ORDER IN COUNCIL
At the Government Buildings, at Wellington, this seventeenth day of December, 1908.
Present:
THE RIGHT HONOURABLE SIR J. G. WARD, K.C.M.G., PRESIDING IN COUNCIL.
IN pursuance and exercise of the powers and authorities conferred upon him by “The Education Act. 1908,” and of all other powers and authorities him enabling in this behalf, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby, in respect of the regulations made by Order in Council dated the third day of December, one thousand nine hundred and two, under the authority of “The Manual and Technical Instruction Act, 1902,” revoke clause sixteen thereof, and in respect of the regulations made by Orders in Council dated the twenty-third day of March and the twenty-third day of May, one thousand nine hundred and eight, respectively, under the authority of “ The Education Act, 1904,” revoke clauses twenty-six (e) and thirty-six thereof, and in lieu of the said clauses doth make the regulations set forth in the Schedule hereto ; and with the like advice and consent doth declare that this Order shall come into force on the first day of January, one thousand nine hundred and nine.
SCHEDULE.
I. SCHOOL CLASSES.
16. Except in the case of a secondary school or the secondary department of a district high school, claims on account of any pupil who attends two or more classes must not exceed 15s. per annum; except that where one of the classes attended by the pupil is (i) a class for woodwork or work in iron, (ii) a class for cookery or dairy-work, in respect of which payment is claimed at the higher rate specified in clauses 24 (b) and 25 (b) of these regulations, up to 20s. per annum in the case of (i) and 17s. 6d. in the case of (ii) may be claimed.
26. (e.) Where there is no female teacher on the staff of a public school below Grade IV, a payment of 10s. per annum will be made for each unit of the average attendance of the pupils on the roll of such school who receive instruction in needlework, as defined in the Standard Regulations, for not less than two hours a week regularly throughout the school year: Provided that in the case of a school of Grade I, II, or III the total of the payments for instruction in needlework shall not be less than £6 per annum.
II. “ SPECIAL ” AND “ ASSOCIATED ” CLASSES.
36. Except in the case of classes for teachers or of classes conducted in country districts by itinerant instructors, capitation shall not be paid on account of any class which has not received regular instruction during a period of at least ten weeks, and for at least twenty hours during the year.
Nor shall capitation be paid on account of any student for more than eight hundred hour-attendances per annum for all subjects altogether. Nevertheless payment shall not be made for more than six hundred hour-attendances per annum for all subjects altogether after the lst day of January, 1909, nor for more than four hundred hour-attendances per annum for all subjects altogether after the lst day of January, 1910, on account of any student taking a course of commercial instruction.

Amending Trout-fishing Regulations for Rotorua Acclimation District.

THE RIGHT HONOURABLE SIR J. G. WARD, K.C.M.G., PRESIDING IN COUNCIL.
WHEREAS regulations for trout-fishing were made by the Governor in Council on the twenty-eighth day of September, one thousand nine hundred and eight, and published in the New Zealand Gazette of the first day of October following: And whereas it is desirable to amend clause two of the said regulations:
Now, therefore, His Excellency the Governor of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities vested in him by “ The Fisheries Act, 1908,” and of all other powers and authorities enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the words “ twentieth day of December” shall be omitted from clause two of the said regulations of the twenty-eighth day of September, one thousand nine hundred and eight, and that the words “first day of February” shall be substituted therefor.
