Excepting Land from the Operation of Section 117 of “The Native Land Court Act, 1894.”

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this twenty-ninth day of January, 1908.

Present:

PRESIDING IN COUNCIL.

WHEREAS by section four of “The Native Land Laws Amendment Act, 1895,” it is enacted that the Governor may, by Order in Council, except from the operation of section one hundred and seventeen of “The Native Land Court Act, 1894” (hereinafter called “the said Act”), for a limited period or otherwise, and either generally or for such purposes and subject to such restrictions as shall be in such Order specified, any land, wheresoever situate, which is for the time being subject to the operation of the said section, or any interest therein or right over the same, or may in like manner make such exception in favour exclusively of any lessee or other person who has been bonâ fide in occupation of and has made improvements on such land, or has paid money to Native owners for lease or purchase thereof, prior to the passing of the said Act: Provided that no Order in Council under the provisions of this section shall take effect until after the expiration of two months from the date of the publication thereof in the Gazette: Provided also that every alienation under the provisions of this section shall be confirmed by the Court in terms of section fifty-three of the said Act:

And whereas the Tokerau District Maori Land Board, by a recommendation made on the seventh day of October, one thousand nine hundred and seven, and received on the twenty-fourth day of October, one thousand nine hundred and seven, has recommended the Governor to except from the operation of section one hundred and seventeen of “The Native Land Court Act, 1894,” for the purpose of alienation by way of sale, the block or parcel of land known as Taetetere:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred upon him by section four of “The Native Land Laws Amendment Act, 1895,” and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby except from the operation of section one hundred and seventeen of “The Native Land Court Act, 1894,” for the purpose of alienation by way of sale, the block or parcel of land particularised and set out in the Schedule hereto.


SCHEDULE.

ALL that piece or parcel of land, situate in the Auckland Land District, containing 186 acres, more or less, known as Taetetere, and comprised in an order of the Native Land Court, on investigation of title, dated the 10th day of April, 1907, in favour of Karipa te Kaupapa.

Validating the Public Notifications of the Special Order in connection with a Loan of £3,015 applied for by the Sluggish River Drainage Board.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this twenty-ninth day of January, 1908.

Present:

PRESIDING IN COUNCIL.

WHEREAS the Sluggish River Drainage Board lately proposed to raise a loan of three thousand and fifteen pounds, under “The Local Bodies' Loans Act, 1901,” for the purpose of efficiently repairing and maintaining a drain known as the main drain extending from the Oroua River to the north-eastern boundary of the Board's district: And whereas the public notification of the special order making the special rate was published in the Manawatu Evening Standard newspaper for four weeks, but was not published once in each week of the four weeks immediately preceding the date of the subsequent meeting at which the special order was confirmed, as required by section eleven of “The Counties Act Amendment Act, 1903”: And whereas it appears that the ratepayers have not been misled by such irregularity, and it is expedient to validate the said notification:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers conferred by section ten of “The Local Bodies' Loans Amendment Act, 1902,” and acting by and with the consent of the Executive Council of the said Dominion, doth hereby declare that such public notification of the special order shall be deemed and taken to be as valid as though the said notification had been properly published, and that the proceedings relative to the said loan shall not be called into question by reason only of the irregularity aforesaid.

Validating the Voting-papers used in connection with a Loan of £1,000 for Widening and Metalling the Waitetuna-Aotea Road, applied for by the Kawhia County Council.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this twenty-ninth day of January, 1908.

Present:

THE RIGHT HONOURABLE SIR J. G. WARD, K.C.M.G.,
PRESIDING IN COUNCIL.

WHEREAS the Kawhia County Council has applied to the Minister of Finance, under the provisions of “The Local Bodies' Loans Act, 1901” (hereinafter called “the said Act”), and its amendments, for a loan of one thousand pounds for the purpose of widening and metalling the Waitetuna-Aotea Road: And whereas by section eleven of the said Act it is provided that the form of voting-paper set forth in the Schedule to “The Local Bodies' Loans Amendment Act, 1903,” shall be used at any poll of ratepayers taken upon a proposal for a loan under the said Act: And whereas the voting-papers used at the poll of ratepayers taken, under the provisions of the said Act, on the twenty-first day of July, one thousand nine hundred and six, were not in the form set forth in the said Schedule: And whereas the Governor is satisfied that the ratepayers have not been misled by such irregularity or defect, and it appears expedient to validate the said poll of ratepayers:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities contained in the tenth section of “The Local Bodies' Loans Amendment Act, 1902,” doth hereby validate the said voting-papers so used as aforesaid, and doth hereby declare that all proceedings in relation to the said loan shall be and be deemed to have been as good, valid, and effectual as if the said recited poll of ratepayers had been duly and regularly taken.
