  1. Each applicant shall state his or her residence, occupation, and condition in life (namely, whether married or single), and will be required to make the prescribed declaration.

  2. Each applicant shall pay the first half-year's rent, together with the lease and registration fee (£1 1s.), and the value of the improvements, immediately the application has been approved or declared successful at the ballot, also the rent for the period elapsing between the date of the lease and the due date of such half-yearly payment.

  3. All rents must be paid half-yearly, in advance, on the 1st days of January and July in each year, as provided in section 157 of the said Act; and the first half-year's rent is payable as before provided.

  4. Improvements and residence on the land comprised in each lease shall be as provided in Part III of the said Act. The provisions of section 144, and all other provisions of the said Act with respect to substantial improvements, shall apply accordingly to lessees under these regulations. The provisions of section 141, and all other provisions of the said Act in respect of compulsory residence, shall apply accordingly to lessees under these regulations.

  5. No lessee shall divide, sublet, or transfer the land held by him under these regulations, except under and subject to the provisions of Part I of the said Act.

  6. No lessee shall hold more than one allotment, and such allotment shall be held for his or her sole use and benefit, and not for the use or benefit of any other person whomsoever. Each section is an allotment. No married woman shall be eligible as a selector; but this provision shall not apply to any married woman who may become a transferee under a will or by virtue of an intestacy.

  7. All the provisions of the said Act, so far as applicable, shall extend and apply to the lands affected by these regulations, and to the applications and leases to be made and issued thereunder, and generally to the interests created, and the persons whose rights, liabilities, or interests are thereby affected; and the mention of any particular provision of the said Act shall not be deemed to exclude any other provision of the said Act applicable to the particular case.

Vesting Reserves in the Levels County Council.

PLUNKET, Governor.

ORDER IN COUNCIL.

At the Government Buildings, at Wellington, this fourth day of February, 1908.

Present:

THE RIGHT HONOURABLE SIR J. G. WARD, K.C.M.G.,
PRESIDING IN COUNCIL.

WHEREAS the lands mentioned in the Schedule hereto have been permanently reserved for gravel purposes:

And whereas, in the opinion of the Governor, it is expedient that the said lands should be vested in the Levels County Council:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in exercise of the powers and authorities vested in him by the fourth section of “The Public Reserves Act, 1881,” doth hereby declare that, from and after the day of the date hereof, the reserves mentioned in the Schedule hereto shall become vested in the Chairman, Councillors, and Inhabitants of the Levels County, in trust, as reserves for gravel purposes.


SCHEDULE.

All that area in the Canterbury Land District, containing by admeasurement 1 acre 2 roods, more or less, being Reserve No. 3531 (in red), Block VIII, Pareora Survey District (Papaka Settlement). Bounded towards the north-west by Section No. 2, Block VIII, Pareora Survey District, 375 links; towards the north-east by the said Section No. 2, 400 links; towards the south-east by the said Section No. 2, 375 links; and towards the south-west by a road-line, 400 links.

Also all that area in the Canterbury Land District, containing by admeasurement 1 acre, more or less, being Reserve No. 3532 (in red), Block VIII, Pareora Survey District (Papaka Settlement). Bounded towards the north-west by Section No. 3, Block VIII, Pareora Survey District, 290 links; towards the north-east by the said Section No. 3; 250 links; towards the south-east by the said Section No. 3, 543·4 links; and towards the west by a road-line, 359·4 links.

Be all the aforesaid linkages more or less; as the same are delineated on the plan marked S.G. 19218/14, deposited in the Head Office, Department of Lands, at Wellington, and thereon coloured blue.

And whereas, in the opinion of the Governor, it is expedient to vest the said reserves in the Hampden Borough Council:

Now, therefore, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in exercise of the powers and authorities vested in him by the twenty-fourth section of “The Public Reserves Act, 1881,” doth hereby declare that, from and after the day of the date hereof, the reserves described in the Schedule hereto shall become vested in the Mayor, Councillors, and Burgesses of the Hampden Borough, in trust, for public-recreation purposes.
