And whereas the said land is held or occupied by Native owners under a title which is not derived from the Crown:

And whereas a map of the said land has been prepared in duplicate, as required by the ninetieth section of "The Public Works Act, 1908":

Now, therefore, in pursuance and in exercise of the powers vested in him by "The Public Works Act, 1908," and of all other powers in anywise enabling him in this behalf, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby proclaim and declare that the land shown upon such map, and described in the Schedule hereto, is hereby taken for landing reserves as aforesaid; and the said land shall vest in His Majesty the King as from the twenty-third day of November, one thousand nine hundred and eight.

Terms and Conditions of Lease of Village-homestead Allotments in Horopito West Village Settlement, Wellington Land District.

ORDER IN COUNCIL.

At the Government House, at Wellington, this sixth day of October, 1908.

Present:

His Excellency the Governor in Council.

WHEREAS by the two-hundred-and-third section of "The Land Act, 1908," it is enacted that the Governor in Council may fix the terms and conditions upon which the lands in any village settlement shall be disposed of, subject as in the said section is provided: And whereas by a Proclamation made under the said Act on the fifteenth day of September, one thousand nine hundred and eight, and published in the New Zealand Gazette on the seventeenth day of September, one thousand nine hundred and eight, the lands described in the First Schedule hereto have been set apart under the said Act and declared open for lease as a village settlement, and it is expedient to fix the terms and conditions upon which the said lands shall be disposed of:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred by the said Act, and by and with the advice and consent of the Executive Council of the said Dominion, doth hereby fix the terms and conditions on which the lands mentioned in the First Schedule hereto shall be disposed of by way of renewable lease, and which said terms and conditions are set forth in the Second Schedule hereto.

Horopito is situated on the North Island Main Trunk Railway, about 207 miles from Wellington and 219 miles from Auckland, and lies on the main Waimarino–Waioru Road, about twenty miles from Raurimu and seven miles north of Ohakune. A metalled road leads to Raetihi, about eight miles distant. It is surrounded by a large bush of milling-timber, and the country to the west is being gradually opened up for settlement. The sections are in heavy standing bush, comprising principally rimu, maire, birch, and kaikawaka, and comprise for the most part flat land with light soil, principally on grit formation; some are wet in places. The town contains a post-office, school, and store.
