Order in Council under the provisions of this section shall take effect until after the expiration of two months from the date of the publication thereof in the Gazette: Provided also that every alienation under the provisions of this section shall be confirmed by the Court in terms of section fifty-three of the said Act:

And whereas the Aotea District Maori Land Board, by a recommendation made on the twenty-sixth day of May, one thousand nine hundred and eight, and received on the eighth day of June, one thousand nine hundred and eight, has recommended the Governor to except from the operation of section one hundred and seventeen of “The Native Land Court Act, 1894,” for the purpose of alienation by way of mortgage, the block or parcel of land particularised and set out in the Schedule hereto:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred upon him by section four of “The Native Land Laws Amendment Act, 1895,” and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby except the said land from the operation of section one hundred and seventeen of “The Native Land Court Act, 1894,” for the purpose of alienation by way of mortgage to the Government Advances to Settlers Office.

SCHEDULE.

ALL that piece or parcel of land, situate in the Ohinewairua Survey District, containing 515 acres, more or less, known as Awarua No. 3A2E No. 3, and comprised in a partition order of the Native Land Court bearing date the 28th day of May, 1904.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-eighth day of July, 1908.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS, in accordance with the provisions of the third section of “The Land Drainage Act, 1904,” a majority of the ratepayers in the area of land described in the Schedule hereto, situated in the Counties of Waitomo and West Taupo, have presented a petition to His Excellency the Governor of the Dominion of New Zealand praying that the said area be constituted a drainage district under the provisions of the said Act:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the power and authority contained in the third section of “The Land Drainage Act, 1904,” and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby constitute and declare the area of land described in the Schedule hereto to be a district for the purposes of Part I of the said Act, and to be called by the name of the “Kawa Drainage District”; and also, in pursuance and exercise of the power and authority contained in the fourth section of the said Act, doth hereby declare that the Board of Trustees for the said district shall consist of five persons, to be elected as members of the said Board under and in accordance with the said Act.

SCHEDULE.

KAWA DRAINAGE DISTRICT.

ALL that area in the Auckland Land District bounded by a line commencing at the intersection of the northern boundary of Section No. 1, Block X, Puniu Survey District, by the North Island Main Trunk Railway line; thence easterly along the northern boundary of that section and the northern boundary of Ouruwhero No. 3x Block to its north-eastern corner; thence southerly along the eastern boundaries of Ouruwhero Nos. 3x, 3H, and 3s Blocks to the south-eastern corner of the last-mentioned block; thence westerly along the southern boundaries of Ouruwhero Nos. 3s and 3t Blocks and the northern boundary of Section No. 3, Block XIV, Puniu Survey District, to Puketarata Road; thence along that road to the south-western boundary of Section No. 3, Block XIII, Puniu Survey District; thence along the south-western boundary of that section, the southern and western boundaries of Section No. 9, and the southern boundaries of a Native reserve and Section No. 13, Block XIII aforesaid, to the Kakepuku Road; thence northerly along that road and the road intersecting the western portion of Kakepuku No. 9B Block, in Block XII, Pirongia Survey District, to a point in line with the northern boundary of Section No. 3, Block IX, Puniu Survey District; thence easterly along a right line to the northernmost corner of the last-mentioned section; thence along the northern boundaries of Sections Nos. 3, 4, 5, and 6, Block IX aforesaid, and the northern boundaries of Kakepuku 11 Nos. 2E and 2F Blocks, to the easternmost corner of the last-mentioned block; thence along a right line to the north-western corner of Kakepuku 10B No. 2 Block; thence along the northern boundary of the last-mentioned block to the railway-line; and thence southerly along the railway-line to the place of commencement.

Extension of Time for Preparation of County Rolls, Cheviot County.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-eighth day of July, 1908.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS it has been made to appear that, owing to unavoidable circumstances, the preparation of the rolls for the County of Cheviot, and the taking of certain steps consequent on such preparation, cannot be made and taken within the times limited by “The Counties Act, 1886,” and it is expedient to extend the said times respectively:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in exercise and pursuance of the powers conferred upon him by “The Counties Act Amendment Act, 1903,” and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the several dates mentioned in the Schedule hereto shall be the respective dates for taking the several steps set out in the said Schedule.

SCHEDULE.

  1. For preparing the defaulters’ list and the rolls for ridings within the County of Cheviot: Until the 22nd day of August, 1908.

  2. Time for which such list and rolls shall be open for inspection: From the 27th day of August, 1908, to the 15th day of September, 1908.

  3. Time for appeals against the said rolls: Until the 30th day of September, 1908.

  4. Revision Courts may sit for hearing applications with reference to the said rolls, and adjourn: Until the 20th day of October, 1908.

  5. Time when the said rolls, having been duly corrected and signed, shall come into force: On the 31st day of October, 1908.

Licensing Joseph Evans to use and occupy a Part of the Foreshore of Waipapakauri River as a Wharf-site.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-eighth day of July, 1908.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS, there being no Harbour Board empowered to grant the license hereinafter mentioned, Joseph Evans, of Waipapakauri (hereinafter called “the licensee”), has applied to the Governor in Council for a license under “The Harbours Act Amendment Act, 1883” (hereinafter called “the said Act”), to occupy a part of the foreshore in Waipapakauri River, in the County of Mongonui, in order to construct and maintain thereon a wharf; and, in accordance with the one-hundred-and-fifty-sixth section of “The Harbours Act, 1878,” has deposited plans in the office of the Marine Department at Wellington (marked M.D. 2360) showing the place where it is intended to construct such wharf, the area of foreshore intended to be occupied for such purpose, and the manner in which it is proposed to carry out the work: And whereas it has
