said Section 7, being a distance of 10 chains, more or less.
Also all that road commencing at its junction with the road on the north-eastern boundary of Section half of 12, and running in a south-westerly direction generally through the said Section half of 12, and through Sections 14, 15, and 9 to the south-eastern boundary of the said Section 9, all in Block LIV, Tokomairiro Survey District, being a distance of 57 chains, more or less.
Also all that road commencing at the north-eastern corner of Section 13, and running in a north-western direction along the north-eastern boundaries of Sections 13, half of 12, and part of the boundary of Section half of 1 till it meets the road running in a south-westerly direction through the said Section half of 1, all in Block LIV, Tokomairiro Survey District, being a distance of 42 chains more or less.
Also all that road commencing at the north-eastern corner of Section half of 5, Block LI, Tokomairiro Survey District, and running in a north-easterly direction along part of the north-western boundary of Section 1, Block L, Tokomairiro
