Kauri Timber in Auckland Land District for Sale by Public Tender.
District Lands Office,
Auckland, 15th September, 1908.
NOTICE is hereby given, in terms of “The Land Act, 1908,” and the regulations thereunder, that written tenders will be received at the District Lands Office, Auckland, from the proprietors of existing sawmills, and logging contractors, up to 12 o’clock noon on Wednesday, the 21st day of October, 1908, for the purchase of the kauri timber standing on the undermentioned section.
SCHEDULE.
AUCKLAND LAND DISTRICT.
Section 329a, Parish of Waipu, Whangarei County.
58 GREEN and dry kauri-trees, containing (approximately) 80,679 sup. feet (standing measurement).
Distinguishing-brand thus: X.
Time for removal: Six months.
CONDITIONS.

Intending tenderers are expected to visit the locality and to satisfy themselves in every particular on all matters relating to their tender.

The aforementioned quantity, quality, and kind as to the said timber shall be taken as sufficiently accurate for the purpose of this sale; and no contract for purchase shall be voidable, nor shall the successful tenderer be entitled to any abatement in price, by reason of the said timber being of less quantity, quality, and kind than as stated herein or in any advertisement having reference to the said timber, nor shall any extra sum be claimed by the Crown if for any reason the quantity of timber is found to be in excess of that stated herein.

No tender will be considered wherein a less royalty is offered than 2s. per 100 sup. feet for the timber.

The quantity stated is standing measurement.

Should any dispute arise as to boundaries the decision of the Commissioner of Crown Lands shall be final.

In the event of the above lot not being disposed of, consideration will be given to applications made at any time within six months from the above date of closing of tenders (unless previously formally withdrawn), providing, however, that the amount offered is not less than the royalty stated herein.

Tenders must be submitted on forms which will be supplied on application to the Postmasters at Whangarei and Waipu, or to this office, and envelopes enclosing same to be marked “Tender for Timber,” and addressed to the Commissioner of Crown Lands, Auckland.

The highest or any tender not necessarily accepted.
TERMS.
Tenders must be accompanied by a deposit of 5 per cent. on the amount of their tender, in cash, marked cheque, or post-office order; the balance to be paid, if tender accepted, within seven days after date of acceptance.

Timber in Southland Land District for Sale by Public Auction.
District Lands Office,
Invercargill, 15th September, 1908.
NOTICE is hereby given that the milling-timber on the undermentioned land will be offered for sale by public auction, at this office, on Tuesday, the 27th day of October, 1908, at 11 o’clock a.m.

SOUTHLAND LAND DISTRICT.
SECTION 34, Block XXIV, Invercargill Hundred: Area, 505 acres.

Situated about ten miles from Invercargill and about six miles from Long Bush Railway-station.
CONDITIONS OF SALE.

The right to cut and remove the timber on the lot will be sold generally in accordance with the provisions of “The Land Act, 1908,” the Timber Regulations made thereunder, and the following conditions:—

The quantities of the various timbers set forth in the Schedule are approximate only, and are furnished for the general information of intending purchasers, who are expected to make their own estimate of the quantity of the timber on the lot.

The purchaser of the lot shall pay the purchase-money to the Receiver of Land Revenue, Invercargill, on the fall of the hammer.

The purchaser of the lot shall have the right to cut all the milling-timber thereon during a period of two years from the date of the sale.

The purchaser shall have the right for the cutting and removal of the milling-timber only, and shall have no right to the use of the land.

At the expiration of the term allowed to cut—viz., two years—the purchaser must leave all fences on the lot in a state equal to their present condition and value. Should the purchaser fell or cause any trees to be felled on any of the fences, the posts and wires must be repaired, and all tree-tops removed from the fence-lines to a distance of 6 ft. on both sides of the fence.

The purchaser shall not put, throw, or place, or allow to be put, thrown, or placed, into any stream or watercourse, or into any place where it may be washed into any stream or watercourse, any sawdust or other sawmill refuse.

The lot will be sold generally in accordance with the area and boundaries as shown on the map in the office of the Chief Surveyor, Invercargill.

No compensation will be given, nor shall any be claimed, for any error, discrepancy, or misdescription whatever in respect of the lot or in these conditions.
