At the Government House, at Wellington, this sixth day of October, 1908.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by “The Public Works Act, 1908,” it is, in section ninety-four thereof, provided that there shall not be taken under the authority of the last preceding section any land occupied by any pa, village, or cultivation, or any buildings, gardens, orchards, plantations, or any burial or ornamental grounds, without the previous consent of the Governor in Council:

And whereas the land described in the Schedule hereto is required to be taken for the purposes of the Te Wairoa-Tarawera Road:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the land described in the Schedule hereto being taken for the purposes above mentioned.

Amending Order in Council fixing Lighthouse Dues.

ORDER IN COUNCIL.
At the Government House, at Wellington, this sixth day of October, 1908.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS an Order in Council fixing lighthouse dues was made on the fifteenth day of September, one thousand nine hundred and eight, and published in the New Zealand Gazette of the seventeenth day of the same month:

And whereas it is desirable to amend such Order in Council:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in exercise of the power and authority conferred upon him by “The Shipping and Seamen Act, 1903,” and of all other powers and authorities enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby amend the said Order in Council of the fifteenth day of September, one thousand nine hundred and eight, by substituting the word “place” for the word “port,” in the last line of the fourth paragraph, and by deleting the word “Kai-koura,” which occurs between the words “Havelock” and “Wairau,” in the Schedule.

And, with the like advice and consent, His Excellency the Governor doth further order that this Order in Council shall come into force on the first day of October next.

Amending Boundaries of Papakura and Wairoa Road Districts, County of Manukau.

ORDER IN COUNCIL.
At the Government House, at Wellington, this sixth day of October, 1908.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS “The Counties Act, 1908,” is suspended in the County of Manukau: And whereas, in pursuance of section twenty-four of “The Road Boards Act, 1908,” petitions have been presented to His Excellency the Governor praying him to alter the boundaries of the Papakura and Wairoa Road Districts, situated in the said County of Manukau:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities vested in him by the said “Road Boards Act, 1908,” and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that, from and after the thirty-first day of October, one thousand nine hundred and eight, the area described in the First Schedule hereto shall be excluded from the Wairoa Road District and added to the Papakura Road District, and that the boundaries of the said Papakura Road District and of the said Wairoa Road District shall be those described in the Second Schedule hereto.

FIRST SCHEDULE.

AREA TO BE EXCLUDED FROM WAIROA ROAD DISTRICT AND ADDED TO PAPAKURA ROAD DISTRICT.

ALL that area in the Auckland Land District bounded towards the north-east by the road forming the north-eastern boundaries of Sections Nos. 35 and 42, Papakura Parish; towards the south generally by the road forming the south-eastern boundary of the last-mentioned section, and by the Town District of Papakura to the Great South Road; thence towards the south-west by a line along the middle of the Great South Road to a point in line with the northern side of the road forming the northern boundary of Section No. 33, Papakura Parish; and thence towards the north-west by a right line to and along the northern side of the said road forming the northern boundaries of Sections Nos. 33, 34, and 35, Papakura Parish, to the place of commencement.

SECOND SCHEDULE.

PAPAKURA ROAD DISTRICT (AMENDED BOUNDARIES).

ALL that area in the Auckland Land District bounded towards the north generally by the road forming the southern boundary of the Manurewa Parish, from the Great South Road at the southern boundary of Section No. 40, Manurewa Parish, to the southernmost corner of Section No. 94; thence by that section and Sections Nos. 91 and 153, Manurewa Parish, Sections Nos. 178, 131, and 132, Pakuranga Parish, Sections Nos. 33 and 55, Maraetai Parish, by the road forming the south-eastern boundary of Section No. 57, and by Section No. 63, Maraetai Parish. to Section No. 80, Wairoa Parish; thence by the north-western and north-eastern boundary-lines of the last-mentioned section to its north-eastern corner; thence towards the south-east generally by Section No. 78, Wairoa Parish, to the road forming the northern boundary of Section No. 79; thence
