And whereas the Maniapoto-Tuwharetoa District Maori Land Board, by a recommendation made on the fifteenth day of March, one thousand nine hundred and seven, and received on the eleventh day of June, one thousand nine hundred and seven, has recommended the Governor to except from the operation of section one hundred and seventeen of “The Native Land Court Act, 1894,” for the purpose of alienation by way of lease, the block or parcel of land known as Pirongia West No. 3B Section 2F:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance and exercise of the power and authority conferred upon him by section four of “The Native Land Laws Amendment Act, 1895,” and acting by and with the advice and consent of the Executive Council of the said colony, doth hereby except from the operation of section one hundred and seventeen of “The Native Land Court Act, 1894,” for the purpose of alienation by way of lease for twenty-one years, without right of renewal, the block or parcel of land particularised and set out in the Schedule hereto.

SCHEDULE.

ALL that piece or parcel of land, situate in the Kawhia North Survey District, in the Land District of Auckland, containing 306 acres, more or less, known as Pirongia West No. 3B Section 2F, and being the whole of the land comprised in a partition order of the Native Land Court dated the 5th day of May, 1899.

Excepting Land from the Operation of Section 117 of “The Native Land Court Act, 1894.”

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-third day of August, 1907.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS by section four of “The Native Land Laws Amendment Act, 1895,” it is enacted that the Governor may, by Order in Council, except from the operation of section one hundred and seventeen of “The Native Land Court Act, 1894” (hereinafter called “the said Act”), for a limited period or otherwise, and either generally or for such purposes and subject to such restrictions as shall be in such Order specified, any land, wheresoever situate, which is for the time being subject to the operation of the said section, or any interest therein or right over the same, or may in like manner make such exception in favour exclusively of any lessee or other person who has been bond fide in occupation of and has made improvements on such land, or has paid money to Native owners for lease or purchase thereof, prior to the passing of the said Act: Provided that no Order in Council under the provisions of this section shall take effect until after the expiration of two months from the date of the publication thereof in the Gazette: Provided also that every alienation under the provisions of this section shall be confirmed by the Court in terms of section fifty-three of the said Act:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, in pursuance and exercise of the power and authority conferred upon him by section four of “The Native Land Laws Amendment Act, 1895,” and acting by and with the advice and consent of the Executive Council of the said colony, doth hereby except from the operation of section one hundred and seventeen of “The Native Land Court Act, 1894,” for the purpose of alienation by way of sale, the interest of Riakiao Wharepa in the block or parcel of land particularised and set out in the Schedule hereto.

ALL that piece or parcel of land, situate at the Chatham Islands, containing 3 acres and 34 perches, more or less, known as Kekerione No. 65, or Piharonga, and being the whole of the land comprised in a partition order of the Native Land Court dated the 10th day of August, 1900, in favour of Rihania Wharepa.

Exchanging a Reserve in Auckland Land District for other Land.

ORDER IN COUNCIL.

At the Government House, at Wellington, this twenty-third day of August, 1907.

Present:

HIS EXCELLENCY THE GOVERNOR IN COUNCIL.

WHEREAS the land mentioned in the first column of the Schedule hereto was permanently reserved for a site for a market-house: And whereas, in the opinion of the Governor, it is expedient to exchange the said land for that described in the second column of the Schedule hereto:

Now, therefore, His Excellency the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, and in exercise of the powers and authorities vested in him by the fourth section of “The Public Reserves Act, 1881,” doth hereby declare that the said reserve described in the first column of the Schedule hereto is hereby exchanged for the land described in the second column of the Schedule hereto.

All that area in the Auckland Land District, containing by admeasurement 2 roods 36·1 perches, more or less, being Section No. 106, Town of Hamilton West. Bounded towards the north-east by Victoria Street, 133 links; towards the south-east by Section No. 105, 549 links; towards the south-west by Section No. 476, 133 links; and towards the north-west by a road, 549 links: be all the aforesaid linkages more or less: as the same is delineated on the plan marked S.G. 57042/12A, deposited in the Head Office, Department of Lands, at Wellington, and thereon bordered red. All that area in the Auckland Land District, containing by admeasurement 2 roods 36·1 perches, more or less, being Section No. 476, Town of Hamilton West. Bounded towards the north-east by Section No. 106, 133 links; towards the south-east by Section No. 477, 549 links; towards the south-west by Selkirk Street, 133 links; and towards the north-west by a road, 549 links: be all the aforesaid linkages more or less: as the same is delineated on the plan marked S.G. 57042/12, deposited in the Head Office, Department of Lands, at Wellington, and thereon bordered red.

Commission to inquire into the Coal-mining Disaster at Nightcaps.

To all to whom these presents shall come, and to William Reeve Haselden, Esquire, of Wellington, District Judge; Huntly John Harry Eliott, of Hutt, Esquire; Henry Andrew Gordon, Esquire, of Auckland, Mining Engineer; and Alexander Forbes, Esquire, of Kaitangata, Secretary to the Otago Coal-miners’ Union of Workers: Greeting.

WHEREAS a disaster occurred at the coal-mine at Nightcaps, known as the Nightcaps Colliery, the property of the Nightcaps Coal Company (Limited), on the twenty-first day of June last, which caused the deaths of three persons working therein: And whereas it is expedient that a Commission should be issued for the purpose of inquiring into the cause of the said disaster, and into the working of the existing law in respect to the prevention of such disasters, and for the other purposes hereinafter mentioned:

Now, therefore, know ye that I, William Lee, Baron Plunket, the Governor of the Colony of New Zealand, reposing trust and confidence in your knowledge, integrity, and ability, and acting by the advice and with the consent of the Executive Council of the said colony, do hereby, in exercise of the powers conferred on me by “The Commissioners Act, 1903,” and of all other powers and authorities
