Now, therefore, I, William Lee, Baron Plunket, the Governor of the Dominion of New Zealand, in exercise of the powers and authorities conferred on me by sections thirteen, twenty-nine, and one hundred and eighty-eight of "The Public Works Act, 1905," and of every other power and authority in anywise enabling me in this behalf, do hereby proclaim and declare that the land mentioned in the Schedule hereto is hereby taken for the purposes above mentioned.

Given under the hand of His Excellency the Right Honourable William Lee, Baron Plunket, Knight Commander of the Most Distinguished Order of Saint Michael and Saint George, Knight Commander of the Royal Victorian Order, Governor and Commander-in-Chief in and over His Majesty's Dominion of New Zealand and its Dependencies; and issued under the Seal of the said Dominion, at the Government House, at Wellington, this fourteenth day of August, in the year of our Lord one thousand nine hundred and eight.

Allocating Land reserved and taken for a Railway to the Purposes of a Road at Matamata, in the County of Piako.

A PROCLAMATION.

WHEREAS the land mentioned in the Schedule hereto forms part of land taken for the purposes of the Thames Valley and Rotorua Railway, and it is considered desirable to allocate such land to the purposes of a road:

And whereas it has been certified by the Minister for Railways that such land is not required for railway purposes: And whereas such land is situated in the County of Piako, the local authority of which has assented to the issue of this Proclamation:

And whereas His Excellency the Governor is of opinion that the said local authority can conveniently construct and maintain the said road:

Now, therefore, I, William Lee, Baron Plunket, the Governor of the Dominion of New Zealand, in exercise and pursuance of the powers and authorities vested in me by section one hundred and ninety-seven of "The Public Works Act, 1905," and of every other power and authority in anywise enabling me in this behalf, do hereby proclaim and declare that the land described in the Schedule hereto shall, upon the publication hereof in the New Zealand Gazette, become a road, and that the said road shall be under the control of the Piako County Council, and shall be maintained by the said Council in like manner as other public highways are controlled and maintained by the said Council.

SCHEDULE.

ALL that area in the Auckland Land District, containing 1 acre 1 rood 8 perches, more or less, being portions of railway land in the Wharetangata and Turanga-o-Moana Blocks, in the Tapapa Survey District, at Matamata Station, on the Rotorua Branch Railway, and being bounded as follows: On the west by the western boundary of the railway land, a distance of 2612.2 links; on the south by the southern boundary of the railway land, a distance of 50 links; on the east by a line parallel to and 50 links distant from the said western boundary of the railway land, a distance of 2586.4 links; and on the north-east by the south-west side of the road forming the north-eastern boundary of the railway land, a distance of 56 links: as the said piece of land is more particularly shown coloured purple on plan marked W.R. 16319 in the office of the Minister for Railways, at Wellington.

Land taken for a Native School at Matihetihe.

PLUNKET, Governor.

ORDER IN COUNCIL.

At the Government House, at Wellington, this fourth day of August, 1908.

Present:
HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS the land mentioned in the Schedule hereto is required for a certain public work, to wit, a Native school:

And whereas the Native owners have agreed to make a free gift of the said land to His Majesty the King, and it has been made to appear that such agreement is sufficient for the purposes intended to be effected thereby:

And whereas by a partition order made by the Native Land Court, bearing date the ninth day of October, one thousand nine hundred and six, certain aboriginal Natives are declared to be the owners of the Moetangi B2 No. 2 Block, within which the said land is situated:

And whereas, as required by "The Public Works Acts Compilation Act, 1905," a map has been prepared showing accurately the position and extent of the said land, and such map is hereto attached:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in exercise and pursuance of the powers and authorities conferred by "The Public Works Acts Compilation Act, 1905," and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the land shown upon the said map, and described in the Schedule hereto, is hereby taken for the purposes of the said Native school, and shall vest in His Majesty the King, as from the twenty-first day of September, one thousand nine hundred and eight.
