Amending Trout-fishing Regulations for Hawke's Bay Acclimatisation District.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this twenty-second day of October, 1908.

Present :

THE RIGHT HONOURABLE SIR J. G. WARD, K.C.M.G., PRESIDING IN COUNCIL.

WHEREAS regulations for trout-fishing in the Hawke's Bay Acclimatisation District were made by the Governor in Council on the twenty-first day of September, one thousand nine hundred and four, and published in the New Zealand Gazette of the twenty-second day of the same month: And whereas it is desirable to amend clause one of the said regulations:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance of the powers and authorities vested in him by “The Fisheries Act, 1908,” and of all other powers and authorities enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the words “East Taupo” shall be omitted from clause one of the said regulations of the twenty-first day of September, one thousand nine hundred and four.

Regulations for netting Trout in Lake Hawea, in the Provincial District of Otago.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this twenty-second day of October, 1908.

THE RIGHT HONOURABLE SIR J. G. WARD, K.C.M.G., PRESIDING IN COUNCIL.

IN pursuance of the powers and authorities vested in him by “The Fisheries Act, 1908,” His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby make the following regulations, and doth hereby declare that such regulations shall have effect on and in the waters of Lake Hawea, in the Provincial District of Otago (hereinafter termed “the said lake”):

REGULATIONS.

  1. The season for netting trout shall extend from the first day of November in any one year to the fifteenth day of March in the following year, both days inclusive.

  2. No net of a smaller size in the mesh than seven inches in diameter when wetted and stretched for the taking of trout shall be used in any portion of the said lake.

  3. No person shall be permitted to use a net for the purpose of fishing therewith unless he holds a valid license so to fish issued by the Otago Acclimatisation Society (hereinafter called “the society”).

  4. It shall be lawful for the holder of every license issued as aforesaid to use two nets for the purpose of fishing for trout in the said lake.

  5. Any person holding a trout-fishing license under the trout-fishing regulations for the Otago Acclimatisation District may fish with rod and line in the said lake, anything contained in these regulations to the contrary notwithstanding.

  6. The society, through its officers, rangers, inspectors, constables, or other person duly authorised, shall have full power at any time to inspect, examine, and search for any net, tackle, engine, boat, or any utensil or instrument used or employed for the taking of trout within the said lake, and to seize and appropriate in the interests of the society all and every net, tackle, engine, or any utensil or instrument so used and employed in contravention of these regulations, and also to seize and appropriate as aforesaid all and every fish caught and in the possession of any person who cannot, or who does not, produce at the time of catching or disposing of such fish a license under the hand of the secretary of the society empowering him in that behalf.

  7. The fee for every such annual license to net trout in the said lake shall be the sum of one pound for each person so licensed, such fee to be paid to the secretary or other duly authorised officer of the society.

  8. It shall be the duty of the chairman of the society to forward to the Marine Department, on or before the fifteenth day of April in every year, a statement, certified by such chairman, showing in detail the number and particulars of all licenses to net granted by the society as up to the fifteenth day of March previous.

  9. It shall be unlawful for any person, whether licensed as aforesaid or not, to sell trout taken under these regulations.
