in any case where the local authority having control of a
road or street by resolution declares that the provisions
thereof shall not apply to any specified road or street, or
any specified part thereof, and such resolution is approved
by the Governor in Council:
And whereas by section three of “The Public Works Act
Amendment Act, 1906,” it is provided that such approval
may be either absolute or subject to such conditions as the
Governor by Order in Council thinks fit to impose:
And whereas on the twenty-third day of January, one
thousand nine hundred and seven, the Wanganui Borough
Council, the local authority having control of the portion
of the street described in the Schedule hereto, did by reso-
lution declare that the provisions of the said section one
hundred and seventeen should not apply to the said portion
of the street:
And whereas it is deemed expedient that such resolution
should be approved:
Now, therefore, His Excellency the Governor of the Colony
of New Zealand, in pursuance and in exercise of the powers
conferred by the above-in-part-recited Acts, and acting by
and with the advice and consent of the Executive Council
of the said colony, doth hereby approve of the said resolu-
tion.

SCHEDULE.
THAT portion of London Street from Victoria Avenue to
Russell Street, within the Borough of Wanganui, in the
Wellington Land District; as the said portion of street is
more particularly delineated on plan marked R. 8657,
deposited in the office of the Chief Engineer of Roads,
at Wellington, in the Wellington Land District, and thereon
coloured red.

Consenting to closing Road in Clutha County.

ORDER IN COUNCIL.
At the Government House, at Wellington, this twenty-
third day of August, 1907.
Present:
His Excellency the Governor in Council.
WHEREAS by section one hundred and thirty-three,
(a), of “The Public Works Act, 1905,” it is enacted that a local authority shall not declare any county
or district road to be stopped, and such road shall not be
deemed to be stopped, until the consent thereto of the
Governor by Order in Council gazetted is obtained:
And whereas the Clutha County Council has applied for
such consent in respect to the road described in the Sche-
dule hereto:
Now, therefore, in pursuance and in exercise of the
above-in-part-recited Act, and of all other powers in any-
wise enabling him in this behalf, His Excellency the Go-
vernor of the Colony of New Zealand, acting by and with
the advice and consent of the Executive Council of the said
colony, doth hereby consent to the Clutha County Council
closing the road mentioned in the Schedule hereto.
