Authorising the Laying-off of a Street through Subdivision
of Section 75, Hutt District, Block VIII, Belmont Survey
District, Borough of Lower Hutt, of a Width less than
66 ft., but not less than 40 ft.
PLUNKET, Governor.
ORDER IN COUNCIL.
At the Government House, at Wellington, this eighteenth
day of February, 1908.
Present:
His Excellency the Governor in Council.
WHEREAS by section two hundred and thirty-six of
“ The Municipal Corporations Act, 1900,” it is,
inter alia, provided that where the configuration of any
borough is such as that within any particular area or areas
thereof it is difficult or inexpedient to construct streets of
the width of sixty-six feet as required by the said Act, the
Governor may, by Order in Council defining the limits of
such particular area or areas, authorise the Council to per-
mit within such area or areas the construction of streets
and private streets of a width less than sixty-six feet, but
not less than forty feet:
And whereas the configuration of the Borough of Lower
Hutt is such that within the area described in the Schedule
hereto it is inexpedient to construct a street of sixty-six
feet:
Now, therefore, in pursuance and in exercise of the powers
vested in him by “ The Municipal Corporations Act, 1900,”
and its amendments, and of all other powers in anywise
enabling him in this behalf, His Excellency the Governor of
the Dominion of New Zealand, acting by and with the
advice and consent of the Executive Council of the said
Dominion, doth hereby permit within the area described in
the Schedule hereto the laying-off of a street within the
said area of a width less than sixty-six feet, but not less
than forty feet.
SCHEDULE.
ALL that piece of land in the Wellington Land District and
Lower Hutt Borough comprising Subdivisions 33, 1, 2, 3,
4, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, 15, 16, and 17 of Section 75,
Hutt District, Block VIII, Belmont Survey District; as the
said land is more particularly delineated on the plan marked
R. 9688, deposited in the office of the Chief Engineer of
Roads, at Wellington, in the Wellington Land District, and
thereon bordered blue.

Native Land in Opoiti Survey District taken for the Purposes
of a Cemetery.
PLUNKET, Governor.
ORDER IN COUNCIL.
At the Government House, at Wellington, this eighteenth
day of February, 1908.
Present:
His Excellency the Governor in Council.
WHEREAS the land mentioned in the Schedule hereto
is Native land and is required to be taken for the
purposes of a cemetery:
And whereas the said land is held or occupied by Native
owners under a title which is not derived from the Crown:
And whereas a map of the said land has been prepared in
duplicate, as required by the eighty-ninth section of “ The
Public Works Act, 1905 ”:
Now, therefore, in pursuance and in exercise of the powers
vested in him by “ The Public Works Act, 1905,” and of all
other powers in anywise enabling him in this behalf, His
Excellency the Governor of the Dominion of New Zealand,
acting by and with the advice and consent of the Executive
Council of the said Dominion, doth hereby proclaim and
declare that the land shown upon such map, and described
in the Schedule hereto, is hereby taken for cemetery pur-
poses as aforesaid; and the said land shall vest in His
Majesty the King as from the twenty-eighth day of February,
one thousand nine hundred and eight.

Works, at Wellington, in the Provincial District of Wel-
lington, and thereon coloured as above.

ERRATUM.—On page 755, New Zealand Gazette No. 15, 27th February, 1908, notice re closing-days for shops in
counties, insert “ Rotorua, Wednesday,” after “ Rodney, Saturday,” and before “ Stratford, Thursday.”
