Land in Block IX, Kaitawa Survey District, taken for the Purposes of a Post-office.

A PROCLAMATION.

WHEREAS the land mentioned in the Schedule hereto is required to be taken, under “The Public Works Act, 1905,” for the purposes of a post-office:

And whereas an agreement for the taking of the estate in fee-simple of the said land has been entered into, and it has been made to appear that such agreement is sufficient for the purposes intended to be effected thereby:

And whereas a plan has been prepared in duplicate showing accurately the position and extent of the said land, and the Minister for Public Works has recommended that this Proclamation should be issued:

Now, therefore, I, William Lee, Baron Plunket, the Governor of the Colony of New Zealand, in exercise and pursuance of the powers and authorities in me vested by “The Public Works Act, 1905,” and of every other power and authority in anywise enabling me in this behalf, do hereby proclaim and declare that the land mentioned in the Schedule hereto is hereby taken for the purposes of a post-office as aforesaid; and it is hereby declared that this Proclamation shall take effect on and after the twenty-sixth day of July, one thousand nine hundred and seven.


SCHEDULE.

The parcel of land mentioned hereunder:—

A. R. P. 0 1 1 Section No. 4 (Parata Township) IX Kaitawa.

In the Land District of Wellington; as the same is more particularly delineated on the plan marked P.W.D. 22773, deposited in the office of the Minister for Public Works, at Wellington, in the Provincial District of Wellington, and thereon coloured red.

Cancelling Proclamation taking Land in Block IX, Kaitawa Survey District, for the Purposes of a Post-office.

A PROCLAMATION.

WHEREAS by the twenty-third section of “The Public Works Act, 1905,” it is enacted that in any case where a Proclamation has been issued taking land for any public work, and where before such Proclamation has been registered by the District Land Registrar it is found that such Proclamation incorrectly describes the land purporting to be taken, or that any other error in form or substance exists in or in relation to such Proclamation, the Governor may by a subsequent Proclamation cancel and annul such first-mentioned Proclamation, or any part thereof: And whereas an error in substance exists in a Proclamation made under “The Public Works Act, 1905,” dated the fourteenth day of June, one thousand nine hundred and seven, taking land in Block IX, Kaitawa Survey District, for the purposes of a post-office, and published in the New Zealand Gazette of the twentieth day of June, one thousand nine hundred and seven, and such Proclamation has not been registered by the District Land Registrar as provided by the first-mentioned Act:

Now, therefore, I, William Lee, Baron Plunket, the Governor of the Colony of New Zealand, in exercise of the powers and authorities vested in me by “The Public Works Act, 1905,” do by this Proclamation hereby cancel and annul the said Proclamation dated the fourteenth day of June, one thousand nine hundred and seven, and published in the New Zealand Gazette of the twentieth day of June, one thousand nine hundred and seven, taking land as specified therein.

Given under the hand of His Excellency the Right Honourable William Lee, Baron Plunket, Knight Commander of the Most Distinguished Order of Saint Michael and Saint George, Knight Commander of the Royal Victorian Order, Governor and Commander-in-Chief in and over His Majesty’s Colony of New Zealand and its Dependencies; and issued under the Seal of the said Colony, at the Government House, at Wellington, this twentieth day of July, in the year of our Lord one thousand nine hundred and seven.

Resuming Land held under Lease in Perpetuity for the Purpose of a Road.

A PROCLAMATION.

WHEREAS by section one hundred and twenty-five of “The Land Act, 1892” (hereinafter termed “the said Act”), it is, inter alia, enacted that the Governor in Council may, by Proclamation, resume possession of any land leased under Part III of the said Act which in his opinion is required for any public purpose:

And whereas the land described in the Schedule hereto forms part of land which is held on lease in perpetuity from His Majesty the King under the said Act, “The Land for Settlements Consolidation Act, 1900,” and “The Land for Settlements Amendment Act, 1901,” such lease being dated the eleventh day of June, one thousand nine hundred and two: And whereas in the opinion of the Governor the land described in the Schedule hereto is required for a public purpose—that is to say, for a road:

Now, therefore, in pursuance and exercise of the powers and authorities conferred upon me by section one hundred and twenty-five of “The Land Act, 1892,” and section sixty-one of “The Land for Settlements Consolidation Act, 1900,” and of all other powers and authorities in anywise enabling me in that behalf, I, William Lee, Baron Plunket, the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, do hereby proclaim and declare that I hereby resume possession of the land mentioned in the Schedule hereto for the public purpose hereinbefore mentioned, the same being part of the land as held under lease as aforesaid; and do also hereby proclaim and declare that this Proclamation shall take effect on the twenty-fifth day of July, one thousand nine hundred and seven,
